Cabinet clears ordinance to penalise persons with old currency notes


New Delhi, Dec 28 (PTI): The Cabinet today approved promulgation of an ordinance to impose a penalty, including a jail term, for possession of the scrapped 500 and 1,000 rupee notes beyond a cut-off.

The Cabinet headed by Prime Minister Narendra Modi also approved an ordinance to amend the RBI Act to extinguish the liability of the government and the central bank on the demonetised high-denomination notes to prevent future litigations.

Official sources said the ordinance has been cleared, but did not say if the penal provisions would apply for holding the junked currency after the 50-day window to deposit them in banks ends as of December 30 or after March 31, till which time deposit of old currency notes at specified branches of the Reserve Bank after submitting a declaration form is open.

The penalty for holding old currency in excess of 10 notes may include financial fines and a jail term of up to 4 years in certain cases.

While announcing the demonetisation of the old currency on November 8, the government had allowed holders to either exchange them or deposit in bank and post office accounts. While the facility to exchange the old notes has since been withdrawn, depositors have time till Friday to deposit the holding in their accounts.

    There are 60 daily fix in 50 days of demonetisation.

    Whereas none has been addressed particularly for Non resident Indians who carry small amount of demonetised currency either by respective Ambassador to the country, Ministry of Foreign Affairs,Finance Ministry or Prime Minister.

    None of the NRI has given chance to exchange his/her old currency with new,who does not have immediate travel plans.

    Does it mean majority of those who possessed old currencies are subjected to jail term or penalties?

    Does Modi government really care for NRI who remit billion to support its economy?

    Is it constitutionally permissible to create a criminal offence through a government ordinance? Doubt if the courts will uphold such an ordinance. Only Parliament through a duly enacted statute or amendment to the penal code can do so, in my humble opinion.

    Narendra Modi is telling me that in the long run, I, the common man am going to benefit. I have not been able to understand this. Insurgents crossing the border had the new currency with them on 10 November. Counterfeit currency is a fraction of a fraction. The corrupt people, all corrupt politicians, all corrupt officials and all corrupt businessman have exchanged the old currency for the new with the help of corrupt bank officials. That is why the currency deposited so far is almost equal to the total currency withdrawn and will probably reach close to equality in the next two days. Thereafter the deposits made into the Reserve Bank are likely to make currency withdrawn equal to currency deposited. Please tell me how all this is going to make me feel good. The corrupt have exchanged their money and are looking for more corruption. The so-called terrorists have got the new currency and the counterfeiters are already busy making a new things. Have I been taken for a ride?
