Bangalore: High Court Rejects Bail Plea of Journalist Naveen Soorinje

Bangalore, Dec 26: In a setback to jailed journalist Naveen Soorinje, the high court on Wednesday December 26 rejected his bail plea in connection with the July 28 attack on a home stay at Padil in Mangalore.

The court also dismissed the bail petitions of Taranath Alva and Venugopal, members of the group that allegedly carried out the attack.

A journalist with a Kannada TV channel, Soorinje was arrested on November 7 by Kankanady police led by inspector Ravish Naik.

Dismissing Soorinje's bail plea, Justice K N Keshavanarayana said that Soorinje had failed to inform the police despite having information about the attack on boys and girls celebrating a birthday at the home stay. In addition, by recording the video of the attack and flashing it repeatedly on television, the dignity of the students had been put at stake, he said.

The judge in his statement also said that as the students who were attacked resided in Mangalore, there may be chances that they would be threatened. Also, granting bail to Soorinje was not an issue of public interest, he said while rejecting the journalist's bail plea.

The high court had earlier ordered a stay on the FIR lodged against Soorinje, and a copy of the order was sent through fax on November 20.
 
As it was not an attested copy, the third JMFC judge in Mangalore had asked for clarification over the release of Naveen Soorinje.

On July 28 this year, a group of HJV activists had attacked boys and girls celebrating a birthday at Morning Mist Home Stay at Padil, alleging that they were indulging in a rave party. The police have arrested 29 persons, including Soorinje, in connection with the case. The court has denied bail to all the arrested.


Soorinje in Hospital

Meanwhile, Naveen Soorinje on Tuesday December 25 was hospitalized in Mangalore with symptoms of chicken pox.

Soorinje developed high fever and rashes on Monday December 24 night, and was taken to Wenlock hospital on Tuesday afternoon.

He has been kept under observation at the hospital block meant for jail inmates.

    Let us think that Mr. Soorinje had information and he did not inform police...!!!! After police came to the villa, what they did..what action they took..!!!??? The guy's attacked were arrested next day and Victims were taken into custody same time. Mr. Soorinje did a good thing video shooting the whole episode..otherwise no one would have been caught in this incident....!!!???? Police could have acted as if noting has happened...!!????

    Comeone Just you are expressing your feeling with sad, one of the lady from mangalore crying in last night party, because of kalamady incident and she was explaining this kind of cruel act from bajarangdal to one of the newzeland Citizen even he got shocked.just you are telling whats happening in karnataka ? people lost faith in karnataka because day by day this kind of cruel act is increasing.no body is there to reply with strong weapon,some time too silent also danger. police force also not doing anything.

    The High Court is certainly right by not granting bail .Naveen Soorinje had prior information of what was to happen and never informed the cops, as one report had earlier mentioned. Just imagine if someone..... was ( to be ) murdered or something as grave as the Delhi incident ? The graveness of the incident would have been known only after the act.

    The decesion of the court needs to be uplauded as it was a good move.Naveen had the information about the attack and stands in contempt of civic, ethical, moral and human values. He is a paragon of cowboy media capitalism and political propaganda. We do not need such irresponsible news channels. They went ahead and reported it as news rather than preventing the incident from happening. I seriously feel bad to those kids who were just enjoying a birthday party and ended up being colateral damage to the political agenda of the TV channel and the goons. I hate to say that people like us are being taken for a ride by such anti social elements. We need to imprision such people under sedition laws and not people who post comments on facebook.

    I watch all news Channels. As you know few are owned by Politicians. But Kasturi News is worst among all bcoz it is an online version of JDS. This channel is used by HDK to promote his/party activities and blame BJP and congress. I have obsereved this many times.

    Other news channel maintain some decency in telecasting news, where as Kasturi News not.

    Once I saw breaking news in Kasturi News "Beedige bidda BJP Sarkarada Mana Maryade" on some issue. Immediately I switched on to other news TV9, Suvarna, janashree etc and saw the breaking news "Matte ikkattige silukida BJP Sarakara". This is one example, which clearly shows the purpose of Kasturi Channel.

    Fortunetly for now we dont have to see some half law learned politicians using Navin Soorinje's case to play their vote bank card. The court itself which they threatened to go against the police & home minstry has sailenced them. Atleast now they cant tell we dont agrre wit High court.
    NS's situation is more of personnel revenge fromthe police Dept i feel as the the inspector who took the lead in arrestign is the same whom NS claims he tried calling but in vain. Anyways unfrotunetly, the case is fitted tight and I guess the accused could not provide enough evidence to prove his innosence.
    Also not to forget to appriciate the court for rejecting the bail pleas of the the real attackers. They should rot for some time in Jail.

    I will not blame Mr Navin Soorinje here it is the Total Careless ness attitude of the Kasturi News Channel to which Mr Navin belongs .It is the duty of Owner of the Channel to Train their journalists as to what is right and what is wrong and for every sting operation to be carried out they should inform the responsible person and rather the Channel itself would have taken responsibility on their own shoulders .Young Journalists life has been ruined

    Naveen was able to fool us public but could not fool the court. It was very clear from very beginning that he was part of the group which attacked homestay and hon'ble court has made same observation. Very well written judgement by court. Excerpts below today's "The Hindu" newspaper report:

    While observing that material on record does not project Mr. Soorinje as a “whistle-blower” as claimed by him, the High Court said the material on record “prima facie indicates that he also came to the place along with the group.”

    “Instead of preventing such an incident, prima facie he [Mr. Soorinje] appears to have encouraged the happening of the incident and assisted in videography of the event, and thereafter facilitated its telecast in television channels, which has caused greater damage to the dignity and reputation of the victims,” said Justice K.N. Keshavanarayana, while dismissing the petition filed by Mr. Soorinje, who has been arraigned as accused number 44. ""

    Nothing should be said against Court's verdict.
    Courts are supreme guardians of our constitution and rights.
    Judges have lot of wisdom, power and interest of the nation.
    However, mob culture, riots, moral policing etc are acting as extra constitutional authorities, are THREAT to the authority of courts and LAW enforcing agencies! Riots are reason for diminishing moral values in society and civil disobedience.
