Karnataka HC upholds ban on hijab in schools & colleges, dismisses all petitions


Bengaluru, Mar 15 (IANS): The Karnataka High Court's special bench on Tuesday dismissed all petitions seeking direction for permission to wear hijab in classrooms.

The HC also stated that "wearing of hijab is not an essential part of Islam. Prescription of uniform is constitutional and students can't object to it." Chief Justice Ritu Raj Awasthi read the judgement.

"We are of the considered opinion that wearing a hijab by Muslim women does not form any essential form of practice in Islamic faith. The prescription of school uniforms is only a reasonable restriction and are constitutionally permissible which the students cannot object," the bench said.

"In view of the above we are of the considered opinion that the government has power to issue the government order dated February 5, 2022 (restricting hijab in classrooms) and no case is made for its invalidation," the bench noted.

The bench further observed, "We are of the considered opinion that no case is made out for issuance of direction of disciplinary action and warrants against the respondents. Therefore, the petition in this regard is rejected as not maintainable.

"Accordingly in above circumstances all these petitions are devoid of merits and liable to be dismissed, and all the pending applications are not maintainable and disposed of," the bench underlined.

The bench after commencing the session said that keeping the holistic view of the entire matter, it has formulated a few questions and they have answered them.

"The questions which are formulated are whether wearing of hijab, headscarves is a part of essential religious practice in Islamic faith protected under Article 25 of the constitution?

"The second question is whether restriction of school uniforms is not legally permissible and being violative of petitions fundamental rights guaranteed under Article 19 (1) (a) freedom of expression and privacy?

"The third question whether government order dated February 5, 2022 apart from being incompetent is being issued without application of mind and further it is manifestedly arbitrary and therefore violates the Articles 13, 14 of the constitution?

"Whether any case is made out in the petition of issuance of direction initiating disciplinary enquiry and warrants against respondents? The special bench said.

As a precautionary measure security was beefed up across the state. Holiday was declared in the districts of Dakshina Kannada, Kalaburagi and Shivamogga for schools and colleges.

Most of the districts imposed prohibitory orders in the surrounding areas of educational institutions. The Bengaluru Police Commissioner Kamal Pant issued prohibitory orders restricting protests, celebrations and gatherings in the entire city for seven days from March 15.

The hijab row, which started as a protest by six students of the Udupi Pre-University Girl's College, turned into a big crisis.

The bench headed by the Chief Justice Ritu Raj Awasthi, Justice Krishna S. Dixit and Justice Jaiunnesa Mohiyuddin Khaji heard the matter on a daily basis.

The counsels appearing for the petitioners contended that restriction on hijab to classrooms is a violation of fundamental rights and religious rights. There is no legal standing for the School Development Committee (SDC) or College Development Committee (CDMC), they said.

They also argued that wearing of hijab is an integral part of Islam. However, the Advocate General and other counsels appearing for the government argued that wearing of hijab is not an essential part of Islam. They have also stated that the government respects the wearing of hijab and it had been left to the discretion of SDMC and SDCs. It was also brought to the notice of the court that many Islamic and European countries have banned hijab.

    In that case there can't be caste and religion identifying surnames inside the classroom. Religion is everywhere and already in the classrooms. Otherwise all students must be addressed by just the roll number to make this so agnostic to religion.

    We are very happy when we see ladies with modern clothes, Wearing respectful clothes are better or not? Clarify here. Muslim women cannot even go front of any men, even father brother son without proper body cover. If someone not following their religion is their choice but don't say Islam says it is not compulsory. Please refer below verses from Holy Quran. Allah says (interpretation of the meaning):  “O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks (veils) all over their bodies (i.e. screen themselves completely except the eyes or one eye to see the way). That will be better, that they should be known (as free respectable women) so as not to be annoyed. And Allah is Ever Oft-Forgiving, Most Merciful.” [al-Ahzab 33:59]  I believe, there is good for muslim ladies if they put ban on hijab so that they can understand Muslim ladies quality.

