Ahmed Patel deals severe blow to BJP, wins RS poll


Gandhinagar, Aug 9 (IANS): Ahmed Patel on Wednesday dealt a severe blow to the BJP when he won the Rajya Sabha election in Gujarat in a cliffhanger contest in which the top BJP leadership staked its all by backing a Congress defector.

Patel got 44 votes that was just enough to beat his rival Congress defector Balwantsinh Rajput and earn a fifth term in Rajya Sabha while Shah and Irani got 46 and 45 votes respectively in the counting that was delayed by over nine hours because of the Congress challenge in the Election Commission first and the BJP's objections before the returning officer past midnight.

Celebrations broke out in the Congress camp with workers setting off firecrackes and distributing sweets as Patel reacted saying "truth alone triumphs".

"This is not just my victory. It is a defeat of the most blatant use of money power, muscle power and abuse of state machinery," he tweeted.

Patel thanked his party MLAs, workers and the leadership for the victory and said under Rahul Gandhi's leadership, the Congress will get strength and win Gujarat assembly election.

In a jibe at the BJP top leadership, Patel prayed to God that everybody be given good sense.

Senior Congress leader P. Chidambaram, who was part of a Congress delegation that met the Election Commission on Tuesday seeking rejection of votes of two Congress rebels said: "Money, muscle and manipulation could not win in the Guarat Rajya Sabha elections."

"BJP can break a few weak Congress MLAs but BJP cannot break the Congress party," he said in his reaction.

The victory that came as a major boost to Congress has been battered in many elections in the last three years and did not come easily given the fact that the whole of Tuesday was marked by high drama and allegations, counter-allegations and high-pitched legal battle in the Commission over votes of two rebel Congress MLAs.

The first setback for the BJP came after the poll panel upheld the Congress complaint seeking rejection of the two votes by Bhola Bhai Gohil and Raghavji Bhai Patel, both loyalists of Shankarsinh Vaghela, who had shown their ballots to Shah and Irani against Conduct of Election Rules.

The Commission rejected the arguments of a high-powered BJP delegation led by Arun Jaitley that the Commission had no power to intervene in the matter as retunring officer is the statutory authority to decide the validity or otherwise of ballot paper.

This was countered by the Congress delegation that asserted the Commission was the only authority to decide on the issue in keeping with the precedents set by it in Haryana last year and in Rajasthan in 2000.

In the Gujarat assembly with an effective strength of 176 MLAs, the numbers were enough for a comfortable victory for two BJP candidates and one of Congress.

But the BJP made it a prestige fight in Gujarat from where both Prime Minister Narendra Modi and Shah hail in an apparent attempt to inflict another crushing blow on the Congress in the assembly elections scheduled later this year.

The battle became bitter between the powerful BJP ruling both at the Centre and in Gujarat and the political secretary to Congress President Sonia Gandhi when defections were engineered from the Congress first by friend-turned-foe-turned ally Shankarsinh Vaghela and six other MLAs who resigned from the Congress.

From 57, the Congress strength came down to 51 when Vaghela quit the party while six of his loyalists quit the assembly. The strength further came down when six of the MLAs defected to the BJP reducing his backing to 45. The Congress had to shepherd 44 MLAs to Bengaluru to counter poaching by the BJP.

On the day of reckoning, Ahmed Patel had 44 in his bag along with the backing of one NCP and one JD-U MLA though there was day-long speculation on how the two allies voted.

    They also saw 10 crore cash confiscated in DKS house who was hosting them.

The BJP deserved this shock treatment because their approach to this election to RS was shocking as they indulged in crude Political Corruption. Inspite of all their central leaders camping in Gujarat they could not stop Ahmed Patel from winning the election. The timing of the IT raids on our minister Shiv Kumar was linked to this election. Regretfully the electronic Voting Machines did not come to the rescue of the BJP in this election. The people of India must resolve to teach the BJP more lessons so that democracy can be saved in our country with a strong opposition.

    Now we all know there is corrupt guy sitting in EC office too. According to constitution members can vote any Rajyasabha candidate irrespective of party he/she belongs to. Ahmed Patel is the most corrupt guy shouldn't be sitting in Rajyasabha. He is the main culprit in chopper scam. Rajyasabha seats are meant for noble well talented educated people, country should make use of their brain. People like Narayan murthy, Nilekani or other famous economists should be sitting in those seats, not corrupt guy like Ahmed Patel. All he does is, working as PA for Sonia.

    For smooth running of democracy an active role of Opposite party is much required.
    Congress had some chances of getting majority in next coming assembly election but now i think its a tough job.

    I can see that you are frustrated; but cannot agree with some of the facts pointed out by you.

