Sr Abhaya murder: Fr Kottur gets two life terms, Sr Sephy sentenced to life


Thiruvananthapuram, Dec 23 (IANS): A CBI Special Court on Wednesday sentenced Catholic priest Fr Thomas M Kottur to two life terms and co-convict Sr Sephy to life imprisonment for the murder of Sr Abhaya in Kottayam 28 years ago. Judge K Sanilkumar also imposed fines of Rs 5 lac each on the two convicts.

Fr Kottur has to pay additional Rs 1 lac as fine as he was also found guilty of trespassing the Pious Tenth Convent, where Sr Abhaya was found dead in a well on March 27, 1992. Fr Kottur was handed the second life imprisonment under Section 449 for barging into the convent.

Fr Kottur was handed the life imprisonment and fine after conviction under Section 302 of the IPC. Sr Sephy was also convicted and fined under the same Section, apart from 7 years of rigorous imprisonment for tampering with evidence under Section 201.

The convicts will have to undergo both punishments concurrently.

Earlier, Fr Kottur's counsel argued that he was suffering from various ailments and required regular shots of insulin as he was a chronic diabetic.

Sr Sephy's counsel too argued that she was the sole support of her parents and that her pension money helped them survive. However, the court did not buy the defence arguments and handed them life imprisonments.

Joemon Puthanpurakal, Convener of Sister Abhaya Action Council, said: "The judge has acted as a representative of God; after 28 years, Sr Abhaya has got justice. It's God's will to give maximum punishment to the culprits, who committed the cold-blooded murder."

He said that their fight will continue as the convicts will certainly move the higher courts for reprieve. "I will fight till the last as these culprits will move the higher courts to get relief. I will go to any extent to see to it that this judgment is upheld."

Varghese P Thomas, a former CBI Deputy SP and the first Investigating Officer who had come out with the report that Sister Abhaya was murdered, told the media: "It's a clear judgment and both convicts given maximum punishment just short of death penalty. Justice has been upheld. It shows that truth can prevail even after so many years."

Thomas was forced to take voluntary retirement from service after his superior officers opposed his findings in the Sr Abhaya case.

Professor Thresiamma, now a retired Professor of BCM College at Kottayam and one of the witnesses, said: "Truth will always prevail. Even after so many years, truth has come out...."

"I think it was my divine duty to be a witness in this case and its God's will that I am part of this."

Thresiamma was a teacher of Sister Abhaya, who was pursuing a pre-degree course at the BCM College at the time of her death. Thresiamma was one of the few witnesses who stood their ground amid intimidation and threats and offers.

    Rest in peace sister Abaya God has brought justice
    Finally justice is done. But what about the police team and crime officials who declared this as suicide.
    28 years to reach here now may be another 28 years for appeal in higher courts, some justice system we have victims and witness punished more than the criminals. Hats off to the witness to still appearing for hearing. Shame on our so called justice system.

    As i could read the things as published i say and stand my words that both the nuns are innocent while Sr. Sephy innocently became a victim of Thomas M. Kottur, two innocent souls have been targeted for the selfish motive of Thomas M. Kottur.
    I salute the Honourable Judge who could clearly see the hand of Goa and the punishment for Thomas M. Kottur was actually written by the hands of God, certainly I feel that thje Honourable Judge might have felt great pain to punish Sr. Sophy, and I am sure that the punishment to Sr. Sophy would be reduced by the higher Courts to some extent.
    Please note this are my personal comments, as having experience as an advocate of more than 23 years by handling similar type of cases.,

    Readers, for thirty long years, these " Pious, Holy Ordained " individuals, could successfully subjugate our justice system, using the powerful, influential, political and financial clout... They were well guided n protected, by their religious orders !!!! Life sentence is " Too little, Too Late " The soul of Abhaya, will certainly not rest in peace, until and unless these crafty criminals, are not given " Capital Punishment "

    When religious personalities and politicians, etc. are involved in criminal activities, they are given all out support by higher ups to protect them. In this case the poor victim was victimized more by the culprits and their supporters.
    We have seen the case of a bishop who had raped at least one nun and the victim who complained against the bishop, got a raw deal. Many such things are happening but they don’t see the light of day for various reasons.
    Sr. Abhaya was just 19 year old girl, who was killed because she witnessed the priest and nun in a compromising position who later killed her. They were having illicit relationship, murdered an innocent girl, kept the world in the dark and God knows what all crimes they have committed during their tenure as priest and nun. Why did they become God’s representatives if they have to commit devilish acts?
    I’m glad finally justice is given to the Sr. Abhaya and her family even though it was very late. I would say better late then never. The killer priest now says he is diabetic and the sister says she is the sole support of her family and are expecting the court to be lenient towards them. Why do they expect leniency from the court when they did not show mercy and killed an innocent soul?
