Mangalore: Forced sex case: Police ask court to add rape charges against accused

Mangalore, Jan 5: Following allegations by a few organizations and individuals that police had failed to register rape case against the accused in the infamous Deralakatte incident wherein two students were allegedly kidnapped, forced into having sex, videographed and blackmailed, the Mangalore city police on Sunday January 5 issued a clarification on the case.

The clarification reads as follows:

"There have been statements issued by some people in the media regarding the investigation of Konaje police. In order to place the correct facts before the public this clarification has been issued:

"Konaje police station crime number 192/2013 was registered on December 19, 2013 based on the written complaint by the victim. At the time of receiving the complaint the police officer concerned suspected the involvement of section 376 IPC (pertaining to rape) and questioned the complainant who in turn denied the same. Further, the complainant did not co-operate with the investigation officer for medical examination and requested the investigation officer not to allow publicity for this case.

"During the investigation, the police had launched massive operation to catch the suspects and were able to apprehend all the accused within 48 hours. All the accused are in judicial custody till now. From the date of arrest till now a lot of progress has been achieved in the investigation.

"The statement of the victim was recorded under section 164 Cr PC (code of criminal procedure) before the magistrate and the same was made available to the investigating officer on January 2, 2014 evening. Based on the investigation conducted so far, the investigating officer has filed a memo to the court to add section 376 and 376D IPC to the case on January 3.

"The police assure the general public that a thorough investigation will be carried out and a charge sheet will be submitted to the court well within the time frame stipulated by law against all the accused persons."

    I still wonder why are the faces of these people covered, usually their faces are not covered. For eg check the Manipal rape case accused faces was not covered. If the faces of these guys were shown I am sure more cases would be registered against them, who knows if this is the first crime they did or have done many in the past.

    Eight Persons raped a student in Deralakatte. But police have termed it as small offence of 'eveteasing' (Section 354 IPC)-three years punishment. Well known Advocate P P Hegde has appeared in the Court on behalf of the victim and Jagratha Mahila Vedike Mangalore and filed application to add charge of Gangrape against all 8 accused under Section 376-D IPC - life imprisonment punishment. Hope atleast now police will be compelled to add the correct penal provision and treat it as Gangrape
