Liquor ban on highway - SC gives clarification, says no ban within city limits

Mangaluru, Aug 24: In what could be a major relief to the liquor and hospitality industry, the Supreme Court on Wednesday clarified that the ban on sale of alcohol within 500 meters of state and national highways does not apply within municipal limits.

The bench, comprising Chief Justice of India JS Khehar and Justices DY Chandrachud and L Nageswara Rao, had said on July 11, "The purpose of the directions contained in the order dated 15 December 2016 is to deal with the sale of liquor along and in proximity of highways properly understood, which provide connectivity between cities, towns and villages. The order does not prohibit licensed establishments within municipal areas. This clarification shall govern other municipal areas as well”.

“We have considered it appropriate to issue this clarification to set at rest any ambiguity,” the court said. The July 11 order was posted on the apex court website only on Wednesday.

This move will enable liquor vendors to renew licenses and restart the business. More than 85% of the bars and restaurants are expected to start business, says Riyaz Amlani, president of National Restaurant Association of India.

“The hospitality industry has lost more than Rs 1000 crore worth of business from April (ban implementation) to now,” Amlani informs.

    i strictly instruct Modi ji & honorable Supreme court to ban all NRI from drinking in India when they are on vacation as many of this NRI are in holiday mood and drink heavily and also involved in drink and drive so it leads to many accident this ban on NRI can avoid many accident and this is my strict order

    Now they added water to whiskey in the interest of bar owners. The law stands diluted favouring both the bar owners and highway travelers. For instance while traveling from Mumbai to Mangalore one can have access to a bar or wine shop every 40 to 50 minutes since he will have to pass through many municipal limits of a town or city all along the highway.

    Has the present Supreme Court ruling put to rest all confusions/doubts???

    After this, who will be the final authority/ies, to permit the re-opening of liquor outlets/bars/bar-cum-restaurants within City/Municipal limits??? How will be the City/Municipal limits be fixed??? Will the permission have to be obtained from multiple authorities/governing bodies or from a single authority???

    Hope there will be no more confusion on these aspects.

    Good judgement by the Supreme Court. That calls for a ALCOHOLIDAY..!!!


    Just for time pass:

    - To me, 'drinking responsibly' means not spilling it.

    - Apparently alcohol contains female hormones. After you drink enough, you can neither drive nor shut up!!

    - It is strange how 8 glasses of water a day seems impossible but 8 glasses of beer is so damn easy!

    - Alcohol! Yeaah.. Because no great love story started with a glass of milk.

    - I used to think that drinking was bad for me. So I stopped thinking.

    - Alcohol may not solve your problems, but neither will water or milk.

    - I drink beer only on days that end in 'y'

    - Always buy a bigger bottle than you think you'll need. Better to be safe than sober.

    - I finally quit drinking for good. Now I drink for evil.

    Me: I'm too drunk, you get in.


    Ok, feeling good after reading all this?? Then imagine what alcohol can do!!!

    Supreme Court of this country has no value, nobody respects it because they don't have any clarity in their rulings.
    If you have given a ruling or verdict just stick to it.
    I don't no what exactly their purpose of rulings? Just to confuse the people?
    It is just a confused Supreme authority in the Nation.
    This is the reason why i always say all Lwayers, Courts & judges are liers, it's just a business for them..
    If any crime happens these are the people who are happy because people go to police, lawyers, courts & this stamp paper, that Affidavit etc.. etc.. in the name of justice. It's all money....
    So no value for their judgements. They make & they break it...

    Where there is a will there is a way.Let us take the case of gujarat state where officially its a dry state where sale and consumption of alcohol is banned .But its common knowledge that alcohol in gujarat is more easily and freely available than milk.At 2 p.m midnight you will not find a shop which sells milk but you will surely find a shady place selling alcohol even on gandhi jayanthi day .
