Supreme Court upholds death sentence to four Nirbhaya gangrape convicts


New Delhi, May 5 (Deccan Chronicle): The Supreme Court on Friday upheld the death sentence of the four convicted in the sensational December 16, 2012 gangrape and murder of Delhi’s Nirbhaya.

SC confirmed findings of the trial court and Delhi High Court against the four convicts in the case.

Justice Dipak Misra observed in its order that it's a story of 'some different world'.

“It’s a barbaric incident. Taking the serious injuries, the severe nature of offence committed by the convicts, we are upholding the sentence,” said the order said.

The top court said that the nature and manner of the crime devastated social trust and falls in 'rarest of rare' category warranting death penalty.

“Victim's dying declaration is consistent; it has been proved beyond doubt and corroborated.

“Aggravating circumstances outweigh mitigating circumstances in the case; offence created ‘tsunami of shock’.”

Tears were seen in the eyes of Nirbhaya’s mother during the verdict and the entire courtroom clapped when the judgement was read out.

The 23-year-old paramedic was brutally assaulted and raped by six persons in a moving bus in south Delhi and thrown out of the vehicle with her male friend on the night of December 16, 2012.

She was not only raped and beaten, but was also ‘violated with a metal rod.’

“It appears to be that a rod was inserted into her and it was pulled out with so much force that the act brought out her intestines... That is probably the only thing that explains such severe damage to her intestines,” a doctor from Delhi’s Safdarjung Hospital where the woman was undergoing treatment had told the media.

A P Singh, lawyer for one of the convicts, said that justice had not been done and that he would file a review petition after reading the order. “The convict can’t be hanged for sending a message to the society; the order violated basic human rights,” Singh asserted.

The Delhi High Court, in its verdict on March 13, 2014, had observed that their offence fell in the rarest of the rare category and had upheld the death sentence awarded to them by the trial court.

The trial court had also awarded death penalty to the four convicts. Prime accused Ram Singh allegedly committed suicide in his cell in Tihar jail in March 2013 and proceedings against him were abated.

The woman had undergone multiple surgeries, where portions of her intestine, which had turned gangrenous, were removed. Doctors had said that only five percent of her intestine had been left inside her when she arrived at the medical facility. She had died in a Singapore hospital on December 29 that year.

The four convicts -- Mukesh, Pawan, Vinay Sharma and Akshay Kumar Singh -- had approached the Supreme Court against the high court's order which had confirmed the death penalty awarded to them by the trial court.

During the hearing, advocates A P Singh and M L Sharma, representing the four convicts, had said they should be given a chance to reform and considering the mitigating factors, the court should not award them death penalty. They also raised questions about the evidence collected by the police in the matter.

    Some may say above judgement is correct but some may say it is wrong judgement. My doubt is why our judiciary is awarding different judgement. Is there any political pressure for awarding different judgement?????

    Bilkis Bano got justice because the rest of India and its institutions were not infected by the virus of lawlessness that Modi bred in his home state. Today, that virus is going national.

    Fifteen years on, it would be comforting to believe Modi has had a change of heart. The truth is that he has not. He is vocal about wanting to save Muslim women from the evil of triple talaq, or instant divorce, but has yet to say anything comforting to Muslim women like the widows of Pehlu Khan and Mohammad Akhlaq, whose marriages were brutally dissolved by the sudden, instant violence of ‘gau-rakshaks’. He talks of the constitution but then helps select as chief minister of Uttar Pradesh a man whose hatred of women and of Muslims is well documented. He calls himself a ‘born Hindu’ and a ‘nationalist’ but cannot bring himself to react to the shocking incident in Reasi, Jammu last month when a crazed mob shouted ‘Jai Shri Ram’ and ‘Bharat Mata ki Jai’ as they tried to lynch three defenceless Muslim women.
    The Supreme Court on Friday upheld the death sentence awarded by the trial court, and confirmed by the Delhi high court, to the four people convicted in the 2012 Jyoti Singh gang rape case.Nirbhaya case finally got justice.
    Why does Bombay High court is unfair and double standards awarding death penalty for Bilkis case accused raped her, killed her 3 yr daughter ,mother,sister,14 others no death penalty?
    Modi wants to give Muslim women their rights. So why did he abandon bilkis in her hour of need?

    Bombay High Court on yesterday dismissed CBI's plea seeking death penalty for three out of 11 people in the 2002 ''Bilkis Bano gangrape case' and upheld the trial court's verdict of life imprisonment.

    Today Supreme court has upheld death sentence to four Nirbhaya gangrape convicts.

    Bilqis Yakoob Rasool alias Bilkis Banu is a living tragedy.When fellow villagers raped her during the post-Godhra riots she was five months pregnant.In the accompanying violence, she lost 14 relatives, including her three-year-old child, mother and two sisters.

    Balkis bano who has lost her 14 members of her family has suffered more than 'Nirbhaya' rape case living dead.
    Is Bombay High Court think rape and 14 murders of Bilqis bano case is less crime than 'Nirbhaya'? On what basis Bombay HC dismissed CBI recommendation of death penalty? Does accused in Bilquis bano is influence by political party and judges are pressurized? Why 'Nirbhaya' verdict is not applicable to Bilqis bano? Why mass media remained quiet and not had interview with judges who has passed the verdict?

    Juvenile Muhammad Afroz should have got capital punishment too. I'm not with name like many people here in this forum. I'm against the crime who may done it. If his act is so cruel then how he termed as minor ? Very poor law.

    Finally Nirbhaya gets Justice... we welcome SC order with all our heart and soul... Though 4 of them get their required punishment, one is spared which is not 100% Justice given... In our opinion juvenile should not be spared and he too should get death sentence...

    Most heinous act was committed and vehemented by a so called major minor...
    He was let off and must be eyeing so many...
    As a case of mass crime detailed chain of events must be considered...
    Death penalty is not the concluding penalty to prevent future crimes...
    It van only be a deterrent...
    Fear of death they say keeps a man from away from committing a heinous crime...
    But in this age where people are trained to die as human bombs some other strategy is the need of the hour...
    From 2012 till date these four have already died so many times...
    Why kill them again?
    Let them be in captivity until death...