    1. LK Advani - Old age has caught up with him. BJP has a something called the Rule-75. I.e. any one over the age of 75 will not hold a party position or a cabinet position. It is high time that Mr. Advani retires by the end of his current term. I am not sure what you mean by a broom stick.

    2. Vice-president post - Your assertion that this post is good for nothing is absurd. Do you know who is the chairman of Rajya Sabha? And are you absolutely sure that no person holding the President's office in India would ever die or get disqualified? You are pretty much insulting the founding fathers of our constitution with your comment on the VP.

    3. Regarding BJP / RSS killing people who did not vote for them - In the 2014 general election, 172M people voted for the BJP, whereas 376M people voted against it. Further, the state elections held in the last few months too saw more people vote against BJP than vote for it. Why am I not seeing millions of dead bodies on our streets?

    4. Regarding your comparison of India to Iraq / Afghanistan - What logic are you applying? India has independent judiciary and free media. Further, more than 500M people have ready access to the Internet which is not censored. Iraq / Afghanistan was run by dictator / mullahs for decades, where as India has been a vibrant democracy since 1951. By what stretch of imagination are you equating India with those countries?

    It is OK to have difference of opinion in a political discourse. However, if you want someone to serious consider your criticism, base it on facts and not conjunctures.

    Please do some basic research on RS poll arithmetic before making some absurd / illogical comments.

    RS polls work on "transferable preference" voting system. Had the two MLAs not been disqualified, then Ahmed Patel had to get 45 preference vote to win. It does not matter how many votes the third BJP candidate got at this stage.

    Of the 176 MLAs, 46 gave first preference to Amit Shah and 46 gave first preference to Ms. Irani. Another 40 (including non-BJP and 2 disqualified MLAs) gave first preference to Mr. Rajput; and 44 gave first preference to Mr. Patel. I can guarantee that each one of the 132 votes that went against Mr. Patel would have placed Mr. Patel as his fourth preference (I.e. even below NOTA option). So, if the counting had gone to second round (because two out of four candidates failed to get the 45 first preference vote), then NOTA had a better chance of winning then Mr. Patel.

    For just one seat why DAKU made such a big drama then? Why he indulged in donkey trading? It was not a question Congress winning the seat... it was question of DAKU's prestige. They used all their power to snatch RS seat from Congress at any cost.. but failed miserably. DAKUs target was clean sweep in Gujarat as assembly elections are nearing in the state and they have to do lot of damage control there!

    First of all all cong. mla's brought to Bangalore and the reaction of bjp was raid on shiv kumar's house although there is a big shark untouched like reddy's. secondly after taking back all MLA's to gujarat amit shah able to purchase two cong. mla's by money power of gujju industrialist whose names are well known to the people.but to his unfortunate the two mlas are voted to bjp and shown the ballots to the leaders of bjp , confirm to get the money which they promised by them..and election commission declared their vote invalid, resulting in winning the Ahmed patel's victory The moral of the story is that truth always prevails and trump.the plan adopted by cong in gujarat and recent bye election in mysore succeeded . The era of decline of BJP started from its home state.the Indian people earlier had hope on Nitish kumar's lead front to fight against BJP all over India. but he has defected to BJP.

    It is amazing how all the congress backers suddenly see this as a great congress victory, while conveniently forgetting that this whole mess is a creation of Congress party in the first place. With 51 Congress MLA’s he just managed to 44 votes (including 2 from NCP).

    How many people even understand the arithmetic behind RS elections??

    A month ago, the election of Ahmed Patel should have been a no-brainer. Still he just managed to get 44 votes yesterday. Had the two MLA votes not been disqualified by the ECI on technical grounds, then he would have required 45 votes to win and thereby kissed goodbye to RS seat.

    There is no doubt that BJP is breaking the Congress flock through Shankersinh Vaghela. However, the bigger question is as to why does Congress finds itself in this position time and again. Be it Goa, Manipur, Bihar or Gujarat, the Congress leadership is simply in a reactionary mode rather than being proactive in managing the 21st century politics of India. Add to this complication is the party’s inability to see anything beyond the No. 1 family of India. Even Jairam Ramesh was frank in his assessment that Congress party just does not have an answer to the Mod-Shah juggernaut.

    As a side note – many of the people in this forum had previously created a huge hue & cry over EVMs and were asserting that the ECI is hand-in-glove with the BJP. Would the ECI have ruled against BJP on the two MLAs on a pure technical ground if that was the case?

    The BJP came to power with a promise that they would be different from the Congress and form, govern, and ensure that the government and elections are managed following ethical values. People are gullible and believed them despite the fact that Mr Yediyurappa had resorted to such unethical practices of "Operation Kamala" and tried to lure the Congress and JD(S) legislators. Thanks to the Constitutional body the Election Commission which dealt a severe blow to such unethical practices of the BJP. Hope the leaders in the BJP will learn in future.
