Bangalore: HC Split on Fate of 11 BJP MLAs: Third Judge to Hear on Oct 20

Bangalore, Oct 18: The beleaguered Karnataka Chief Minister B S Yeddyurappa, who had proved his majority on the floor of the Karnataka Assembly twice in a matter of three days last week, has won a temporary reprieve with the Division Bench of Karnataka High Court being divided on the disqualification of the 11 BJP MLAs.
         
While Karnataka High Court Chief Justice J S Kehar upheld the disqualification of the 11 BJP MLAs, the other member of the Division Bench Justice N Kumar disagreed and set aside the disqualification.

Consequently, the Division Bench has referred the matter to be heard by the third judge on October 20 which in cricket parlance is equivalent to asking the opinion of the third umpire. However, the twist is that the third judge in this case, will be hearing the arguments from both sides afresh to make up his mind.

Thus, the third judge may not come with his judgement immediately and until then the Chief Minister appears to be safe.
         
In the meanwhile, the hearing on disqualification of the five independents, which was posted for hearing on this afternoon, has been  referred by the two-man bench to a the matter to a division bench which will hear it on Nov 2.

Justice Khehar said the case of 11 MLAs will be posted before a third judge who will hear it on October 20.

On the 5 Independent MLAs case, the bench said: ''We are of the view it should go to some other bench. We will post it before some other bench.”

It may be recalled that the Governor H R Bhardwaj had asked the Chief Minister to prove his majority on the floor of the House by 5 pm on October 12 following the submission of a letter to him on October 6 by 20 MLAs, including seven ministers – five of whom were independents.

The Chief Minister decided to convene the Assembly session on October 11 morning. However, the Speaker hurriedly conducted hearing in respect of 16 MLAs and issued orders for their disqualification on October 11 morning, with the remaining signatories to the letter to the Governor returning to the Chief Minister’s camp.

As a result of this disqualification and the consequent reduction in the strength of the 224-member Assembly, the assembly speaker K G Bopaiah held that the motion expressing confidence of the House in the council of ministers headed by the Chief Minister was carried by voice vote, even though the 5 Independents managed to be attend the session held amid tight security.

All the 16 disqualified MLAs, including 11 from BJP and 5 Independents, had filed separate writ petitions on October 11 itself before the High Court challenging their disqualification.

In the meanwhile, the Governor had termed the floor test victory by Yeddyurappa by voice vote amid bedlam and chaotic scenes as a ''farce” and sent a report on October 11 afternoon to the Centre recommending dismissal of the Yeddyurappa ministry and imposition of President’s Rule in the State.

But, obviously under pressure from the Centre to undo the damage, the Governor convened an unprecedented news conference in Raj Bhavan on October 12 morning. even as the Chief Minister had flown to Delhi by a special flight with all his 105 MLAs for holding a parade in front of Raj Bhavan, that he would offer a second chance to Yeddyurappa to prove his majority by October 14.

Though Yeddyurappa and the ruling party initially opposed the second floor test, they quickly changed their stance after learning that the High Court had put off the hearing till October 18 and returned to Bangalore on October 13 night.

The Division Bench, however, had ruled that the vote in the House will be subject to its verdict on the petitions against disqualification.

Accordingly, the second vote of confidence was taken on October 14, strictly in accordance with all the rules, and the Chief Minister registered his victory by 106 to 100 votes.

The ruling party had managed on October 13 to lure another Independent MLA, Varthur Prakash, who had disassociated himself from BJP and joined JD(S), and agreed to vote for the Chief Minister.

Another JD(S) MLA from Channapatna, M C Ashwath, abstained and subsequently resigned his seat. The BJP MLA from Lingsugur, Manappa Vajjal, also remained absent.

Thus, the Yeddyurappa regime appears to have continued to hold its facile majority in the Assembly.

The final decision of the single judge on October 20 or later in respect of the disqualification of the 11 BJP MLAs, and the second division bench, which will hear the petitions of the 5 Independents on November 2 will decide whether Yeddyurappa will continue to rule the State.
         
Significantly, the last word on the subject will have to come from the Supreme Court as whichever party wins in the Karnataka High Court will surely approach the apex court.

    It is not good precedence, CJ Kher attending Dussera with CM as CM himself is a party in disqualifucation of MLAs in which CJ of Karanataka presided over!!??Nagesh Nayak have any clue on that?By the by where is that much of amount (5o crores)for an MLA coming from to OPERATION TAVARE!!!!?

