Italy recalls ambassador to India over marines' case


New Delhi, Feb 18 (Agencies) : Italy has recalled its ambassador to India over delay in a court hearing in the marines' case.

Daniele Mancini was recalled to Italy for consultations after Supreme Court on Tuesday postponed the hearing of the case to February 28.

The court asked the Central government to categorically spell out its stand about the law under which to try the two Italian marines accused of killing two Indian fishermen.

The apex court bench headed by Justice B.S. Chauhan said the government will spell out its stand in writing by next Wednesday, when the court takes up the matter for further hearing, reported IANS.

The order came after Attorney General G.E. Vahanvati told the court that the law ministry's opinion has been sought on the Suppression of Unlawful Act against the Safety of Maritime Navigation and Fixed Platforms on Continental Shelf Law (SUA) being invoked for the marines' trial.

The law ministry is examining the home ministry's opinion and that of the external affairs ministry which favours withdrawal of the SUA.

The National Investigation Agency (NIA) invoked the SUA but the decision has come under review after the Italian government opposed it, saying that its two marines could not not be tried under the anti-piracy law.

Appearing for marines Massimilliano Lattore and Salvatore Girone, senior counsel Mukul Rohtagi told the court the two could not be tried under the SUA, which is an anti-piracy law.

Italy's special envoy Staffan De Mistura said this was the 27th sitting of the court and a decision had still not been arrived at.

The envoy also suggested that with European Union's backing in the marines' case, Italy had upped the ante diplomatically.

Two Italian marines, Massimiliano Latorre and Salvatore Girone, have been held in India since February 2012 when they allegedly killed two Indian fishermen off the coast of Kerala, mistaking them for pirates.

The marines were the security personnel on an Italian oil tanker crossing the Indian Ocean.

India claims jurisdiction in the case while Italy alleges the incident took place in international waters and the marines should be tried in their home country.

    The case has been handled in a in-professional manner.
    We should know for every action there is a reaction!
    If the marines, being security personnel, if their action is a concern for Ship security? Whether they are within the scope of their security guidelines? Their action, whether intentional and mischievous or un- intentional, and their security angle alone need to be checked in all angles.
    We may re-collect, one of our Captains from Mumbai, is still languishing in Togo Jail, falsely accused for not defending against pirates.

    India has already spoiled its name in the international world by "unprofessionally" handling the marine's case. When India expected a super express solution to the Devayani case from US within a week and showed a lot of 'reactions', we drag this marines case unnecessarily. When even Rajiv Gandhi murderers have been acquitted from the death penalty, we contemplate on how to award death penalty to these foreigners.

    look at our neighbors..earlier, we had one sworn enemy PAKISTAN..now, CHINA is aggressive claiming parts of our 3 states, Srilanka opposing each & every our move (even they are opposing Nuclear power plant at TN!!),Nepal already in CHINA fold, If Bangladesh comes to Khalida Zea rule then we will be left alone in ASIA..
