New Delhi, Jul 13: Former Central Vigilance Commissioner (CVC) PJ Thomas filed a petition before President Pratibha Patil not to appoint a new CVC but to wait for the outcome of his petition in the Delhi High Court.

His request comes a day ahead of swearing-in of Pradeep Kumar as the new CVC.

His lawyer Wills Mathew said that no injustice should be done to anyone.

"Only after the disposal of our representation should there been further action," said Mathew.

Thomas’s verdict on a Public Interest Legislation (PIL) crushed his chances of being appointed to the post of the CVC.

The apex court observed that Thomas was accused in the palmoline export scam in Kerala. The high-powered committee, however, failed to consider relevant material recommending action against Thomas, the court observed.

President Pratibha Patil had cancelled Thomas' appointment on March 14.

A three-member committee comprising Prime Minister Manmohan Singh, Home Minister P Chidambaram and Leader of Opposition in the Lok Sabha Sushma Swaraj chose Kumar, a 1972-batch Haryana cadre IAS officer as the new CVC. If appointed Kumar will have a three-year term and he will have to demit office on attaining age of 65 years under the CVC Act.
