Karkala: 'Missing' girls case - Police arrest three, file rape charges

Karkala, Mar 9: The case of the two teenage girls who had gone missing and were later traced in Bijapur, has taken a new turn.

The police had, in the past, stated that Suma V (15) and Harshita (15), neighbours staying in Dookapadakatte near here, had left their homes together on March 1, having been fed up with the harassment and pressure from family circles. Both are ninth standard students of SNV School here.

As per the police version, both the girls had travelled to Udupi and Bijapur, before the police caught up with them at a tourist spot in Bijapur, and escorted them back to their homes.

The police had registered a case of kidnap then, as the family members in their complaint, had stated that they did not know whether the girls had left on their own or were forcibly taken away by someone. The police have come up with a new story since.

The police now say that they have arrested Manju (25), Satish (26), and Nikhit (22), all locals, for kidnapping the two girls. It is said that these youths convinced the girls to accompany them to a lodge. The police did not say which lodge and where, either Udupi or Bijapur.

The police have now added rape charges against the above accused under sections 376 of Indian Penal Code. The three men, it is said, had raped the girls at the lodge. Assistant superintendent of police, Annamalai, said that the accused can be charged with rape even if the act was consensual, on account of the fact that the girls are minors.

    @ rudolf , mumbai. That Mumbai case created legal dilemma , woman has been booked under POSCO act 2013 for sexual assault against the boy. That opens up prosecution of women too. It will be even more interesting if woman crosses complaints using CRPC 2013. There are legal provision and she can file an accusation against the boy. Have to wait and watch! .

    Bro, go through today's TOI, Mumbai edition, page 3 (to get the latest development on the same incident) where it is reported that she has decided to marry the minor boy as soon as he attains 18 years of age, which shows that they are madly in love!!

    At no point of time will I disagree any point you have mentioned here. However, you tell me - which percentage could be more (1) Women enticed by men or (2) Men enticed by married women ?

    Even disregarding both above factors, which percentage do you think is more (a) Those gave in to enticement and later regretted or (b) Those who withstood the enticement and found a perfect partner to marry ? You bet - (b) is always more because there are no one but TWO examples here - I too was coerced by a married man into marrying him (as his second wife).

    Dear Lydia,
    The debate can go on and on. It is not critical to know the percentage.
    My point was to highlight black sheep are there on both sides, why men are only targeted whenever these kind of cases appear?
    Sex is a natural desire. Those who do not have the access they try to snatch it. In one of my previous comment i had highlighted that every city should have a legalized brothel so that those who do not have the access can go there. This reduces the sex related crimes greatly. You may say that this is not the right solution. But i say that this is the practical solution. There is no need to be narrow minded with this because brothels existed thousands of years before also.
    This is what Dubai has also done since last 2 years. Every 2 kms there are massage centers to reduce the sex related crimes.

    R fernandes I totally agree with you and I profess to stop Rapes in India the best way is to legalige prostitution and have licensed brothels when sex is a need of a man it is not want but a need like Air/food/water if this is not taken care of the fantasy runs amok like a hungry predator our societal and upbringing and personal will etc. shall check and reigns this behavior but not in everyone it is like some people can fast for many days where as some willnot / cannot fore go one meal in a day so we cannot expect all men to behave in same manner but it is very important to give a channel to this need to be fulfilled legally just as Alcohol (even though Alcohol is not a need but a Want), I think it is time to start a Legalize Prostitution movement to curb all such unwanted temptations of luring/ coercing kind of behavior as once sexually relieved man will not be interested to take unwanted or unnecessary hassles for what is freely available.

    I will give you a fresh example, wherein a 25 year old female teacher enticed a 15 year old boy, took him to Goa to have fun, then from there to Bangalore and started working and living there, but now they (she)are in the police net, read today's DNA epaper, Mumbai edition, front page!! If this is not enough, I will give you several other recent reported cases as case studies for people looking around with horse blinders on their eyes!!

    The girls are above 15 and if those three boys had a marital ceremony before any intimacy , then rape charges will not stand ( please check crpc 2013 ). Police should be aware of this before filing any case. And as far kidnapping charges goes , if girl consents in court as its not force , offenses r quashed even minor party involved.


    As such cases of elopement are on the rise its legally safe for men to convince girls parents or surrender in front of the magistrate with girl and consent. The law can b very cruel on lovers sometimes.

    This act cannot be expressed as rape it can only be treated as CONSENSUAL act. When these girls were voluntarily accompanied with 3 men, not kidnapped or blackmail!
    After all, when the issue is known publicly due to social concern girls & their family members will make it as raped.

    Even though you say diplomatically there is no favouritism,one can read sexist comments very clearly.
    I agree that Men are physically strong and they try to dominate woman by force for their lust and it is called rape. It is condemnable.
    At the same time what about woman seducing men and the men may not complain and they will enjoy everything in secret. Is this not immoral and amount to soft rape?
    Do you know how many students across Mangalore has an immoral relationship with married women because they seduce them?
    This is not an assumption but it is a fact because i was also targeted many years back by a married woman in my student days, but i did not have the courage to go ahead with immoral act.
    Hence, you should know that it is a general problem and cannot be one sided.

    @ Vincent,Bendoor,you are just forgetting that These Girls had gone not of their own,but by three men forcibly.we cant judge the Situation as Outsiders without knowing what is what.but the fact that Girls are judicially minor and went not of their own,and men were above 20years.Girls are at this Age bit phantasiful and were more attracted to what they said.and Boys got what they wanted .may be some Money what Girls took.girls must have believed since they knew them.

    Very unfortunate incident, but lucky that the missing girls have been found without any delay!!

    Even if the female is a major and has consensual act, still she can change her statement later, due to vested interests, and say that she was tricked and raped, and put the man concerned into big trouble!!

    ..i am not against prosecuting boys..but my point is Girls also to be charged for their negligence..they are minors, but did a major thing!!..In Delhi rape case a boy is minor, there is all efforts going on to treat him as major for his gruesome crime..same should be applied here..recently SC ruled that 'it can not be termed as rape, if a girl (major) indulge in premarital relationship with Boy on marriage promise'..Girls should know that she is taking risk knowingly & it is not allowed in our culture'..Major or Minor must aware of this reality..

    Do you know why parents want their sons to grow big enough before marrying them ? Because that is when they will be able to shoulder the burden of a family. But, elders don't say they should seek sexual pleasure elsewhere before they marry - do they ?

    The same rule applies to girls too. If they seek physical pleasure before they come to a certain age, its harmful for their health. A man has no risk, but a girl may face a teenage pregnancy ? Is the man who took part in the act ready to support her ? Never ! So, while supporting crime, please think humanly and from both angles. It's alright to be a male sympathizer, but don't be a female hater either - please...

    @Ramesh 15 yr old is not mature to look after themselves so they are added in minor category it is same in all developed countries. Its male responsibility to check the age of female even if they are going to get married if she is a minor and male above 18 he could still be charged.
