Kundapur: Failure to pay Compensation: Court orders Attachment of Insurance Co Property

Kundapur, Jul 10: The local civil court (senior division) and Motor Accident Claims Tribunal have issued orders, attaching the movable properties of the Kundapur branch of New India Assurance Company, for its failure to pay compensation to an accident victim, as per an earlier order.

H N Abubakker, a resident of Santosh Nagar in Hemmady near here, had died in a vehicle accident in the year 2003. The civil court (senior division) here and the Motor Accident Claims Tribunal had ordered the local branch of New India Assurance Company to pay a sum of Rs 25,900 as compensation along with interest at 6% per annum to the claimant.

The claimant had recently filed an execution petition against the insurance company, on its failure to pay the amount as ordered. The court, which considered the petition, passed an order to attach the movable property of the defendant company to realize the said amount.
