Bangalore: Why Do Police Take Perpetrators' Side in Rape Cases? - Chief Justice

Bangalore, Nov 8: With series of rape incidents hitting media limelight, the Karnataka High Court has directed the state police to submit a status report on the investigations into recent incidents of rape in the city by November 22.

A Division Bench headed by Chief Justice Vikramajit Sen gave the directive on Thursday during the hearing of a public interest litigation filed by advocate M K Vijaykumar.

The petitioner had sought a direction to the police to strictly follow the directions and guidelines issued by the High Court and the Supreme Court while investigating rape and gang-rape incidents.

The advocate in his petition had also asked the court to direct police officers not to be influenced by politicians while carrying out investigation of rape and gang-rape incidents.

The High Court had earlier issued notice to the Centre and State authorities on the PIL.

During the course of the hearing, the Chief Justice observed, “I never understand why the police always seem to take the side of the perpetrators rather than the victims whether it is in Haryana or Karnataka.”

The petition had been filed in the backdrop of two incidents of alleged gang-rape of a law student from Nepal and three bar girls by a group of persons in the city recently.

Police have arrested eight persons in connection with the rape of the Nepali student, who incidentally was the main reason behind arrest of the culprits as she gave a detailed and rather accurate description to the police sketch artists.

    There are very few judges who comment on social evils. We need more and more judges like the Chief Justice of Karnataka so that evils like rape can be controlled if not totally eliminated.

    Speceally and particularly in Mangalore - D.K.
    As long as Govt supports what police can do?
    They are the servent for Govt.
    If they try their best, immidiately they be sent for better training in Scotland and we all are all evident for this.

    rape will not stop.

    Rapist should be hanged.

    low court decision should be final.

    I had a matter in the High Court of Karnataka.The matter was fully heard. The High Court website mentions that my plea is ALLOWED.But the concerned judge refuses to sign the judgement. Hence I cannot apply for a certified copy to take further action.It is one and a half years now.In the meanwhile my High Court Advocate filed 3 memo's to release the Judgement.But with no luck.

    I wrote to the Chief Justice of Karnataka about it. But I have not received a reply.

    Is there anybody else I could write to ? What is the legal procedure ?

    My HC Advocate is shy to talk to the Judge about it for fear of retribution in others cases.

    I need your legal guidance.

    I am sure many of Daijiworld readers are having a similar problem regarding the High Court of Karnataka.

    Justice saab , your intention is good. But also consider , there are lot of fake cases going arround , often framing innocent men. Its become cheap bussiness often peaple with hidden agenda and also feminist elements. I hope you will not give serious thought of pushing a lot cases of eloping ( even minor ) into 'rape ' category. Also going bit slow on perpetuaters is good , becoz it gives them opportunity to get the evidence in case they r innocent. In case , convict gets evidencse agains thim , he gets fair trial too.

    Answer is very simple, accused is willing to offer bribe(to escape from punishment) and victims are not willing to bribe...

    Good question by CJ of HC.Perhaps 1)Money plays a role 2)Political interference 3)caste/community also plays a role 4)Govt's style of functioning/accountability and responsibility(Home department and Officers)attitude also plays a role.Victims in such cases always in recieving end therefore,rape cases even not reported properly to authorities and fortunately,reported so many hurdles have to face from officers to society as a whole.

    Police are eagerly waiting for such cases which gives them hefty ghoose. If no ghoose, from where they will feed politicians for transfers for their desired locations.

    There is a chain corrupt people from top to bottom and if two police officers are good what they will achieve and the others all undermine his good works.

    Few judges are good but most of the judges are ghoose liking.
    God only should save good people from wicked people.
