Bengaluru: State govt to fix treatment rates in private hospitals


Bengaluru, Jun 14 (DHNS): The Karnataka government is all set to fix rates for different types of treatments and bed charges in private hospitals and nursing homes. If rules are violated, it would attract imprisonment or penalty.

A bill which empowers the state government to fix rates was tabled in the Legislative Assembly on Tuesday. The Karnataka Private Medical Establishments (Amendment) Bill, 2017, piloted by Health and Family Welfare Minister K R Ramesh Kumar, may come up for discussion on Wednesday.

The bill provides for imposing a penalty of up to Rs 5 lakh and imprisonment up to three years if hospitals/nursing homes collect charges higher than that fixed by the state government.

The person who runs the hospital will be held responsible for violations and minimum penalty has been fixed at Rs 25,000 and imprisonment of not less than three months.

The government will fix rates or charges for medical investigation, bed charges, operation theatre procedure, intensive care, ventilation and consultation.

The state government will fix the rates based on the recommendations of expert committees. These committees will classify hospitals taking into account the infrastructure in the private medical establishments.


No advance payment

The bill restricts hospitals from demanding advance payment from patients in case of emergency treatment. In case of death of a patient, hospitals will have to hand over the body of the deceased immediately without insisting on payment of dues. The dues can be recovered from representatives of the deceased at a later date.

The bill also provides for constitution of District or Metropolitan Grievance Redressal Committee for redressal of grievances of patients. The panel will be headed by the chief executive officer of the zillapanchayat of the district and include the superintendent of police, one representative of private hospital, district surgeon, public prosecutor and woman representative nominated by the government as its members.

On receiving a complaint, the panel will have the powers to inspect the hospital, hold an enquiry and issue orders which will have to be followed within a specified time.


Charter

The bill has a schedule entitled “Patient’s charter and Establishment charter” which lists out the responsibilities of patients and hospitals.

According to the charter, every patient has a right to receive treatment, be heard by the doctor, get a prescription with an explanation on details of dosage, dos and don’ts, privacy during examination and confidentiality about the medical condition. Patients have the right to request access and receive a copy of their clinical records, expected cost of treatment, seek second opinion on medical condition, among others.

Patients’ responsibilities include being honest with the doctor, be punctual with appointments, do best to comply with doctor’s treatment plan, respect the doctors and medical staff. Hospital charter includes providing a printed schedule of fee for office visits, procedures, testing, surgery and provide itemised bills.

    Although on the face of it the Karnataka Government's move fix treatment rates in Private Hospitals looks good but surely it will not benefit the patient. This will only make the hospital managements to circumvent and put their charges in other forms which cannot be challenged at all. So ultimately bringing such law will give the ruling party political mileage without actually benefiting the patient. I recently came across that a famous Charitable Hospital at Kankanady is selling medicines at its pharmacy at rates more than other hospitals. Cancer medicine which is available at other hospital at Rs.75,000/ is sold at the Pharmacy at Rs.90,000/- Earlier patients could not procure their medicines from the outside stores. If the patient is partially under insurance they have no other go but to allow themselves to be administered medicines procured from their pharmacy. When a cancer patient has to undergo 6 to 8 Chemo therapies you can imagine how much money they have to pay extra. Why such hospitals are allowed to have the term Charitable in their boards. Perhaps to get some more benefits from the Government. I pray that the Government should come with a policy to regulate the prices of Cancer medicines and stop the blatant overcharging by the hospitals and the Pharma companies. I don't understand why a doctor should charge Rs.1000/ each day he visits and says Hello , How are you? while he is on his rounds. This too need to be regulated.!

    Dear friend ..... Kankanady is a charitable hospital ..... And rate,s are very very less than all the hospitals in mangalore ... less than 1/4 th of the other hospitals... And regarding medicine... It is also very very less then all other hospitals .. .. I know this hospital from more than fifty years....

    Idea is good ,but before that try to practice it self in govt.hospitals where poor ones suffer.Rich ones can afford with money.what happened in the last months of refusing ambulances,to carry the bodys of their closeones?Had to drag the husband to xray?Look first in your own hospitals ,and practice itthere.Of course some private clinics are only care after recieving money even in emergency.That should be prevented.many suffer to pay horrible amount of money to be paid in private hospitals.They think private is besser treatment and rush there.Suppose Govt hospitals provide good treatment ,of course people do go to there.So now we are waiting of govts,so called improvements.

