Govt cannot force St John's to part with seats: High Court


Bengaluru,Feb 12 (DHNS): The High Court said on Wednesday that the state government cannot force City-based St John's Medical College, an unaided religious minority institution, to surrender 25 per cent of its medical seats to the government in lieu of granting approval to the college to increase seat intake.


The High Court said on Wednesday that the state government “cannot force” City-based St John’s Medical College, an unaided religious minority institution, to surrender 25 per cent of its medical seats to the government in lieu of granting approval to the college to increase seat intake.

Justice B V Nagarathna directed the state government to consider its application for essentiality and feasibility certificate within two weeks.

The court disposed of a petition filed by Catholic Bishops' Conference of India Society for Medical Education and St John’s Medical College.

The petitioners approached the Rajiv Gandhi University of Health Sciences (RGUHS) in March 2014 to increase their medical seats from the existing 60 to 150 for the 2015-2016 academic year .

The RGUHS had inspected the medical college and hospital and recommended increasing the seat intake. The state government, which had to provide approval to the college with essentiality and feasibility certificate, however laid down a condition that the institution should surrender 25 per cent of its seats.

    Christian institutions:be it educational, health, charitable and host of others are known for their efficiency and good administration.I wonder why RSS and their affiliates start doing something good for the public instead of all kind of nonsense

    What's new?? The government is too used to taking what is not theirs, whether it is hard earned money by way of never ending Taxes or seats in this case which are not theirs to take.
    Pure and simple criminal extortion on the part of the government.

    This is indeed a a wonderful judgement on the part of The High Court Judge. Government cannot simply enforce any laws at the discretion of the ministry.

    I join several others in complimenting the High Court Jude on the decision that has been taken.

    Shame on Govt. This is nothing but equality in asking for the bribe. If the govt is not aiding the institution then in what manner it can claim for the 25% seats. Funny part of it, govt will utilize those seats to appeasing politics , buy giving away to backward class or minorities, at the cost of minority institutions.

    BIG NIL, FOR MINORITY LIKE MUSLIM AND CHRISTIAN, THEY ADDED IN THE THE BACK WARD CLASS CATEGORY AND MINORITIES HAS TO SHARE THIS 5% OF THE RESERVATION WITH OTHER HINDU BACK WARD CLASS PEOPLE, IT YOU TAKE INTO INDIVIDUAL CONSIDERATION THEN MINORITY MANY GET LESS THAN 0-1%, BUT THEY REQUIRED 25% SEAT FROM MINORITY INSTITUTION, THIS IS WHAT APPEASING THE MINORITY IN REALITY AND WHAT BJP MAIN PROPAGANDA TOOL TO WOO MAJORITY AND CONGRESS STRATEGY IN REAL TERMS GIVE TO MINORITIES NOTHING JUST FOOL THEM FROM LAST 68 YEARS.

    Reservation in higher education should be purely based on economic/income criteria. It is even better if admissions are purely on merit.Candidates from poor economic background can then be financed by the govt.irrespective of caste/religion. Where govt needs to focus is to create a primary/secondary education of equal standards for everybody thus creating a level playing field.

    Its a right verdict. My msg to the Govt. is set up new college, spend money and help the children with admission. Be a service to the people first. Do not demand from St. John's administration. They are a long pending list.

    Every year government is setting new medical colleges nursing colleges during the budget but nobody knows where are they set up and hardly in any one finds them too then in a span of another 2 years they will just disappear out.
