B'luru: HC issues SC verdict on SC/ST reservations in promotions

Bengaluru, Nov 7: Even as the state government is dithering in the matter of implementing Supreme Court (SC) verdict that has annulled reservation-based promotions to government employees belonging to scheduled castes and tribes, the state high court has gone ahead and implemented the directive.

In tune with the verdict delivered by SC on February 9, 2017 in B K Pavitra case, the high court has published a provisional list of service-based seniority of its employees and duly making changes in their promotions as per the verdict.

Although the state government had filed a special leave petition questioning the SC directive, the apex court had dismissed it, duly directing the state to implement its order in toto before December end this year. The government had planned to issue an ordinance on the issue, but the governor, who returned the draft ordinance, asked the government to take a decision after discussing the matter in both houses of the legislature. Therefore, the issue might be tabled during the winter session of the legislature at Belagavi which will begin next week.

None of the government departments have so far published revised promotion lists. But the high court published the revised list in the website of the high court. Registrar general of the high court, Ashok Nijagannavar, said that objections if any to the list may be filed before the registrar general of the main bench of the high court here within 15 days.

As per the revised list, some persons have lost their grades and faced reversion while some others got promotions.