    Many pvt. hospitals in Manipal, Udupi etc. charge 3 times for medicines, simply if patients desire to avail special rooms.

    This is day light robbery, and to be stopped right away!!

    I hope this bill is implemented at the earliest. This would prevent assault on doctors. If the patients or their relatives have any doubt about the treatment plan or outcome, they should approach the District or Metropolitan Grievance Redressal Committee. This should also include referring from one hospital to another to make money. The consultant should have some idea if the case can be treated at their hospital/clinic or not and if not referred directly instead of doing it twice.

    Medicine is simply money making business! After the recent exposure on heavy overcharging on stents by middlemen n hospitals, recently there was a news report in Mumbai that hospitals r charging 18500₹ for a cataract lens whose actual landed cost is 2800₹, which is really shocking n shows how corporate hospitals squeeze money from innocent patients!
    I would like to cite one of my close relative recently had in a reputed hospital in Mangluru! He was having certain chronic complaints of dizziness n edema in the legs for which he was taken to a quite famous physician who diagnosed that there was some problem with his heart n asked us to admit him in the hospital where he also has a consulting room. We refused n asked him for a referral to another bigger hospital with advanced facilities, which he agreed, n we cleared his bills then n there! The patient was admitted to the other hospital for observation n was found to have a problem with low heart beats n everything else clear, was suggested a pacer! Though the duty of the outside physician was over, he still made it a point, on his own, to visit the hospital twice a day for 7 days though his visits were totally unwarranted; n in the final bill, his charges were 500*14=7000₹ (what shall we call this??)! Over n above that, he asked us to again come to him after 7 days, again unwarranted!! This same physician sees patients in an OPD like set up where at a time he examines 3-4 patients simultaneously in one room n charges a whooping 500₹ per patient!! I was stunned at the way he was checking patients n pushing in crisp 500₹ notes inside his pockets!!
    Again back to the hospital, besides charging 50,000₹ by main cardio, another 7000₹ for his assistant, again they put an extra charge of 25000 under the head "Cross consultation fees" when they themselves established that all other system of his was OK except the heart pacing!! In s way I felt pity on these people who r no better than extortionists!!

    Good move if the bill is passed and issued notification to the private hospitals at the earliest then ,hats off to the govt of Karnataka. its been hard to go tho the doctor even for a minor disease they send for scanning , x ray , and so many kind of blood tests, which is a costly affair for a common people.

    instead of this measure the government must first ensure improving facilities of goverment hospitals and providing easy health insurance schemes to citizens. that will solve a lot of healthcare issues of the common public who will no longer need to depend on private hospitals.

    consultation fees and procedure/hospital bills should not be curbed as doctors too have to make a decent living after slogging for so many years and hospitals must be able to manage their day to day running costs to provide quality service. after all patients have a choice to choose their doctor/hospital based on their budget . nobody minds if a doctor or hospital charges well for services rendered provided it is done ethically and in the best interest of patients.

    instead of this it is far more important to develop a mechanism to reduce the need for unnecessary investigations, blood tests, surgeries and to control the cost of medical education which has badly damaged the reputation of the medical system.

    when hotel charge 4000 for 4 people dinner no complaints, for fish curry they charge 150 no compalints. biriyani they charge 250- no complaints - chicken they sell for 225 no complaints 2, when petrol they charge 71,50 no complaints, only dr charging this fees is every thing discussed. the medical students pay 20 lacks no one bothered- an admission medical college charge lacks of fees no one bothers. one student pass out medical education costs him 50 to 100 lack and 150 lack. where or when that 150 lack will return him. what is the ethics he/she keep when paying and get trouble for eudccation for 10 years with entrancence and other examination no one bothers. u give them free education and tell doctors to be reasonable. other students go of IAS, IIT or IPS and then come out with flying colours and hefty payments no complain. polotician get easy money for you coughing or your services no complains - these all genuine - only doctors want to be tied up they work other for free. so simple - fist you change the system and then try to control everything

    Indeed very good move. All hospitals, schools , education fees to be decided by government and ensure that win- win situation for both patients, doctors , Hospital owners etc etc.

    Government should ensure that insurance for all people. Every consultant charges of doctors also to be fixed...

    Because different doctors charges different prices for same purpose. For example, physican charge fixed to Rs.150 or so . likewise other doctors as well.

