Hyderabad: Justice Santosh Hegde favours legalizing prostitution, betting and gambling

Hyderabad, Jul 7: Retired Karnataka Lokayukta and former Supreme Court judge, Justice N Santosh Hegde, expressed his support to legalizing prostitution. He also said that he concurs with the recommendation of the Central Law Commission to give legal sanction to betting in sports and gambling.

Speaking to a news agency here on Friday July 6, Justice Hegde said that law cannot, on its own, root out some kinds of wrong things. "If someone feels that this can be done, he or she must be living in imaginary world. Even when liquor was banned in the past, illegal production and sale of liquor continued to happen. The government did not achieve anything other than suffering loss by way of tax. Betting in sports too cannot be stopped by passing law. If it is legalized, most of the irregularities happening in the name of betting and gambling can be regulated," he asserted.

On the issue of legalizing prostitution, Justice Hegde emphatically said that there is a need to legalize this activity, duly noting that in spite of ban, prostitution has been proliferating everywhere. "It has become an industry in itself and there cannot be any town where prostitution is absent. Therefore, it should be regulated by issuing licences and legalizing the activity," he added.

At the same time, he expressed the belief that morality cannot be enforced by law and this can be done only by religion and religious leaders.

The Law Commission has said that the law banning betting and gambling has not been able to stop these activities, as this activity is going on behind the scenes, and creating black money in the bargain. It has recommended to permit betting and gambling in a controlled manner and that linking of Aadhar and PAN should be made mandatory for the same. It also has recommended levying tax on the income arising out of these activities as this will result in increased income to the government and regulating of these activities.

    Why not recognise brothel keeping, running gambling dens, running betting syndicates as legal occupations? If legalised, these industries/occupations will give lot of opportunities to people to make money without toiling hard. Now we have liquor barons...in future we will have prostitution barons, gambling barons etc.

    Justice Hegde is thinking out of the box. There are many benefits for the society as a whole if the prostitution is legalized. Some people are born with high libido and some as impotent. When people cannot control their sexual urge, they tend to commit conjugal fraud and suffer for rest of their lives with guilt and social stigma. To understand this concept, one need to have a higher level of thinking like Justice Hegde.

    Now a days decent young men are afraid of courtship with women because of the laws related to sex are ambiguous and left for one's (police) discretion. For example: Rape is not defined clearly.

    Legalization of prostitution can avoid gruesome gang rapes on decent women. Prostitution is a victim less crime and we shouldn't be moral police for others.

    Good opinion by justice Hegde, it will reduce the crime rate in India related to rape and gambling. It will help to balance the society, between wealthy and poor people. Indian politicians should stop talking about religion & cast, instead focus more on people's wellbeing and living standards.

    Agree with Justice Hegde legalising prostitution. Most of the developed western countries prostitution is legal. Many of our girls can be saved from the forced sex trade and clutches of pimps. We need progressive thinking.

    We in India suffer without acknowledging our suffering because of our traditions, culture, family, cast etc,.

    Most of the young men & women are starving for sex due to our custom like high dowry, no marriage with other cast & religion, Killing girl child in the womb, Late marriage, Lot of men & women are involved with illegal sex, Prostitution, Sex with in the family members, master bating, toy sex etc,.

    We cover up our deeds and act like Saints in the society. We are man dominated society so do not talk, bring up male prostitution and only talk about female prostitution. For majority healthy people Sex is biological need, Many women are asexual, Many men have erection problem and unable to satisfy the women. Almost everyone has a skeleton in the private closet.

    Legalizing prostitution/sex will give the people what they want, women will have full control on her body and her earning, end police, moral police corruption and bribes. Things have gotten better in Nevada, New Zealand, Denmark, Europe and other developed world and we are far behind in race. Our religion & Leaders keep us Horney blind.

    Morality cannot be enforced by State and its Law Enforcement agencies / primarily Police ,agreed...that's why we have 'Marl Police' sorry 'Moral Police' to enforce morality on people...