    These GIRLS(6 from Udupi) really wanted Hijaab or Just wanted an issue to support BJP? Every religion has some practices, but one should follow them wherever possible without disturbing others (and making any trouble in the system). Present Hijaab movement gave a very good chance in Karnataka to youngsters(students) to support/look at BJP, who are losing their popularity in Karnataka( 2nd place in Local bodies election).

    The four states include Uttar Pradesh, the Muslim bastion. Once the High Court came to the conclusion that Hijab is not an essential practice in Islam, the whole case fell. Any appeal to the Supreme Court can only be on constitutional grounds.

    I Respect the High Court Order. But bit confused at the same time for some unanswered questions by the Court - If this was not an Essential wearing as per the Islam then what was it which they were wearing from so many years/decades ? Was it a fancy/fashion wear ? Moreover, if it is indeed a fancy/fashion wear, why someone would wear such a black/dull wear, when you have so many colourful, bright fashion-rich wears in today's modern/advanced/world ? I am sure, this will definitely go for Supreme Court's appeal for further questioning on the order!!!

    Boss the answer for later part of the question is .."Freedom of choice". Indian constitution guarantees that, as far as in public it does not offend/obscene anyone . But at places where there is a dress code like Uniforms, then the authority rules which is a minimum deviation overcomes this freedom. Actually this question would not have arrived first of all if the petitioner themselves had not asked the court as if it was the essential part of Islam. Court is not the best authority to rule on such subjects. Since they asked, now they got the answer and it will have its consequences good or bad. They should have simply challenged the court that Hijab should be part of the Uniform. Then the matter/verdict would have been simple limited to only school uniform. The petitioners have murked the water which will have nationwide effects now.

    Court has answered what question has been asked by Plaintiff, i.e. whether Hijab is essential in Islam in Secular country (India) and Uniform is compulsory. Answer is followed by Yes & No. There never been questioned about pagadi & saffron, Saffron is not considered as Uniform, so its not allowed.

    Meena Kumari (Mahjabeen), Nargis, Waheeda Rehman, Mumtaz, Zarina Wahab,Zeenat Aman, Shabana Azmi,Sania Mirza, Nikhat Zareen , Sara Ali Khan, Urrfii Javed, Hina Khan , Nora Fatehi,Yasmeen Azim Premji never wore a hijab.So it means it is not compulsory. In Saudi Arabia which is the custodian of the holiest places, hijab is not compulsory, in many Islamic countries like Syria, Egypt it is banned in educational institutions, while in Islamic countries like Turkey, Azerbaijan and Tunisia it is banned in most educational institutions, which means it is not a religious compulsion,then why the fuss here. If the head or hair has to be covered, it can be done with the school/college uniform dupatta.Religious symbols will cause polarization and help certain political parties.

    MOnty ! Muslims do not follow Meena kumari/ zeenat Aman or any other actress nor anyone else. Secondly the Hijab is not imposed by any one or any government, it is the teaching of Quran, where Allah guided muslim men to do hijab of eyes and woman to wear Hijab. Why do people think Hijab or parda is imposed by Muslim men to woman, if that was true, then why wemon fighting to wear Hijab. Finally you said in you comment "If the head or hair has to be covered, it can be done with the school/college uniform dupatta." Thats what these girls are asking, they want to cover their hair with the school uniform dupatta. Is it not strange that a girl can put her dupatta on shoulders, but she cannot put the same dupatta on head??????

    Cynthia, These girls were NOT demanding any ADDITIONAL attire to be worn inside the class, they demanded to REPLACE the position of UNIFORM SHAWL OR DUPATTA from shoulder to head. that's it ! Irony is students are allowed to have their uniform dupatta on their shoulder but not on their head !!!!

Inside the campus, if all look one, with one uniform....do you think, its bad ?? No caste/creed/religion can be noticed and cannot be categorized looking at the dress....she is muslim, and other one is Christian and another hindu. Inside the campus, there is safety....When they step outside, let all dress up however they want and according to the parents....

    Court verdict is out & now the case is dismissed. Because of few students from Udupi where this issue started now everybody has to suffer as those students who were allowed to wear hijab will also have to follow the uniform dress code. Pity, wrong decision to raise.