    Also, there should different Tiers of Hospitals..

    By the way when this will be implemented ? Only announcement ?

    Same thing to happen for education as well. Everyone starts education institution for business purpose...

    Medicine has now become a business. Some Doctors cant think of anything other than money. Their only aim in life is to make money and they have no regards for human life or suffering. Hospitals these days have least regard for patient and they only want to make money. When I roam in Mangalore I found some Doctors driving expensive cars like Benz This is all looted money from the patients. Hospitals in Kundpaura Mangaluru Udupi are all nothing but money making enterprises. Its well known now that DOctors take commision now for everything . They do unwanted invetsigations,They admit patients whether indicated or not. Surgeries are done with out adequate reasons. I feel we must stand up against this system of private care in India. They do all kinds of unethical work for money In my opinion the best way to handle this problem is to nationalise the whole health care in India. Let the tax payers moeny be used for the benefit of the people. Charges for doctors must be controlled and a good step by the Goverment of Karntaka to regulate this. There must be transaprency in charges of Doctors and everything must be ethical and clean. There are many medical colleges in our district They must be made to treat at leat 40 percent of cases absolutely free so that it will benefit the poor people of this area. I also but condemn the attack on doctors. Doctors must never be attacked. MEdical profession is the most noble profession and we must respect that very much. Unless strict action taken on DOctors who charge as they like medical profession will not imporve. A good move and step by the goverment and I appreciate this very much. Human live is precious and health is a basic human right. I am sure the goverment will succeed in this venture. May god bless the Sidhu goverment whos is making this bold decision. very nice step thats all that I can say and I am sure this will prevent all greedy doctors from making money at the expenses of poor people .     this is really good move from state government . few months back I have suffered a lot . My father had a hip replacement surgery doctor told it will cost 2 lakhs but final bill came to around 3.5 lakh . and surgery was also not successful , and when we told we are not capable of paying so much he told us to shift to other hospital and my fathers situation was very bad as operated area was infected , v paid all money and immediately shifted to other hospital again bear same amount . now a days for doctors its just a business no value for life . government should bring this regulation as soon as possible .

    It is a good move but why they took so long to implement this rule strictly while all these years patients suffered in the hands of doctors and hospital authorities. All these charges should be displayed clearly on the reception front wall with a complaint number. Even private clinic as well as dental should display consulting charges in the clinics. I have experienced personally when doctor charged me Rs 450/ for just mild cough while others he charged only Rs 300/. We all think doctors profession is noble and respected when some doctors try to exploit poor patients.

    A very good move by the state government. Medicine these days has become a business and doctors charge like anything. The price of treatment room is to be fixed. No doctor should charge more than what is actually ethical. Corporate hospital charge like anything and loot patients. It's a well known fact that there are some greedy doctors. They have least concerned for human suffering and the only aim is to make money. This tendency has to be stopped. Many private hospitals in Kundapur Mangalore and Udupi charging patients like anything. Doctors these days have no concern for human suffering. It looks like they are more interested in buying big houses and making their status better than treating patients. I strongly condemn all attack on doctors. However there are some greedy doctors who has least regard for patient suffering. It's high time that charges in the hospital has to be fixed. Charges for treatment should be just. I know doctor should charge extra money then that is needed. Do I do not generalize it's a fact that doctors these days take comission and order unnecessary investigations. There is lot of corruption that is going in hospital area practice and it's high time we become strong and stop this operation of patients by doctors. I am very happy that such a law is coming into practice. May God bless the Karnataka Government who is taking such a bold step.

    FAQs:-
    Who will recover from the representatives of the deceased at a later date??
    Should hospital / Nursing home start a recovery team ?
    Would the recovery team get the money or Kharcha paani?
    Would recovery team return safely?
    Should they be accompanied by the police?
    Would hospital authority have to file a case and fight in the court?
    Case to be filed on deceased ? or representatives of deceased?
    How many years the case will drag on? Tareekh pe Tareekh
    Would representatives of patient accompany him/her to hospital / nursing home fearing the consequences?
    Would government reimburse the same if hospital authorities fail to recover the dues. After how long?

    Medicine and education are the noblest of profesion where money should not be the criteria.But nowadays they have become money minting.God should save common man from this greedy fellas.In each hospital there should be rate fixation with a notice board clearly mentioning the service provided and the rates charged.
