Udupi, Jul 29: The fast track court here on Tuesday July 29, acquitted all 12 persons accused of parading two persons naked at Adi Udupi three years ago.

A total of 13 persons were named as accused in this case and one among them was Manoj Shetty who died recently in an accident. Town council member Yashpal Suvarna, Kantu Poojary, Satish, Ram Bhat, Jayanth Shetty, Dharmakumar, Jayprakash, Prashanth, Ashok, Bheem, Suresh and Vinayprakash were the other persons against whom the allegations were made. The court has ruled out the charges against the twelve citing that prosecution failed to produce enough proof against the accused.

A group of activists of local Hindu organization had paraded Hajabba and Hasanabba naked in Adi Udupi in connection with an alleged cattle running case. The incident had attracted even the national media and the issue was taken up by human rights organizations too. Vidhana Soudha’s corridors too were the witnesses for some hot debating over this shameful act. Accordingly after state-wide protests and agitations a case was filed against Yashpal Suvarna and others in the Malpe police station in this regard.

Finally a chargesheet was filed in the court and the process was taken up by the fast track court. Yashpal Suvarna who had been named as the prime suspect was later even nominated member of town council by the BJP-JD (S) government. With this it was widely believed that he and all those who were named accused in the case will get out scot-free. It has been proved quite right today.

Though the Court has said that prosecution failed to produce enough proof to establish the crime, it was only expected after certain proof such as negatives of the photo clicked by a photographer etc were not produced in the court at all, said a local social activist here while speaking to this correspondent. "Justice was the last thing expected in this case after Yashpal Suvarna was appointed member of the town council even when a criminal case was pending against him. So how can you expect that such a system and administration would ever stand by the victims," he questioned.

Meanwhile local Hindu Yuva Sena activists took out a victory procession from the court premises as soon as the court pronounced the judgement on Tuesday. They shouted victory slogans during the procession as they marched ahead towards Gandhi Katte.

Thanks for all those who condemned this act in this column. I again believe that Hindus of my district are innocent and swayed away with some VHP idelogies which are actually not hindu culture in anyway, and they will soon realise this and return back to their natural religion and themselves will punish those so called Hindu office bearers who just want to be in power by creating mischeif in the land.

Come on my dear innocent, peace loving, tolerant Hindus, show your true tolerance to us minorities whom you loved once and we loved you, we do not want to complicate the matter by retaliating. You show us where we stand united.

There is scope for appeal in the High Court. I am sure the culprits can be taught a fit lesson in the High Court or the Supreme Court. You cannot escape...Stop Rejoicing. One day your own family members may come to see you in jail for this act. If I was an advocate I would have surely put you behind the bars....

This is really a bad Judgement. This shows that courts are not conducting fair trial. How can the culprits be set free when the entire country witnessed this episode. How can the court say there is no evidence. What kind of evidence does the court require. This is clearly a politically motivated judgement. This judgement may further aggravate communal violence in the district. Once our courts were impartial but now its so sad to say that judicial system in the country has become corrupt.

But remember this is not the victory of Hindus nor the defeat of Muslims. It is the victory of power & money that you can get everything now a days. It is true that majority of Hindus are not comminal and I always find them friendly and peace loving. But it is the duty of every Indian to expose the culprits who take law in to their hands irrespective of religion.

There is no doubt that the culprits are a bunch of criminals and they should be punished by the Govt. When govt fails the people take irrational actions to take revenge.Justice may be blind but the masses are not.

Let the accused appeal to the higher court and let the Human Rights Commmision take up this matter to the end.It is indeed a sad day for Indian Justice System.

Kindly do not blame all Hindus for the actions of one radical outfit as we can't and must'nt blame all muslims for the acts of certains terrorist outfits.

These people who take law in their own hands an attack  on "HUMAN BEING" do not and must not represent any community If they really want to represent then let them remember that the main principle of any religion is "HUMANITY".

How can an event which took place in broad day light..ever be proved wrong? a deadly cocktail of Politics, religion and Justice can prove to be dangerous for the twin coastal districts. The life & dignity of a human being is far more superior then that of an animalafter all god made us humans like him not in the form or shape of an animal. As far as the judicial system is concerned....

The Muslims still should not forget that this incident was first raised in the Assembly by Mr. Jayaprakash Hegde and condemned by many Hindu brothers and sisters across the world.

We can’t blame all for this shameful act in every society this type of people live. When eating beef I bet these people are in number one go to any restaurant you will find this guys having beef dishes and giving reason doctor advise them to have beef purely medical reason.

So who is left :) , yes people like me and my friends from padil and around mangalore :). I know a very close relative of mine who is part of the Militant Hindu Group Bajrang Dal, who loves to eat beef and then stops trucks and lorries carrying illegal cattle,

What an irony, Why am I saying all this ? Now I am in a diffrent country and have seen that if 180 different Nationalities can live together, WHY CANT TWO COMMUNITIES ? I can only remmember the funny rhyme from my early 1980's schooling days :SHAME SHAME PUPPY SHAME :)

Let me point out why the court failed. Allegation of "Digital modification" of photo is a serious allegation by the prosecution. Its upto the defence to prove beyond reasonable doubt that the photos were indeed modified. Why would a villager modify a photo of himself paraded naked - does not make sense to me. Secondly the affected individual would have a say in this matter? I agree the article is biased. but it is biased by not putting forward arguments in highlighting the limitations of the judgment. With proper representation, this case can indeed be won and the self proclaimed protectors ( the defendants) will indeed be proved guilty. Let them not gloat over this win.
