Mangaluru: Man arrested for digging up road, obstructing vehicles

Mangaluru, Jan 13: Chaos erupted at Neermarga here late night on Monday January 12, with the Mangaluru rural police arresting a person for obstructing the movement of people and vehicles on a public road.

The arrested person is Prem Michael Crasta from Ontemaru near Neermarga. His mother Jacintha was also taken into custody but later released.

As per the complaint filed, Prem Michael Crasta with the help of 15 persons, who have not been named, dug the public road and obstructed the movement of people and vehicles on January 12.

The place in question is a road connecting Adyar Padav. The said road deviates from the Neermarga Merla Padav main road. The distance to Adyar Padav from this point is 2 kilometers. If the road is closed, the distance becomes 8 kilometers. The road is narrow and only 3 wheelers and 2 wheelers can use this road at a time.

As a bridge is being built on the main road, the connection through the main road to Adyar Padav is cut off completely. Hence more vehicles started using the shorter road. This road passes by the property of the arrested person Prem Crasta. It is alleged that on January 12, with the help of 15 people he dug the road using JCB earth movers. After that the said road was completely closed for movement of people and vehicles both, because of the pits dug on the road.

The people from the area objected to the digging of the road. Corporator Melwyn D'Souza and Krishna Palemar, the former minister visited the place. When the persons from PWD tried to close the pits Prem is said to have stopped them from doing so. He with his mother Jacintha Crasta told them that the matter is in court from 2006 and hence nobody is authorized to intervene in the matter.

Gokuldas Shetty, the former taluk panchayat president speaking to daijiworld said, "This road has been in use for the past 60 years. 200 families benefit because of this road. No way this road should be closed."

It is reported that police have also questioned Jacintha Crasta and are planning to question other people.

That's not happened in Jacintha's case. But i replied u saying exactly where she admitted for her treatment. What base is required??
Jecinthas Crasta's Br. Jerome Saldhanha built a Mori where sanctioned by Tax payers money is a base and proof.. Please go to Taluk Panchayat and take reocrds of works done during Mr. Jerome Saldanhas Tenure as a Taluk member.. I have those evidences way back 30 years. If daiji is ready and assure to publish we will do so.... probably end all these base....etc...

Viola, one important point to be missed which I remember, Ask Crasta family.. that their uncle whom you claim to be using different road....Whilst taking uncles wife to hospital in her labor pain, in late Lawrence saldanha's, (Kambla) Jeep delivered healthy baby girl over 30 years ago.. probably people will remember if at all that generation is in this argument...

Dear Merlapadav public, I am also aware how much this Crasta family suffered from these public. Otherwise they would have allowed to use their land. But these people how many times beated them spoiled their other land too. And there are many roads which were used by the public from many years and the area which u told that u done have any alternative road can come out these roads but why the public is not opposing the closure of these roads and paths which are clearly there in Panchayath record? If the public has asked in a good manner from Crasta Family then i am sure this Family would have allowed. But see there is not kindness. Only the owner knows the pain while giving the land free of cost. They are not having much land as the public who own acres of land in Poyyabail area. Even public have digged the road which their uncle used for taking his bullet. The road which u r telling (uuncle used to ride bullet) is different not passing through Prems property. And because the public spoiled that road his uncle have constructed a new road and why the same road is in Panchayath records I ll suggest u to use this road throgh which u can reach Poyyabail, Thenkaikodi or any other place.

Good to see all the comment.. I too have property in Mangalore and there are public pathway and natural water channels in this property. And all the records are in my name..The question here is public easement rights... I cant close the pathway or the mamool water channels saying it is my property and I hold the record. Same way,, Mrs Crasta has records in her name. The public road has been built and since 1967 the Neermarga Panchayat has spend lots of investment on this road. That does not mean this property belongs to them. Go to THE INDIAN EASEMENTS ACT, 1882. You will understand better. Simply dont have baseless argument....

Hello Viola,

We are not commenting here after just reading the article. We are leaving in the same area from past 35 years and my dad is leaving there at-least for 76 years.

