Mangaluru: Court orders 8 houses to be vacated, occupants urge more time

Mangaluru, Jan 29: Families staying in eight houses on a piece of land at Bhavanti Street were on Thursday January 29 told to vacate their houses as per a court order.

The land in question is located between Ramakanthi and Roopavani theatres, and belongs to Subhash Bhat and his Mumbai-based partners. There are 31 houses on the land, out of which eight have been ordered to vacate. 

It is learnt that the order to vacate had been first passed by the civil court back in 1999. The families then approached the court, and for 15 years the issue remained in court.

On Wednesday January 28, the court passed orders for eight houses to be vacated, and accordingly, court officials as well as land owners arrived at the spot on January 29 and asked the families to move out. It is learnt that the Mumbai-based partners too had come.

The families however refused to budge and begged to be given more time. They said that they were not informed about the court order, and there was no information given in writing. "A court official came on Wednesday night and told us to vacate, but did not give the order in writing," a resident said.

The affected residents also alleged that land owner Subhash Bhat had cheated them with false promises of transferring the land in their name. "Three years ago Subhash Bhat told us that the land would be given to us if we pay him money. So families in 13 houses paid him Rs 8 lacs, but he did not transfer the land," they said, adding that have no evidence to prove their claim.

However, Subhash Bhat denied the allegations and said that he had not made any such promise nor taken any money from the occupants. He also said that he had given a time of one-and-a-half years to the families to vacate the houses, but they did not move out.

Human rights officials who arrived at the spot said that though court order cannot be questioned, the families should have been given intimation to vacate the land in advance. "The land owners are curbing the rights of the people," said human rights activist Balakrishna Rai.

The families urged the land owner to give them more time, as they do not have anywhere to go. "We have no money to build a house or pay rents. We have sons and daughters who are studying and who have exams now. We have no place to go," they said.

"The land owner has no sympathy for poor people," alleged Revathi, a resident of the area.

The court officials told the residents to respect the court order and vacate the area.

Kumar Malemar of Sri Rama Sene arrived at the spot and urged the land owner to give the families time till April. "Children have exams now, but after April they will vacate. They need just three more months.

"They will give a written agreement in front of the media that they will vacate the land by April end," he assured.

However, Subhash Bhat refused and said that the houses will be vacated on Thursday itself as per the court order and the houses will be locked. "Household items and other personal belongings which they cannot take away now will remain in the houses. They can come back later to collect them," he said.

    The residents are begging for time to move out because they have no money to buy or rent a new place. Besides they have children who are studying and other expenses.
    The question is:
    As long as the sun shines make merry and enjoy. I guess they were living free of cost all this while and now cry for compensation and sympathy. Our system is totally flawed.

    I am sure the new owners will be selling this prime property to some builder to make a high rise towers. The owner has to strike a deal with the builder to accommodate these 8 residents on the lower floors of the new tower. This happens in Mumbai ...

    Sympathy from the land owners was okay before the litigation started. Now however, it is appropriate the court order is implemented. Moreover the residents were aware that their residence is under litigation for so long as 15 years.

    The tenants have pleaded that they be given just three months time to vacate the houses. This seems reasonable considering the fact the children of tenants have exams and it would unfair to throw them out at this juncture. Hope social workers intervene and some amicable solution is arrived at.

    Even tenents didnt bother in 15years about decision of court to ask or get in written.Today only written orders are acceptable.Their payment of 8lacs without any document or reciept cant be considered.Anyway their Situation is very serious and pitiable.when landlords want that they vacate within a weekor short period,then they should give them a shelter .Thats usually most acceptable solution at Moment.when they waited for 15years,can also wait for w months till exams are over.They are poor People.No one give them shelter on the spot.Their 8lacs should be given back without compromises.They must be knowing who recieved.when today big building,flats are coming up.,poor People have to make place.Money is ruling.These Familys have not thought that time of moving,or settling in peace,now time has come to face the reality.sad.

    The value of the land is 30 cores. But the tenants are living in this place for around 150 years. All are very poor people who struggle for food here.and also this land is d as slum area by the government

    15 years is quite a long period wherein the tenants could have made alternative arrangements and vacated the houses. May be they were under the impression or living in illusive thought that court will decide in their favour. Still the owner can extend the grace period on humanitarian grounds.

    hopeless system in India. You show sympathy to someone and they grab the opportunity. Just follow the court order, the grace period is over and you lived in heart of the city several years. I have sympathy on poor as I myself is not rich. Having said that we all need to work hard but never occupy someone's property. Human Rights Officials, you do not have to do anything here other than ensuring the land owners get their land after so many years.

    If these houses belong to Mr. Bhat then the tenants must vacate the same immediately and respect the court orders.

    Our society is not a banana republic and court orders MUST BE RESPECTED.

    15 Years is a very long time and they should vacate the house.

    Only left is 'lender of last resort',the Supreme Court but again outcome may be same.Alternatively,District admin can rehabilitate these families by giving 3 cent site around Managlore or else where near Kudla.The report is not clear how long these tenants were lived as tenant and duration is more than 15 so years land owner can't evict tenants so easily with out proper rehabilitation plan.On the other hand tenants might hired weak VAKIL.Human Rights agency,District Admin(DC mus),Local MLA,in charge Minister and NGOs help this very sensitive case could settled amicably.

    I think people in here dint do proper arrangements since 1999. They knew case was is in high court so they should have done something for their safety.Iam not blaming them because now they dont have no other place to move.I think land owner should give them little time.

    Good story for Cinema.Court Order must be followed in the same vain 90 days grace period for house occupants with registered promissory note.Here Land owner might scared that if time is given again there could be problem..But that should be solved with affidavit.Interestingly,how eight lakhs rupees given to land owner with out agreement?Now this land may fetch 8 crore!

    Poor people where they will go. It would be grateful if Land owners show some sympathy on these people & can offer them free land outskirt Mangalore as the current value of the land must be more than 10Cr and No one will take land or money when they die.
