Diplomacy wins as Italian marines return, government denies deal

New Delhi, Mar 22 (IANS): Two Italian marines accused of killing two Indian fishermen returned to India Friday to face trial, staving off what was turning into a bitter diplomatic stand-off between the two nations.

Massimiliano Latorre and Salvatore Girone returned following India's assurance that they would not face the death penalty or be arrested on their return.

The marines returned to New Delhi in an Italian Air Force aircraft and were staying at the Italian embassy here.

Hailing Italy's decision to send back the two marines to stand trial, Prime Minister Manmohan Singh said: "I'm happy that the integrity and dignity of the Indian judicial process has been upheld. We are happy with the outcome. I welcome the return of Italian marines".

External Affairs Minister Salman Khurshid said diplomacy did the work and denied that any deal was stuck for the return of the marines.

"I want to clarify that there was no deal with Italy."

Khurshid, in a statement in the Lok Sabha, said: "I'm glad that the matter has been brought to a satisfactory conclusion and the trial of the marines will now proceed as per the directions of the Supreme Court in its order of January 18, 2013."

Earlier, the minister told reporters: "You should not write off diplomacy too soon. Diplomacy continues to work when everyone else thinks everything else has failed. Please give diplomacy a little more chance to do what needs to be done".

"The diplomacy that we do in government is given a direction by the prime minister and the Congress president. For anyone else among us to take credit for it would be unbecoming," he said.

Khurshid said the Supreme Court could be informed about the development next week as per legal procedures.

"The Italian requests for diplomatic or expert-level meetings to consider the issue of jurisdiction or referring the case to arbitration or any other judicial mechanism cannot be accepted," he said.

He said India had clarified "that the nature of incident was not a case of rarest of rare for a death sentence".

"We have not given away anything and are happy that the whole issue has come to an end," he said.

Italian Deputy Foreign Minister Staffan de Mistura said that a "potential diplomatic crisis was avoided" with the return of the two marines following New Delhi's assurance that they would not face the death penalty or be arrested after their return.

Addressing a press conference at the Italian embassy here, Mistura said: "The solution was triggered off by an official letter from the Indian authorities Thursday afternoon guaranteeing there will be no death penalty in this case".

Mistura, who met Khurshid in the evening, said that in Italy, "death penalty is a serious issue for us".

He said a special court to try the case as mandated by the apex court should be set up urgently and the trial expedited.

"We want justice, clarity," he said, adding that Italy's official position remains that two military officials acting on behalf of state in international waters should be judged in their own country.

Italy's Ambassador to India Daniele Mancini had given an undertaking to the Supreme Court Feb 22 that the marines would return to India by March 22 after voting in the Italian national elections.

But March 11, Italy informed India that the marines would not be sent back, leading to a diplomatic stand-off.

Following this, the Italian ambassador here was restrained by the apex court from leaving India for reneging on his word.

The marines, posted aboard oil tanker MV Enrica Lexie on security duty, Feb 15, 2012, opened fire at a fishing boat off the coast of Kerala, suspecting that the boat carried pirates.

Two fishermen -- Ajesh Binki and Gelastine -- were killed in the firing.

Information and Broadcasting Minister Manish Tewari said that Rome's decision to return the marines showed that India's "gravitas is being recognised across the world".

But the opposition, which had attacked the government for being soft on the issue, said the government alone could take credit for Rome's change in stance.

"It was the combined effort of all opposition parties. The opposition persuaded the government, which then worked out a tough stand," BJP spokesperson Rajiv Pratap Rudy said.

Communist Party of India leader Gurudas Dasgupta said: "The truth is that credit must be given to public pressure, the pressure created by parliament, international pressure, and also to the stand the Supreme Court took."

However, in Italy, the move has caused anger among people, who have called for Foreign Minister Giulio Terzi to resign.

    After this incidence will the world community believe us? What will be the position of our country in the world map here after? We win but at a high cost. There are more serious issues to be dealt with than the accidental killing and compensating issue of security personnel of a foreign country in the sea.

    The Marines will be in India chilling out at the expense of Indian Tax Payers money till the Loksabha Elections. After the voting is over, they will be allowed to go back to Italy. I will not be surprised if i find these marines in Kalangute Beach, Goa.

    Entire issue is highly dramatised and political. No solution to the families of the dead. Its better to compensate them rather pursue unnecessary prosecution. All must understand the role of the security forces that they work under certain compulsions. Indian Forces too killed some innocents during such operations but nobody mentions about it. There fore whether its Italian and Indian, security forces need to be traeted differently for such instances.

    It is believed that the Indian government has assured the Italian administration that the marines charged with killing two Indian fishermen off the coast of Kerala last year will not be awarded the death penalty. If true then it is not known whether Supreme Court of India or Government of India is conducting the trial and punishment decided before commencement of the trial itself

    Thanks to HONORABLE SUPREME COURT OF INDIA for saving the FACE of India at international level.

    Supreme Court pitched in when it realized that this spineless Govt can not handle the issue and it is a threat to SOVEREIGNTY of India.

    Night watch man was sleeping as usual. Even if Italy occupies India, he will not open his mouth.

    Good Job Supreme Court. You are the only for us at present. We respect you.

    Now the biggest question is do we need this spineless UPA Govt? It is better SC rules us.

    Keep them on trial in India for 2 years and then Italy government will come up with a compensation offer which can help the victims family.They will stay at Italy Embassy so it will not cost anything for tax payers.

    Italian govt acted stupid. It forgot that when there is legal affidavit, the person who guarantees is held responsible and does not enjoy enjoy immunity any more, as the person willingly legally binds oneself to the law of the land. Italy tried to play stupid appealing to EU. They got no support from USA, EU and finally humbly admitted and submitted themselves to the no win situation. Jai Soniaji!

And Italy Government didn't take India seriously. But when Indian government exerted more pressure, Italy Government had to bow down. Hope you have not forgotten our coward government which accompanied dreaded terrorists to Kandhahar for their safe passage!!!. If BJP was in power today, those marines would have never come to India to face trial. So you better read the news instead of acting like a frog in the well.

    Right, it's only when the Supreme Court prohibited the ambassador from travelling out of the country that Italy finally had to bow down. Since the honour, power and prestige of the country's highest court was at stake it had to compel the Govt. to impose a travel ban on the ambassador by alerting all the airports. This action by the court must have been most humiliating to a country or its citizen holding the topmost diplomatic post overseas.

    Honestly speaking, instead of hosting these marines here its better to take good finiancial compensation from the italian Govt and provide it to the victims fly and help them settle their life for the life time & their childrnes educations etc.. It will be waste of taxpayers money as first of all you cannot keep them in jails, you keep them in 5 star hotels, & our judiciary process will never complete for another 10 yearsm & at the end of it if the court announces some light sentence, whats the use ?, will the dead soul come nack ? how will will it practically help the dead fishermens fly ?

Do you know what? this family is not going to get anything from anyone now. Another thing our Dumb media our Dumb opposition our Dumb people made a big issue big hue to get this Marine's back but no people are talking about getting our own Fraud Indian citizen Lalit Modi.