When my Dad was 18 or so, whole people from that place including my dad has constructed that road not recently my dear. And that was the main road for those leaving in ThenkaiKody, Moirekody, Nattil, Doddamane, Poyyabail (Not sure you heard these place names, but I did because I am from that place) to go to Merlapadav bus stand/Merlapadav Church and School. And we have used the same road and lot many other too to do their schooling and religious purpose.
You may not be suffering, but we do mam as we don’t have any other alternative road to go if any emergency exist. This is the road we used from my birth. (You can just ask Crasta fly, which road their brother (Who lives in Moirekody area) was using early and middle 1990’s to ride his bullet? (I remember, that time only 2 bikes were running in that road one is his bullet and another MIT of another neighbor), Also you can ask, from where most of the funeral where passing to church if anybody passed away during that time, only if you are interested else leave it)
Viola, you might be commenting it after just reading this article from daijiworld but not we. You might have grudge on Merlapadav public so you are commenting this. But I am looking for justice.
Let’s see, how someone just say it’s their own property, when road is already constructed 50-60 years ago and its being in used for past so many years. And why they not objected it before when Cyril Uncle (Prems Father) was there. Why these things came up suddenly few years (4-5 years) back?
These are the answer we are looking forward!! Is it because of just 2,00,000 rupees!!!

What about beating Prems mother by gundas on 6-1-15 and entering illegally into their land and construction road by damaging the property belongs to them when no one was there at home? Even though Daijiworld has not published the matter about damage made by public to Crasta property and beating a woman (Prems Mother) by 3 men if God is there he will surely protect and gives courage to this family. thats all is my wish.

Just continuation to my yesterdays comments, What!!! gundas are beaten her? Can you tell me of what extent? If gundas are beaten her, then there might be some wounds in her body right? believe me (If you want else leave) i have just seen her on 7/01/2015 morning, she was fit and fine and there was no such wounds in her body, oh have some mercy dear before commenting. And just see in this pics itself, how active she was in protesting, if she was beaten badly then she would have some problems within her and she would have admitted to hospital directly at least for 24 hours. Hello,

Like that anyone can admit and produce fake documents if you are having good reference in hospitals. Same thing Mrs. Jessys son Prem has did 3 years back. Funniest part is that, when he said he was got admitted to hospital, many of us seen him in front of his house, and lots are there for eye witness.

Being a christian its not good to you. Be good to public. I'll urge you try to help to resolve this issue not to stretch this. This would be good for you.

Hello Viola,

Have you ever tried to see what is the status of the cable and how many patches for those BASNL cables till now and i don’t think they could have manage with this? This is not only this time he has dinged the road like this it’s happen before as well. So do you think is it possible to repair the old cables when there are 100 of patches?
Forget it, they are aware that BSNL cables were passing by that, then why they did not informed BSNL while digging, I am damn sure they must have taken some action to protect government property or so called public property. At least they should have secure our telephone connections.
Still if you would think, old ones can be repaired you have a full authority to speak to BANL and I am not right person to judge their decision and answer for your query too. Mam keep it mind “you are always passing by any road that could be/would be, someone’s private property” they never thought that that’s their private, for someone’s benefit they have given to PWD and you are now making use of it. Think in the same way here too. Do you think we don’t have rights to make use of that road which is exist from 50-60 years?
Madam you might be leaving in city or where you are getting good mobile network, mind that there are still people who depend on BSNL connections like us and from past 5 days we are without telephone connections, understand how we will be contacted when we are gone out for work and there old age persons are leaving?
Keep it in mind that during Perms Fathers time these cables where laid not now. Then why his father not objected for this yaar? Think in that manner too why you are thinking like this, at that time Cyril uncle was the owner of that, its our bad luck he is not with us else this would not have happen for any case. If they had any issues Prem and his mother could objected it as both belongs to Cyril uncles fly. They didn’t do that. What she did is absolutely right. To protect her land she might have done that.when others enter her land and destroy the trees and trying to make road by beating her by gunda from chennai and merlapadavu gundas who don't have right in her land why she can't bring gundas from anywhere and spend her money as she wish. Police have arrested Prem for just sitting for justice but not arrested those who have beaten her mother. And if the land is public then why the govt has put a board at the beginning of prems property saying that work is completed. Why they have stopped tarring the prems land?

If she would have provided that road would be closed at least 5 years back not today with the proper fencing. Then public would not interfere there.

