Bantwal, Aug 28: The Consumers Court at Mangaluru has ordered payment of compensation amounting to Rs 18.12 lac in a case of the death of a pregnant women and her unborn child, holding medical negligence responsible for this happening. The court said that the death of the mother-child duo had occurred on account of the negligence of the doctors and the hospital.

Chanchalakshi, wife of Naveen Kumar, resident of government employees’ colony on bypass road at B C Road, as per the advice of an obstetrician from B C Road, had got herself admitted into a private hospital at B C Road on February 6, 2014 for her second delivery. Reportedly, the doctor whom she was consulting did not come to the hospital on time. In the evening, an injection was administered to Chanchalakshi, after which her condition deteriorated.

Dr Bharati Shetty and Dr Shashikala, who arrived at the hospital thereafter, checked Chanchalakshi's health and advised the family to shift her to a hospital at Mangaluru. Chanchalakshi was sent to Mangaluru in an ambulance but as soon as the ambulance reached the hospital, Chanchalakshi and her nine-month old foetus died.

A case had been registered in Bantwal town police station in this connection. As per the instructions of the then health minister, U T Khader, a high level inquiry had been held.

In the meantime, husband of the deceased lady, Naveen, and son, Aditya, had filed suit in Dakshina Kannada District Consumer Grievances Redressal Forum (Consumers Court) against the hospital and the doctors. The court which conducted hearing has ordered payment of Rs 18.12 lac to the family of the deceased including interest and other expenses.

Advocate from Mangaluru, Udayananda A, had presented the case on behalf of Naveen Kumar.

    If someone had killed her by drunken driving or if she had fallen into a ditch on roadside or if she was killed by communal goondas she could have got nothing. Thank God she was "killed " by a doctor who's intention was to save her!!!

    Very sad.I sometimes dont understand in India (karnataka)there are some private hospitals small kliniks do take pregnent women for delivery which dont have any facilities if any emergencys happen.They the n relatives to take patients to a different hospitals that too so far in mangalore.by then one shouldnt have any hopes of a safe delivery or problems are attended.we hear many of them die .Thatswhy my advice to pregnent women,please dont get admitted in such clinics.Even though they are so called private clinics.I dont understand what private is here.many times we see even doctors are not there suppose a woman is in delivery room.Good that court has given a good verdict.still life is gone.I doubt still if they really get it that money.RIP.

    Although no money can compensate the loss of life of a loved one , the verdict given by this court is commendable , also revoke the lisence of these doctors .

    This is a dist court verdict. It may be appealed in state consumer court and if needed in national consumer court.
    . The licence is never revoked unless it is some extreme case of negligence

    There are not much fake doctors in India now, especially in Karnataka.
    But the 'just pass' dumb PUC students get in to medical colleges on capitation seats and come out as dumb doctors.
