New Delhi: Thomas Quits as CVC after SC Strikes Down Appointment


New Delhi, March 3 (IANS): In the latest blow to the Manmohan Singh government, Central Vigilance Commissioner P.J. Thomas quit Thursday after the Supreme Court struck down his appointment for his alleged involvement in a corruption scandal and raised the issue of "institutional integrity".Six months after the Kerala bureaucrat was named as head of the country's anti-corruption watchdog, the Supreme Court said the appointment by a high-powered panel, consisting of Prime Minister Manmohan Singh, Home Minister P. Chidambaram and opposition leader Sushma Swaraj, did not exist in law.

Responding to the ruling, Manmohan Singh said: "I respect the court judgment and I will speak in the house."

Bharatiya Janata Party (BJP) leader Sushma Swaraj had placed her opposition to his appointment on record at a Sep 3, 2010 meeting. But the government overruled the opposition and appointed him to the post.

An apex court bench headed by Chief Justice S.H. Kapadia was giving its verdict on a petition by the Centre for Public Interest Litigation (CPIL) challenging Thomas' appointment.

The petitioner had said that Thomas, a 1973 batch Indian Administrative Service officer of Kerala cadre who was earlier the telecom secretary, was facing a criminal chargesheet in a case related to palm oil import in Kerala and that he was not an "outstanding civil servant of impeccable integrity".

"We are not in any position to say anything now. He has tendered his resignation and the Supreme Court also held his appointment illegal," Law Minister M. Veerappa Moily told reporters.

He denied that the order had left the government red faced as the appointment was made by a panel of which opposition leader Sushma Swaraj was a part.

Thomas was Kerala's civil supplies secretary in 1992 when the alleged palm oil scam took place.

A case was registered in 1999, accusing Thomas and others of criminal conspiracy and causing a loss of Rs.2.32 crore to the exchequer. They were accused of importing 15,000 tonnes of palm oil from Malaysia at an inflated price for distribution through fair price shops.

The apex court said institutional integrity and functioning were more important than personal integrity though both were related.

It said it was incumbent upon the high-powered committee to keep in mind the institutional integrity while making the recommendation of the CVC and it should be according to the law.

The ruling - the latest blow to the government fighting a series of corruption scandals, including on the allocation of 2G spectrum and the Commonwealth Games - provided the opposition just the ammunition it was looking for.

The BJP and the Janata Dal-United (JD-U) said the Supreme Court decision was a victory against corruption. They called for Chidambaram's resignation on moral grounds.

"As home minister, his duty was to present the right facts but they concealed facts on the allegations against Thomas," BJP leader Murli Manohar Joshi said outside parliament, where the budget session is in progress.

"Even when (Sushma Swaraj) brought it to their notice that Thomas' name was involved in a corruption case, they ignored it," he said.

Toeing the same line, Janata Dal-United leader Sharad Yadav said the step was a victory for the movement against corruption.

"The home minister should take moral responsibility and resign. The removal of CVC is a victory for the movement against corruption," he said.

Communist Party of India leader D. Raja said: "It was a government elected CVC as the main opposition party was opposed to him, so it is a blow to the government."

Communist Party of India-Marxist (CPI-M) leader Sitaram Yechury added that the prime minister must explain the government's stance.

"The prime minister needs to answer in parliament how they went ahead despite all the facts known to everybody... even the leader of opposition objected. They have to answer. He needs to explain," said Yechury.

Supreme Court Strikes Down Appointment of P J Thomas as CVC

New Delhi, March 3 (IANS/PTI) The Supreme Court Thursday set aside the appointment of P.J. Thomas as Central Vigilance Commissioner (CVC) for his alleged involvement in a corruption case, exactly six months after he was appointed to the post.

Apex court rejects the contention of Thomas and the government that the appointment of the CVC cannot be brought under judicial review. SC says legality of the recommendation can be brought under judicial review. 

The Supreme Court today quashed the appointment of P J Thomas as Central Vigilance Commissioner, saying the recommendation made by the high-powered committee headed by the Prime Minister did not consider the relevant material and as such its advice "does not exist in law".

"We declare that the recommendation made by the high-powered committee is non-est in law. Which means that the recommendations made on September 3, 2010 does not exist in law. Consequently, the appointment of Thomas goes," a bench comprising Chief Justice S H Kapadia and justices K S Radhakrishnan and Swantatntra Kumar said.