Its Crasta Family land. May be you are not aware about this. Mrs. Jacintha Crasta has the original land records in which there is no road at all. And everybody accept you knows this. and you will come to know within few days. Its the public and Panchayath or Govt. Officials who have failed to prove that its a public road thats why they are taking help of politicians and public who are not related to this area. But Crasta family is truely fighting for justice. When the matter is in court you dont tell them to put fencing. and its not late too why public is opposing when they do anything in their property. And for your kind information, when the matter is in court who are they to dig the road and spoil the public property, if the property is in their name and if its crastas property why they can’t solve the issue immediately by producing the documents or why they have to rely on court. Punchayah/PWD or government is never failed to prove this, as they have fair enough documents to show this as a public property, it was crastas call to take the matter to court, what public can do for that. We have to wait for courts decision. Till that land is Public land, because it exist from long years. This is already proved in this article itself.

They don't have any other records now drawing bsnl to press land in his absence. We have lost telephone connections and no means of communication there as we are much dependent on just telephone connections as mobile network not reaches to few area there.

I was asked to see this news by my friend. The same one who lost her child(4 months pregnant crossing this pit to meet her old and very close college mate.. I would like to comment on this truely.If this is a private property let it be.. But having to purposely unlevel the road (as in make it a 4 feet step hole for vehicle not to pass or making difficult for old or pregnant ) so that people find it difficult to pass is a very mean thing.. U be a big shot holding that stretch of land and fighting for ur right but make sure no one is harmed. This can be a small incident but it took a life away.who to blame.. ?? The owner or her fate.. Stop all this fighting.. My land ..my ego ..my money and learn to give the best.. Both to mankind and their God fearing conscience.. If 200 families or people are benefiting why make a fuss.. What are u gonna do with that land ..take it to ur grave..?? U don't have to make a sacrifice.. But have the rite mind.. Maybe u will be rewarded for ur good heart.. Anyway lost is lost.. Who said it’s a private property. Do you have any documents to confirm that? Then all whose are in this window will blindly accept it and specially we stop commenting it and Have some mercy for being a christian. If you were used that road to omzoor or where ever before i, mean that road is exist before 32 years? And how somebody come and say it’s not public property? If they would have any hesitations they should have clearly tell before itself not today as they is no other means of road facility exist to that area. Have you ever tried to this? Why I have to try to convince after all sitting in Germany you are speaking, tried to come down and analyze.
Rita it’s none of your buisiness to say anybody to how they have to travel. Just think mam how many families getting benifit out of it. I don’t think they have anythink to say that’s their own property as this road is already registered in Panchayath and PWD.
Then make you clear how you decide its a private property, if road is his private property why he did not fence it before itself and closed it from above rather than digging. Just to add Adyar Padav telephone engineers were layed a cable from that same road, why Crastas were allowed at that time if it was their property I don’t find any sense in your argument here.
If it was a private property why Prems father has didnot file a petiton in court or his grand father!!!! They did not had any issues!!!

@Pradeep nirmarga,yes Pradeep Ihave been through this road before you are Born even .But exactly where the Position I cant say at present.since we have to pass through Merlapadav from mermajal ,with bus.What Prem has done beeting Police is not good I never said it.but the road is bieng repaired,the concerned People contractor or ingineuer should have cleared it in first place about Transport,ways.You might have Problem to drive a car then go through riksha or by other methods or wait till the roads are repaired.This particular road is terrible to drive a vehicle.But doesnt mean one should drive through any hole you have even through someones property as they .I dont know the official side of it.That should be cleared by official records and Panchayat.we too drove through merlapadav to Baddoor.Peace.

if Crasta maam grandfather had not been generous at that time prem would not have seen this day , prem and jacinta are paid today for his generosity . now its already given to the public and they are using it so there is no way to close this road.This was the last option what the crasta family thought but it back fired. thus drag him to the station .
i have been using my vehicle in that road since seven years and others using may be more than 30 or more .

Do you think those 200 families gone crazy to pay for the road which exist at-least for 50 years and all they are using the same pathway to reach destination. Wow.. Merlapadav is in news!!! Surprisingly i can see most of familiar faces.

Well , this is very sad to see police assualting the Mrs.Jecintha and her son.

