Mangalore Air Crash: 'Immediate Compensation if Swedish Authority Withdrawn'

Mangalore, Dec 14: Nanavati, representing Air India, has been in dialogue with the families of victims relating to disbursement of compensation to them relating to Air India Express flight 812  crash in Mangalore Airport on May 22, 2010, which claimed 158 lives.  On the second day in succession on Tuesday, he heard appeals from the families.

He told the families that it would be possible to disburse instant compensation only if they withdraw the authority they have given to Swedish lawyer, Stephen Ericsson, to hold dialogues in an effort to secure more compensation for them.  Sources said that a number of affected families were ready to accept for this suggestion.  Nanavati reportedly told them that he would try to disburse compensation at the earliest, if they provide proof of having written to Stephen, duly withdrawing the authority given to him, as waiting for his response may take more time.

In the past, the families were required to give an undertaking that the compensation was being accepted in full and final settlement, duly revoking their right to approach courts for additional compensation. Because of the long-dawn battle undertaken by families, this provision has been relaxed. Mohammed Beary, president of Mangalore Air Crash Victims Families Association, said that Air India has now provided an opportunity to the families to approach the courts for revision of compensation, even after accepting the compensation disbursed by it.

He said that a number of families have been urging for immediate disbursal of compensation, as many of them are faced with the need to look after old parents, meet marriage expenses, or clear bank loans. “They have expressed the view that they will receive whatever compensation Air India decides for them now, and then wait for the court verdict by approaching courts if the compensation is substantially less than expected,” he clarified.

Beary said that the association has already approached Supreme Court, and that the court verdict will be binding in case of all the families affected by the said crash. “If the court decides that full compensation should be paid to the families, we will be urging for make this verdict applicable to all cases where compensation were disbursed, and undertakings against approaching courts were obtained,” he added.

    First, one must find out through RTI as to how much insurance was claimed and received by AIR INDIA for the lost aircraft and the lives of the pax's / crew.Ultimately,AIR INDIA is not compensating from its resources and its not doing any charity to the families of the deceased.

    I thought Nagesh will spare his Italian Madam in the compensation matter.The compensation matter has delayed due to lack of unity among people and few have signed the affidavit with Swedish lawyer, Stephen Ericsson for higher amount of compensations.There are thousands of Lawyers from our city and none of them are ready to provide free advice there for Swedish lawyer, Stephen Ericsson succeeded in convincing the innocent people.

    This man is speaking as if he gifting some thing to the relatives of the victims if he had lost some one dear to him he would have felt the pain and the need for money. Air india express has kileed the earning member of the families and he is talking of conditions, ask him to bring the dead people back no need compensation.

    All those died were from India. Air Craft was belongs to Indian Company. Place of that fate full flight crash in India too. Then why this Swedish Lawyer Firm appointed by some of the relatives of deceased passenger? If Indians have to fight for legally due compensation from an Indian Company that also jurisdiction prevails in India, just imagine if they died in a Foreign Country with Foreign Air Craft? Will our sacred Country with our own beloved people support this case to get the compensation?

    This happens only in India.In India there is no accountability.It is rediculous situation for the families of the victims to beg for the compensation.It is their right to get it under international Laws for which India is a signatory.The victims not only should pursue their case with swedish law firm to swet Air India and others to the full they should also file criminal cases of neglegency against Air india in the International court of Law.Indians do not show passion but only insane red tapism.

    His name itself says "Na Na" then how he can recommend Air India to pay the compensation. Let all of us get united together and say "We will not use Air India / Air India Express till the claims are settled" Withdrawing the case with Swedish Lawyers should be conditional. If the claims are settled within next 3 months the case will be withdrawn automatically and then don't say "Na Na" Vati.

    It is really a shame on us to understand the scenario. However the compensation to victims should be as per international law. Why the victims have to withdraw the petition filed with Swedish lawyer. Is it a system we have to follow when we look at developed countries round the globe. It is almost 20 months since the devastating crash took place and surprising to understand the compensation as per international norms is not disbursed to poor victims. Are we going to follow the BHOPAL gas tragedy!!!