    Prostitution can be legalized and taxed big time like Cigarettes and Liquor...and revenue it generate could be given to Kumaraswamy...so he Could make Hassan/Mandya/Tumkur/Kolar like Paris....

    Am confident Justice Hegde has done enough research, and who is also capable to doing such study, before voicing his support.

    Legalizing any activity strictly means, conducting the same having strict rules and regulations, monitoring process, that safeguards all the parties involved in a particular activity, such as sand mining, selling alcohol etc., which should give no chance to make illegal money primarily to the Police force, corrupt politicians, Mafia which is currently benefiting in India, at the expense of innocent people.

    Unfortunately,
    Prostitution is only benefiting the above mentioned categories, and not the the prostitutes, nor those who pay prostitutes for their services.

    Once it is leagalised Lodge owners need not fear about sudden raids by Police and Corporation officers ( like Kavita sanil did ).... Every one is happy including Customers of such business.... Police only has to watch and see that there is no fighting and gang wars in these lodges.... Corp. officers should concentrate on Fees collection only..... Many people might get a job to do instead of doing it at back doors with fear...

    Prostitution is age old profession. It can not be stopped in police states of Middle East also.

    I think women should have the right to decide and it is for them to chose whether to involve in this or not. As long as as it is voluntary, it should be legal.

    On the other hand most men are hypocrites. They will be more than happy to go to a prostitute but they do not want it to be legal. It is in the interest of women to make it legal.

    At least there will not be human trafiking and also this will reduce crime against women. Indians are generally sex starved and end up committing crimes when they are desparate.

    Lets say, prostitution is a legal trade, like somebody is a sales-girl, nurse, teacher. Now, how many of those who worked hard to get it legalized, wish a girl who worked as a prostitute as a Daughter-in-Law ? How many of you will allow a female member of your family to be employed in a brothel ?

    I don't think even one. So, forget whether its legal or illegal, stop young men getting entertained in red light area. Teach them humanity and respect. Make sure that they get education and a job of their eligibility. When they are of age, help them get married by not demanding dowry.

    Prostitution is a social evil, it will never end whether its legal, or otherwise.

    Agreed.

    1. It is very difficult to think that state accords legal sanction for a concept where "women are meant for men's satisfaction". He can pay and get these services. It is more or less like their body is offered as service.
    2. We need to bring in other social measures so that the "crave for sex" is handled alternatively.
    3. We all know that sex is one reason for the crime related to rape etc. but we need to handle them with awareness and not by offering "women body for price".
    4. No woman wants to offer her body for price unless compelled for financial reasons.
    5. Society should not put woman to this kind of situation.
    6. Legalization of prostitution it nothing but honoring the urge of a man but turning a blind eye towards woman's situation.

    Your comment is good. But you cannot compare like that to some other concepts. We cannot legalise everything whatever we cannot stop. Here(Prostitution, gambling) the people earn themselves and their own will make the parties to get in to the business & none can bring them frocibly and forcibly making them to get in to the same should be legally punished. In the case of corruption you will eat poor people money and the poor will be sufferers from the hands of capitalists. Hope the concept is clear because Santhosh Hegde and several speakers, look at the pros and cons before they utter something in public.

    Kumar is mixing apples and oranges. Prostitution, gambling, betting, dancing bars, drinking etc. is one's choice that will give them a pursuit of happiness. People also have a choice to become Monk, Priest, Nun or Sadhvi which also give them a pursuit of happiness.

    Whereas, the corruption is a sort of extortion and unlike prostitution it has a victim. Legalizing certain activities will certainly bring down the corruption.

    Santosh Hegde is right, this should be the way ahead. Prostitution & Gambling has been there from ages even in BC. Till now no one could stop it no matter whatever strict laws they brought. It continues to run abated. Everything runs in black with loss of revenue for the state and supporting black economy which inturn funds terror and other anti national activities.

    Legalizing prostitution can end up more human trafficking without any fear. Many studies have proved it does not bring down the rapes. If this is done there will be no more humanity left.
