Panama Papers name Amitabh, Aishwarya among 500 Indians with hidden assets


New Delhi, Apr 4 (AP / IT) : As many as 500 Indians have been named in a massive leak of 11.5 million tax documents exposing their secret offshore dealings. An investigation by The Indian Express claimed that Amitabh Bachchan and Aishwarya Rai Bachchan are also named in the massive leak of documents from the secret files of Mossack Fonseca, a law firm based in tax haven Panama.

Other noted Indians named in the leak are real estate giant DLF's owner KP Singh and nine members of his family, and the promoters of Apollo Tyres and Indiabulls. Adani Group's Gautam Adani's elder brother Vinod Adani also feature on the list, the report said.

According to the report, two years before he launched the Amitabh Bachchan Corporation Limited (ABCL) in 1995, the Bollywood superstar was appointed director in at least four offshore shipping companies. Records of international law firm Mossack Fonseca and subsequent inquiries show that the four companies, in which Bachchan was appointed director, were registered in tax havens - one in the British Virgin Islands and three in the Bahamas in November 1993.

Offshore bank accounts and other financial dealings in another country can be used to evade regulatory oversight or tax obligations. Often, companies or individuals use shell companies, initially incorporated without significant assets or operations, to disguise ownership or other information about the funds involved.

Where are most offshore accounts?

Panama, the Cayman Islands and Bermuda are among more than a dozen small, low-tax locations that specialize in handling business services and investments of non-resident companies.

Legitimate uses for offshore accounts:

Companies or trusts can be set up in offshore locations for legitimate uses such as business finance, mergers and acquisitions and estate or tax planning, according to the global money laundering watchdog, the Financial Action Task Force.

Illicit uses of offshore accounts:

Shell companies and other entities can be misused by terrorists and others involved in international and financial crimes to conceal sources of funds and ownership. The ICIJ says the files from Mossack Fonseca include information on 214,488 offshore entities linked to 14,153 clients in 200 countries and territories.

Efforts to crack down on financial havens:

The Financial Action Task Force and other regulatory agencies publish assessments identifying weaknesses in enforcement of anti-money laundering and counter-terrorism financing efforts of specific countries and territories. Financial and legal professionals get training on how to spot potential violations, since in some cases lawyers and bankers are unaware they are handling illicit transactions. The EU has stepped up efforts to crack down on tax avoidance by multinational corporations.

Past scandals over offshore accounts:

Banking secrecy laws tend to obscure offshore financial dealings. But the disclosure of other leaked documents by the ICIJ and other organizations in late 2014 drew attention to sweet tax deals offered by the tiny European country of Luxembourg to multinational companies and ultra-wealthy individuals. In the 1980s, the Bank of Credit and Commerce International, an international bank founded by a Pakistani financier, was found to have been involved in wide-scale money laundering and other illegal financial dealings.

    A Resident Indian, after paying the tax on his Indian and foreign income can send the money outside or keep the money earned outside after taking permission under the Foreign exchange rules. However, a law abiding citizen is not expected to go thru these money laundering havens.

    If the money is earned outside India and is deposited/invested in any bank/company outside India, Mr. Bachan is not guilty of any wrong doing. He need pay taxes only when gets the money into India. The money in question is earned by Mr. Bachan and Mrs.Rai bachan was earned by different stage shows outside India.

    If you earn in India and then deposit in foreign banks without declaring, then it is crime.

    I too was of that very opinion. However, Mr. Mascarenhas has replied in detail as to why the money is illegal when a resident Indian keeps it outside the country. Policy makers put their heart and soul in studying why its wrong to allow Indians to keep their money outside.

    Well, since I have no such wealth or issues, I will leave it to Bachchan family to file a suitable grievance.

    Have you heard of LRS scheme? You can deposit upto 25000 USD per year in foreign banks under Liberalised Remittance Scheme.

    Moreover you also can invest in foreign companies, set up new joint ventures etc., being a resident of India.

    There was a time when Bollywood stars went on world tours doing stage shows. Aishwarya Rai endorses international beauty products. There can be sports personalities endorsing international brands, paid for it in US$. Or, businessmen, given their agency-fee in foreign currency.

    What they should have done with the money earned this way ? Remit it to their bank accounts in India and pay 35% tax straight away ? And continue to pay tax on it annually ? Anybody may feel a pinch to do that. So, they may have found out ways to keep their money abroad.

    Tell me, how/who says this money is black ? How can Indian government force a citizen to bring in money that he/she does not wish to ? I just wish to know, I am not ridiculing anybody.

    A Resident Indian defined under income tax act, is charged for his Indian and foreign income and hence without RBI permission, keeping his foreign income in a bank outside India is illegal. An NRI can do whatever he finds good for him, till the time he becomes Resident Indian, but, still, he is liable to pay tax on his Indian income if it is above the exemption limit.
    Americans and Canadians irrespective of their residence status, have to pay tax on their global income.

    ultimately we are the fools and jokers who look at a small annual income ( hard work earned money) , calculate Income Tax, promptly pay the same, pay the property tax for a small house built with our hard earned money. there is a threat by all means if we default to pay IT as well as property tax. But these people, so called celebrities, politicians, black market giants... they say bull shit to these tax and law... showing middle finger. Look at Mallya, the politicians who always send up not declaring their assets, film industry legends and now even Amitabh and aishwarya in the radar... they earn in crores and still can escape from bank, law...     This must be the tip of the iceberg. I am not targeting Aishwarya and Amitabh only. Most cine actors are responsible for running a parallel economy which is called as black money. Why target only cine actors. Most business men from Mumbai, hoteliers in particular do not declare their income. Some of the most learned doctors lawyers are also the culprits. I have seen many Chartered accounts becoming crorepatis overnight. Their main practice is converting black money into white. What a shame. Here I am earning many times less than all these guys and pay my taxes regularly. Our society thinks it is completely in order to cheat our government and tax authorities.
