Child labour law: Below 14-year-old children may work in family biz


New Delhi, May 14 (PTI) In major changes to the child labour law, the Cabinet on Wednesday approved allowing employment of children below 14 years in 'non-hazardous' family enterprises, entertainment industry and sporting events after school hours, while relaxing the penal action against the parents.

While child rights activists have been demanding a complete prohibition of child labour, the government said "it would be prudent to also keep in mind the country's social fabric and socio-economic conditions" before taking any such decision".

However, the new amendments propose to make child labour a cognizable offence, while punishment has been increased for those employing children below the age of 14 years in violation of the law. They would face imprisonment of up to three years and a fine of up to Rs 50,000 for each offence under the new law, after it gets passed in Parliament.

However, the parents or guardians would not face any punishment for the first offence, while the penalty would be a maximum of Rs 10,000 for the second and subsequent offence.

These provisions are part of the 'the official amendments to the Child Labour (Prohibition & Regulation) Amendment Bill', which would make changes to the nearly 30-year-old law and was on Wednesday approved at a Union Cabinet meeting chaired by Prime Minister Narendra Modi this morning.

The amendments were, however, criticised by activists and opposition. Congress leader Ahmed Patel tweeted: "Government's move to partially legitimize child labour is a retrograde step. It violates right to eduction and defeats our aspirations to be a just society."

Under the existing Act, the punishment provisions are the same for employers and parents, which include jail of up to two years and a maximum monetary penalty of Rs 20,000.

Also, the prohibition has been extended to all kinds of employment, with the exception of non-hazardous family enterprises, entertainment industry (including films, ads and TV serials) and sporting events (except circus), from the 18 occupations and 65 processes specified under the current law.

Justifying the exceptions to the complete ban on child labour, the government said, "In a large number of families, children help their parents in their occupations like agriculture, artisanship etc and while helping the parents, children also learn the basics of occupations."

"Therefore, striking a balance between the need for education for a child and the reality of the socio-economic condition and social fabric in the country, the Cabinet has approved that a child can help his family or family enterprise, which is other than any hazardous occupation or process, after his school hours or during vacation," a post-Cabinet official release said. .

    Children below the age of 14 years should be sitting in classrooms at school.

    Employment of such children is exploitation or slavery at it best and there is no such thing as 'non-hazardous' family enterprise.

    By legitimizing child labor the government is cleverly hiding its inability to set out a minimum wage which in turn will offend the industrialist who prefer that India remains a third world country with lot of cheap labor or slaves available around.

    If like all the developed countries India had imposed a minimum wage then parents would be financially sound and able to send their child to school instead of sending them to work.

    I had the privilege of witnessing first hand one beautiful sunny morning the difference of children as young as 5 years in muddy clothes laboring at a road site while other children their age in bright school uniform passed that way en-route to school.

    Law is not clear and leading to miss use.and upper class can take advantage by hiring poor children by giving more assurance and future. For my opinion there is no law required if any child helping his parents in their business or occupation in school of time. Let politicians send their children for glass washing in the hotel and show example instead of passing such law.

    There is no shame in working hard and achieving our life goal but stealing and cheating is will not take us to a better life.
    “Dignity of Labour indicates that all types of jobs are respected equally, and no occupation is considered superior. Though, one's occupation for his or her livelihood involves physical work or menial labor, it is held that the job carries dignity”
    There may be some amongst us who have risen from poverty and are enjoying the blessing of the hard work and I am (Flavian) is one of them. I was not born in golden plate I too had a share of tough childhood days but there were true morals and guidance from my late mother. Let us stop scooping so low about persons past profession throughout. Especially, about our PM.

    Should feel happy our Prime Minister Shri Narendrabhai Modiji working in childhood along with his father and rose to such heights.

    After helping his father he run to school for not giving chance to miss any subjects. Modiji even working as a 'Tea-Boy' in railway station running between platforms.

    What a great achievement.
    Modiji's name become household as like Mahatma Gandhi worldwide.

    At least try to give respect to our leaders which especially pour from outside people.

    Manik ji - The Tea Seller Association in Gujarat revealed that "Humble & Poor"Narendra Modi never sold tea on any railway platform or in any station instead his family members were wealthy contractors for tea in the railways.

    This was a blatant lie and a PR gimmick.

    Labour is also an education.

    Many people from DK, who worked in Hotels in Mumbai, Pune or Bengaluru are rich people now.

    I have seen many people who worked are now engineers and doctors and have come up in life, more than those who simply studied, during their childhood
