Bangalore: HC Quashes Proceedings against Poojary and Rathod

Bangalore, Jul 7: The high court on Monday quashed proceedings initiated by a city magistrate court against former KPCC president B Janardhan Poojary and secretary B Prakash Rathod.

Allowing two separate criminal petitions filed by them, Justice V G Sabhahit said counterfeiting charges as claimed by complainant Ashwathanarayana, city BJP unit president, can't be sustained. This is because the `alleged' Rs 5 notes were not circulated but given as receipts to party workers in lieu of membership fees paid.

The VIII Additional Chief Metropolitan Magistrate court had taken cognizance of the complaint and issued summons to both to appear before it.

Ashwathanarayana had claimed that the two KPCC office-bearers issued coupons that resembled Rs 5 notes.

Sportsman's plea

The high court has issued notices to the higher education department, Karnataka Examination Authority and department of youth services and sports on a petition filed by an 18-year-old ball-badminton player.

Petitioner R K Adarsha challenged the denial of a medical seat under sport's quota.

Adarsha, who has represented the state in sub-junior national ball-badminton championship in 2006, had won a bronze medal.

He said he belongs to Nayaka (ST) community. "Despite scoring the highest CET rank (10,048), authorities have allotted the seat to a candidate with 10827 rank under the sport's quota," he claimed.

"The authorities said there's a dispute between two factions of the ball-badminton association," he alleged.

Status quo ordered

The high court has ordered status quo relating to 2.33 acres near Kengeri, which KIADB has sought for acquisition by June 2 this year. This was for the final notification of the peripheral road of BMIC project.

Petitioner Parthasarathy, who owns the land, said authorities have included his land in the notification by shifting the boundaries. "They ignored the earlier report of the special land acquisition officer," the petitioner claimed.
