Udupi: Failure to Demolish Temple - HC Angry Over Official Inaction

Udupi, Apr 22: A division bench of the state High Court (HC), on Wednesday April 21, took the deputy registrar of cooperative societies, Kundapur subdivision, and the district superintendent of police (SP), Pravin Madhukar Pawar, to task for their failure to execute an order of demolition of a part of a temple in the town, as ordered by it earlier. The order to demolish a part of Lord Anantapadmanabha Temple at Badagupet here had been passed by the HC earlier, to restore the land rightfully owned by another person.

The SP was present at the High Court. The bench asked him as to whether he would be able to demolish the temple structure standing on the land not belonging to it. It also directed him to give in writing, if he is unable to execute this order.

In a report submitted by Siddarth, deputy registrar of cooperative society through the public prosecutor, a mention was made about the fact that MLA, K Raghupati Bhat, Shirur Mutt Swamiji, Sri Lakshmivarateertha, and devotees had created hurdles in the operation of the backhoe for the temple demolition. Referring to this aspect, the bench questioned in what way the MLA or the Swamiji were related with this case. When the court questioned as to whether the government is prepared to follow the court directive, the public prosecutor answered in the affirmative. The judges then asked the SP to present himself in the court and tell them whether he would be able to follow the order.

'In various places including Bangalore, you have demolished many houses, temples etc. Why is special concern being shown about the temple now ordered to be brought down? ' the bench questioned.

    Law is supreme and no body is above law. I salute the judiciary. If the court has d it illegal it will be "illegal" and has to be demolised. It applies to muslims, hindus and christians as well. It is a good example for people erecting temples overnight on the roadside on government lands.

    Folks,

    Most of legislators dont have an ideas what is their job responsibilities, some who know thinks that they are law to themself as long as they can elect themself in next election.

    They think they are omnipotent and omnipresent, pretty much they think they can do whatever they want.

    Once they are elected they should be taught constitution and parlimenary procedure before they take oath.

    Illetrates amongst them should be taught using visual slides etc....

    It would save all of us lots of pain if the religious authorities will voluntarily part away with the assets hindering development for common good.I would strongly support such action within the church.

    ya law comes first and bound to every citizen ,But unfortunately the Indian law is not equal to every citizen of the country, Hindu law is for Hindus and Christians ( in some cases ) were else for Muslims no law ( or different like marriage and all ). And money and power speaks most of the time, what can a poor Police personnel can do?

    Same thing happened in karkala also, the ex DC tried in CART Street ( not Ratha Beedi – please dear Karkalites understand this ) but saffron went against. Though the land is rightly belongs to road margin ( since British )yet people suffer. God save India before He mooves out from the country

    Now as the structureis already standingits better to by the land by temple authorites instead of demolishing it. So the temple authorites should negotiate with the party and come to a solution.

    Why not the temple management or its devotees buy land from the aggrieved party for more money than market value and settle the issue.
    Unfortunately in our own society there is scarce of trouble shooters but plenty of trouble makers. Society building is difficult but to break it is easy.

    We are in a democratic and secular country. Rule of law applies to all religions. The concerned people should have thought about the consequences before encroaching the land for temple. If the court has d it illegal it will be "illegal" and has to be demolised. It applies to muslims, hindus and christians as well. It is a good example for people erecting temples overnight on the roadside on government lands.