    @ Nagesh Nayak, Bengaluru, All reforms have been bought by congress. Present P. M. Mr. Manmohan Singh is the father of modern India. During BJP rule in India, we had a fight with Pakistan and BJP took our economy 10yrs back. Vajpayee was shaking hands with Pakistan P.M. when Pakistanis infiltrated into Kargil and we had a bloody war so many our soldiers lost their life the same Boffors guns (Bought by Rajiv Gandhi, Italian Sonia’s beloved Husband) saved our country. This is the achievement of your BJP (Rama Rajya) govt. Now BSY n BJP is doing the same in Karnataka. Wasting money on MLAs in crores, just to keep his seat safe.

    NEW DELHI: Former union law minister Shanti Bhushan Thursday told the Supreme Court that eight out of the 16 former chief justices of India (CJIs) were "definitely corrupt".
    Shanti Bhushan said this in an affidavit filed Thursday. He said that six out of the 16 CJIs were "definitely honest". About two CJIs "a definite opinion cannot be expressed whether they were honest or corrupt", he said.

    The senior counsel gave details of the identity of the "definitely corrupt", "definitely honest" and two other judges in a sealed cover for the perusal of judges hearing a contempt petition against his son and advocate, Prashant Bhushan. Shanti Bhushan has signed the list.

    The former minister said that since he was saying so publicly he should be made to face contempt of court proceedings and impleaded in the case in which Prashant Bhushan too was facing contempt proceedings.

    Prashant Bhushan is facing contempt proceedings for saying that Chief Justice S.H. Kapadia committed a judicial impropriety by being on the forest bench that heard Sterlite Industries matter.

    He said this in an interview and at that time Chief Justice Kapadia was a senior judge in the apex court.

    In his affidavit, Shanti Bhushan said that he should be "suitably punished for this contempt".

    The former law minister said that he would consider it as an honour to spend some time in jail for making an effort to get the people of India an "honest and clean judiciary".

    The senior counsel said that since the question arising in this case affects the judiciary as a whole, the petition "needs to be decided by the entire court and not merely by three judges handpicked by a chief justice".

    Sixteen CJI in the past that Shanti Bhushan has mentioned in his affidavit are Justice Rangnath Mishra, Justice K.N. Singh, Justice M.H. Kania, Justice L.M. Sharma, Justice M.N. Venkatachalliah, Justice A.M. Ahmadi, Justice J.S. Verma, Justice M.M. Punchhi, Justice A.S. Anand, Justice S.P. Bharucha, Justice B.N. Kirpal, Justice G.B. Pathak, Justice Rajendra Babu, Justice R.C. Lahoti, Justice V.N. Khare and Justice Y.K. Sabharwal.
    Shanti Bhushan in his affidavit said that two former CJIs had personally told him that their immediate predecessors and immediate successors were corrupt judges. He said that the names of those four CJIs were included in the list of eight "corrupt" CJIs.

    The senior counsel said that there was a time when it was "almost impossible even to think that a judge of a high court or the Supreme Court could be corrupt".

    The judge Mr. N Kumar is correct. The rebel MLAs were not given even the 7 days mandatory period to show cause their position by the speaker. The speaker had taken this wrong decision on that day morning knowing that the rebels would not support them before going for the trust vote. Even natural justice will not allow to disqualify them. As such, the speaker is not fit for that post and he must resign for acting with partiality.

    Further, Anti-Defection law is not at all applicable for independent MLAs. The court need not postphone the verdict or refer to some other bench to take decision and it is a fit case to drag the speaker for misutilization of anti-defection law.

    We people of India very much disturbed to see these delays even in small matters like this. Our Indian judicial systmem is one of the worst in the entire world. People have to wait years together for getting justice and these judges do not know 'justice delayed is justice denied'? When the speaker is delivering justice over night, why these judges need months together and thus they are indirectly helping the culprits to give misrule to the state. Mr. Moily as a minister in-charge, you should bring reforms in the judicial system without delay and fix accountability for judges. Also, vetting of judges is required before their appointments.

    So the match finals have gone to extra time. Later it will go for Penalty shootout. Our courts don’t have the habit of giving judgment immediately. They will take few months or years. It’s useless to approach the court. The Governor must take his decision. According to last trust vote BJP has won, let them continue, I am sure BJP govt will fall of its own, no need of any judgment, just wait for few days until the cabinet reshuffle. They will quarrel between themselves. and BJP Natak will end for ever in Karnataka.
