Nitaqat fallout: 18,000 Indians prepare to leave Saudi

Riyadh, May 9 (PTI): Over 18,000 Indians have approached the Indian embassy in Riyadh seeking ‘emergency certificate’ to leave Saudi Arabia amid concerns about possible job losses due to implementation of a new labour law “Nitaqat” that seeks to reserve 10 per cent jobs for locals.

The Indian workers have applied for issuance of Emergency Certificate (EC) to leave the country as they had given their passports to the sponsors.

Over 18,000 applications for issuing ‘Emergency Certificates’ to return to India have been received till May 2, Overseas Indian Affairs Minister Vayalar Ravi said in a written reply to a question in Lok Sabha.

The embassy had started receiving applications for issuance of EC since last week of May.

The ‘Nitaqat’ law makes it mandatory for local companies to hire one Saudi national for every 10 migrant workers. There has been widespread perception that the new policy will lead to denial of job opportunities for a large number of Indians working there.

Over two million Indians are currently working in Saudi Arabia. The Saudi government was implementing the Nitaqat law to cut unemployment in the country.

Ravi said as per the Indian mission in Riyadh, the increase in the number of applications seeking EC was due to Saudi authorities’ campaign against foreign workers staying in the country without fulfilling laid down conditions and not due to Nitaqat.

“This drive affects not only illegal workers from India, but also from all countries from where immigrant workers have come to Saudi Arabia,” he said.

A delegation led by Ravi had visited the Gulf nation two weeks back during which it expressed India’s concern about the Nitaqat law.

During the talks, both the sides had agreed to set up a joint working group to address “all immediate problems” facing the Indian community including issues related to overstaying Indian workers and the new labour law.

Ravi said Government has waived the fee of 7 Saudi Riyals for contribution to the Indian Community Welfare Fund by those who applied for EC and even asked the mission to bear processing cost of 40 Saudi Riyals (Rs 600) per application.

He said government has asked the mission to provide temporary accommodation and food to the needy Indians in Saudi Arabia.

More than 200,000 foreigners have been deported from the country over the past few months as part of labour market reforms aimed at putting more Saudi nationals into private sector jobs, where they now make up only a tenth of the workforce.

Replying to a separate question, Ravi said Kuwaiti authorities had arrested 2,000 Indians in September last year for alleged violation of visa norms and after verification of records around 1,750 were released while rest were deported.

    Local paper reported today there will be meeting with affected labor exporting Country's ambassadors to have one on one meeting to discuss repercussions in relating issue.The labor Minister trying no stone upturned to implement this system with out having any human catastrophe.

    At present,there are ques Kilometers to kilometer in front of MISSIONS pf their respective country of which snaps were bombarded with social media.

    Out of sixty thousand 18000 Indian affected expat's EC(Emergency certificate or emergency travel form)have been issued.These papers are processed by Saudi Passport office to facilitate travel to India.

    Indian Missions in KSA having highly impossible job to accommodate such kind of volume of human refugees.Not only Indian expats but all SOUTH ASIAN Country's illegal expats are camping in front of their respective missions.

    90 days of grace periods were given by HE King of KSA.It is not the issue of 10-1 in some cases!A petty business owned by SAUDI and operated by Indians or foreigners are to be called cover up business which could be asked to shut down by newly appointed Labor inspectors.After investing huge money by expat with sleeping partner or monthly remunerations to Saudi by OPERATOR OF BUSINESS IS illegal (That petty Business operator came in Driver or electrician visa and indulged in ending up with profitable PETTY BUSINESS!!!!

    Another category is those worked with sponsor for a while and escaped to work with others also called as illegals (HUROOB= ESCAPEE)Their passport hand over to security officials...Some sponsor even lodge complaint that he swindled enough money and escaped!!! These type of affected workers will have face difficult in getting EC and clearance from emigration.There are various kind expats who comes under Nitaqat need more time to sort out their issue.In this regard delegations from other labor exporting including India are meeting Minister to ease the serious situation and to get their nationals back HOME.

    This is just the initial hiccups regarding Saudiazation in working class. Myself working for an International Construction Company having branch in Oman too. In Oman we have 30% Omanization which we found too difficult to handle but slowly we come to the terms of localization and its’ nothing wrong to employ them. This is very simple just recruit them as helpers, drivers etc they will absent from work after 10 or 15 days due to scorching humidity but keep them registered in Social Insurance by paying minimum Insurance Premium charges per month but not salary since they were absent. Just think other way around where we play “Kannadiga” or “Maratha” trump cards in Karnataka and Maharashtra

    These guy's who are without passport or passport with the sponsors means they are living/working in Saudi Arabia illegally....!!!??? These are not the guy's who were affected by "Nitaqat"....I dont think labour class people are replaced by Saudi Nationals...!!!????

    Its a personal responsibility of an individual to abide by law of the land. One can't stay in a foreign country without valid documentation (i.e. Passport, Visa) and then, at-once call on the government of origin country to rescue them.

    As for Nitaqat is applicable, if foreign companies cannot afford to employ Saudi Nationals at 10:1 ratio, its best that they shut the shop. Saudi government is not wrong in demanding employment to their citizens like all countries allover the world do the same.

    Given the harsh working conditions of Saudi Arabia, I am sure returning low-scale Indians will find employment in their own country that is invaded by Nepali/Bangladeshi workers.

    Saudi Govt is 100% correct and there is no question on its correctness. But for the affected employees, please make a note that they are also not wrong. They have a valid residence permit (free visa) and as usual passport is with their sponsor. As the sponsor is not releasing their passport they have to seek the assistance from Indian embassy.

    When it is beyond the persons capacity to manage the situation they have to seek the assistance from their nation.

    And it is not so easy to settle back in india for a person who was employed in a foreign country for long time. It takes a lot of time to get used to the changes and it is a hard time as well due to the sudden change in the life style.

    Rakesh,

    Don't all sponsors retain the passport of their employees ? The problem arises when one pays the sponsor for a specific period's visa and works outside. This practice is in-fact not legal but the sponsor as well as the PP holder knowingly get into this situation.

    However, when the PP holder never reports to the sponsor to renew the visa which will again cost money, the sponsor reports him as absconding. Now, tell me how is the government of the PP holder supposed to resolve this mess ? This is exactly what has happened and its unfair to hold Indian authorities responsible for this.

    The target of regularizing (affected-NITAQAT)Indian's residency in fact, a daunting task for expats, employers and Indian mission in KSA.There are 60 thousand Nitaqat affected Indian expats who registered with Indian mission.Govt of India appointed law firms to assist aspiring illegal expats to regularize their status.It is highly impossible for those companies which are coming under yellow and red categories either to release or to employee affected labors!So many delegations came to KSA with regarding 'Nithaqat' issue but some cosmetic changes has been done on Indian mission point of view and three month cut out date is final.Of these registered, how many will leave, how many will regularize their residency and how many face wrath of the law could not be estimated under the given circumstances.There are precisely over fifty cities but Indian mission mainly situated in Reyadh,Jeddah only?GOVT of India doing it's best to repatriate all affected NRIs and those who need assistance will be provided.Pray for them and hope for the best.