The road is in use from quite many years and people were trying to make a good road out of it.However the property belongs to Crasta family and they do have all the authority to object on things in which they liable .But the family seems to be having load of issues on this, well the road is only used for commuting and not for any other purpose hence they should let them use as they don't use this any other purpose but taking the family consent and then building will more make sense I guess...

Blue Film Man showed up for this, may be a reason to open a Blue Film Theater to satisfy College Students of near by area. What the hell Gokul Shetty knows about it while He is not from the Community to mouth off. What good He has done for local People during His term. All this problem started with ignorance from PWD.
Without having a good diversion road,they removed the connecting bridge in Ontemar. Is there a real good job,PWD has ever done. They started to dig last year just week before rain started. All the dry months passed and now 4 months before rain they start the work.

My dad and mon says, they were there when this road first bulit and they have contributed too. My dad is 75 now. if this road was built atleast when if my dad was 25, then it would be this road is 50 years aged now.

If the property belongs to prem n road exits from such long time n also if this road reaches to houses saving 5 km then revenue department should acquire Mr. Prems property by compensating him. many people from that region have put the mud, enlargen the road by usinG JCB, and cut the twigs of the trees belong to the property of crasta family.
when the work was in progress Mrs. Jacintha Crasta went to the venue by using auto, Just asked who had permitted them to this work when the matter is in court.
That time three of the gentleman held and bounded her ... and one of the person has assaulted on her back.
after which she was admitted to coloso hospital without able to contol the pain on her back.
there they have lodged a complaint too,
FIR has been registered on those three people, " because of the Political and Money Power" they havet arrested neither Culprits, nor nor the JCB.
But when yesterday Police Commissioner by seeing the legal documents permitted to dig the road, latter {we can observe} both the Political Party leaders Congi and BJP} joined their hands Created Such a worst situation .

if the public are right and have legal document they must produce it, they have not produced, jost showing the money power and man power on Innocent family.....

Because of their selfish nature these things are happening. Both son and mother have some jealous with neighbor s who used same route but it will effecting 200 people that’s all

If you don't have alternate road to pass by, you have to convince the property owner nicely instead of showing goondagiri. Nobody cares goondagiri now a days.

Last 60 years public using this road then what happened now.
why don’t they put wall or something if it is private land
They knows they can’t do that because of 60 year history
Corporation should act on this and solve this disputed land issue and give the justice to the people who use this route for their livelihood.
Even Crasta family knows they can’t close the route that is why they start this kind of drama to disrupt the route and trouble the poor people.

India is a peculiar country!..

You find a MOuntain man like "Dashrath manjhi".. who ALONE, dug the mountains and carved a road for people to go easily, cuttinsg short distance, just because his wife was dead, without proper medical help, because of no road connectivity!

we have young IAS officer, Armstrong Pame in Imphal, who built a long road, from public's shramadaan and money , for the easy connectivity of their village!

and then we have people like this mother-son! ... who are jealous, others are using a Public road, that passes next to their house or village!

tell me, if it is his private property he will leave it without a compound wall constructed? if he has papers/documents for all the land he says it is his, who will stop him from constructing a wall there? I see clearly a compound wall beside it! were you sleeping for last 60 years, when vehicles were plying? Even I know pnachayat rules..! even if one person protests, or for that matter in once own family, there can not be encorachment! if it is agricultural land, and conversion is done, people have to leave their own 40% of border for roads etc!... maateregla rule gottundu! ...undu jaaged problem undu! itte akrama sakrama malpuna plan!

if it is my land, I will construct my wall, I dont need anyone's permission for it! .... i wont dig graves on the road! and specially not in the midnite, liek a chor! If it is Crasta's personal property, why Palemar is there to poke his nose? Can't he sit at home and watch something good?

Allowing people to pass by road belongs to Crasta is his personal call. Nobody can question.

It is a private property and Corporation failed to acquire for public use.As said in the report,the road was used since long and owner considering the history he could've restrained doing so.Now this 'BHOOMI IS VIVADITA'so public has some right on it.Amicable settlement by Corporation and Land owner only can RIP this issue.

After five to ten years govt.. will make it as a bigger road to move more vehicles, then govt will forcile ask to move from there to Mr.Michael Crasta ....