The bench severely criticised the committee for not considering the relevant material including the pending criminal case against Thomas in the Palmolein import case and the recommendations of the DoPT between 2000-04 for initiating disciplinary proceedings against him.

    In India when we sack an employee there is no question of his resigning.
    If he is sacked he has to go or else he will be unceremoniously kicked out.
    I do not know if it is now different in the USA.
    Further to the CVC’s sacking we expected today a lot of fireworks from the BJP but when PM took responsibility for the CVC’s appointment BJP seems lost and depressed.
    It is now quite obvious BJP was gunning for Sonia Gandhi and not PM as Sonia made Advani crawl on his feet and beg for forgiveness for wrongly implicating her in the Swiss Bank account case.
    I guess you will also agree now “Truth is better than Fiction”.

    Mr. Jossey Saldanha has put down the right facts. But I also feel that either Congress made a misjudgement or misled by the beaurocracy in the matter.

    But some of the pseudo nationalists are rejoicing without knowing the actual facts. Court has very clearly said that it is not questioning the integrity of Mr. Thomas but the method of his appointment was not correct.

    This is eye opener to the UPA government in the matter of appointments.

    For your kind info Yeddy is not the head of Lokayukta or CVC...That doesnt mean Im supporting Yeddy. Please accept the fact what Congress did. I can understand there were lot of scams in the country at State levels. No state is out of it either its UPA or NDA. But when it comes to central administration BJP or NDA is more clean than the Congress. They are less cheaters compared to Congress or UPA. When NDA was in Centre the inflation was within 3%. Whats happening now 16 20% inflation??? This one is because Congress is more busy in Corruption and defending its corruption rather than curbing the inflation..And you pseudos wont come out of your wrong mind..and start showing finger at Yeddy instead accepting the wrongdoing in Centre.

    Mr. Thomas had been named in a corruption case dating back to 1991-92 when, as Food Secretary in Kerala, he sanctioned the import of Palmolein edible oil from Malaysia at exorbitant rates. However, charges against the same are yet to be proved.
    In September 2010, Mr Thomas was appointed CVC by a three-member committee headed by PM.
    In January 2011 the government asked PJ Thomas to quit but he refused to quit citing the CVC cannot be dismissed, unless asked by Supreme Court or impeached by Parliament.
    Impeachment by Parliament was ruled out as our opposition prefers sitting outside.
    Congress had no other choice but to await Supreme Court’s decision.
    Stop rejoicing guys – This is not a victory for BJP.

    Dears Readers,
    It is very evident that every one is making comment here without reading the SC judgment. SC clearly said that it does not discount integrity of PJ Thomas. Why SC has struck down the appointment is for not considering "institutional integrity" while recommending the appointment by HPC(High Powered Committe of PM, HM & Sushma). SC has observed that the HPC has failed to consider whether Thomas, if appointed,will be able to perform as CVC. The SC calls this as institutional integrity. SC also pointed out that HPC has followed all the eligibility criteria. I feel SC has stepped out of its limits by twining the judgment the way it wanted than the way it should be. Whether a decision taken by a government body is effective or not is for the people of India to decide,not for SC. Supreme Court is not a performance analyst.

    What do you expect from a government which is neck deep in corruption? Will the PM blame coalition compulsion for P.J. Thomas appointment? For the Congress, corruption is a way of life.     I respect the Judiciary, But Our Judiciary need to deliver faster, when there is a case agaist a officer at the age of 25, should be decided much faster, should not wait till 55, and becomea a hurdle in his career, it should prove one is a innocent or otherwise. in other words somewhere I feel Judiciary is blamming itself in this case for the delay, Judiciary not only deliver justice , but also at the appropriate time.

    Constitutional post nominees should impart very high standards in both personal and private life. The posts which are nominated by the President like that of Chief Justices, CEC, CVC, CAG, the chief of staffs should be impeccably clean and dedicated to public good.
    The PM seems to be out of touch and seems to be misguded by his advisors.In this issue as well as 2G scam he has shown he makes bad judgements.Its high time for him to hand over the baton to someone more capable(as of now) like P.Chidambaram.

One way or the other all the beurocrates can be trapped due to the acts of the politicians including so called highly intellegent or twisted ones. One important thing to remembered is all the orders of politicians will be signed only by the beurocrates. Whatever clean beurocrat may be.. he had with this pronouncement.     This is a classic example of UPA's wrong doings.
