Bengaluru: HC quashes poll code violation case against Janardhana Poojary

Bengaluru, Oct 5: The state high court (HC), on Thursday October 4, quashed an election code violation code registered against veteran Congress leader and former union deputy finance minister, B Janardhana Poojary, during the Lok Sabha election in 2014. A single judge bench of the HC headed by Justice P S Dinesh Kumar dismissed the case, which was filed in the second JMFC court in Dakshina Kannada district.

The bench observed that there is no substance in the allegation made by the petitioner and that it is not backed by any evidence.

A person, identified as G V Rajashekhar, had complained to the election commission during the previous Lok Sabha election, charging Poojary with violating election code of conduct on March 26, 2014. The commission had asked police to investigate the allegation, and the police, who registered case under certain sections of the Representation of People Act and Indian Penal Code, had investigated the case and filed charge sheet against Poojary on March 2, 2015.


Poojary had approached the HC seeking to dismiss the case, duly stressing that he had not violated poll code in any manner. He pointed out that he had delivered the said address after obtaining permission of the election commission, whereas the complainant had falsely said in his impugned complaint that the former had spoken without prior permission.
