We have not alleged sexual molestation: Preity Zinta's lawyer


Mumbai, Jun 16 (NDTV): Actor Preity Zinta has been asked by the Mumbai police to appear in person within a week and share her account of how ex-boyfriend Ness Wadia allegedly molested and abused her.

Ms Zinta, 39, is traveling abroad. Her lawyer, Hitesh Jain, clarified to NDTV today, "We have not mentioned sexual molestation or even the word 'molestation' in the FIR."

On Friday, Ms Zinta filed a police case against Mr Wadia, a 44-year-old businessman, with whom she co-owns the Chandigarh franchise of the Indian Premier League. She alleged that at a match involving their team at Mumbai's Wankhede Stadium on May 30, Mr Wadia "intimidated me by saying he could make me disappear as I was a nobody and only an actress and he's a powerful person...this afore-stated incident in Mumbai in the Wankhede Stadium has left me shattered and fear for my life." 

Mr Wadia has refuted the charges. "I am shocked at the complaint and the allegations made against me are totally false and baseless," he said in a statement released on Saturday.

The charges against Mr Wadia in the police case registered against him include criminal intimidation and assault intended to "outrage a woman's modesty." The police says that by allegedly grabbing Ms Zinta's arm without her consent. Mr Wadia's action amounts to molestation under Section 354 of the Indian Penal Code.

The actress and the businessman dated for five years before ending their relationship. 

The police has recorded the testimony of two alleged witnesses who saw the fight between the high-profile couple.

Sources say investigators will ask the actor to furnish emails exchanged between her and Mr Wadia which allegedly could offer more details on the case.

    Zinnah Vs Zinta !!
    When Jinnah was 45 yrs old he married a 25 year old Parsi girl and then this couple had a girl who was later on married to Parsi Industrialist Wadia. Now this Zinnah's grandson is Unmarried even at the age of 44. Naturally mess up by Ness with Zinta was natural.

    I would appreciate case should be filed against Preethi for misleading the authorities and police. Initially it was so much high lighted as molestation was the prime reason and now it's compromising as molestation was not the case, only ill handling Preethi is the reason... if thorough investigation , preethi and her lawyer may come back saying, he just scolded her in public and hence molestation case was filed. So, I am telling, in turn file a case against Preethi for misleading and wasting the time and effort of law and authorities.

    Ness wadia is not a fool and his lawyers invoked 'false accusation ' clause which can nail preity under criminal conspiracy. Its good that courts waking up for 'mis use ' cases which r gross injustice towards men. Its terrible than 'rape' because 'false case survivor ' goes threw lot of trauma in society and on personal level. The nirbaya fund also be distributed among ' false case survivors . Its nice to hear delhi court concluded that , any man went threw trauma in false cases deserves sympathy and nothing less than ' assault' victim , so deserves rehabilitation fund.

    Some compromise formula might have reached to withdraw false case.
    Govt should note, this is how some sections, (NOT ALL) are exploiting the LAW for their benefit.
    There are exceptions, many a time fairer sex is at receiving end. There should be fair play.
    Accuser's character analysis is very important to determine conviction of accused and to give benefit of doubt.

    It seems to me that she is just misusing and wasting the time of the Indian legal system to settle personal scores and satisfy her EGO.
    I am certain this matter could have been settled across the table as both are adults, educated and accomplished individuals. There was absolutely no need for registering a police case as it seems there was no forced sexual intent/rape involved.
    This talk about fighting for her rights appears to me actually just a fight to satisfy her ego.

    Now Preity Zinta is slowly being isolated from public and Bollywood. However, it looks she is a strong woman to fight for her rights against the powerful and rich great grandson of Mr.Jinnah. She was the only witness who had never gone back from her earlier statements in the notorious Bharat Shah scandal in 2003, when even Shah Ruk Khan and Salman Khan like cowards changed their stand. She was given an award by Maharashtra Govt for her sincerity. My only hope is justice should prevail in this case.
