Bombay HC allows Nestle India to export Maggi


Mumbai, Jul 1 (DHNS): In a major relief to Nestle India, the Bombay High Court on Tuesday allowed it to export Maggi noodles despite its ban in the country.

A division bench comprising Justices V M Kanade and B P Colabawalla allowed Maggi’s export after Food Safety and Standards Authority of India (FSSAI) said the company could export the product if it is as safe as it claims.

“Why blame us...If the company claims that its product is safe and follows the safety standards then let them export it instead of destroying (packets of Maggi noodles after recalling and withdrawing from stores),” said FSSAI counsel Mahmood Pracha. “If the products are safe why do not they export?” he said.

The matter has now been posted for July 14.

Nestle India’s counsel Iqbal Chhagla said by the end of the month, the company would destroy 17,000 crore packets of Maggi. “Of these, 11,000 crore packets are being recalled from the market,” he told the court.

The Maharashtra government submitted that ex-Advocate General Darius Khambata would appear on its behalf, and sought a short adjournment.

The bench subsequently posted the matter to the mid of next month. Advocate Sumedha Rao intervened in the matter, saying Nestlé India should come out with a plan to protect customers. However, the court did not allow her plea saying she can file a separate petition.

On June 11, Nestlé asked the high court to quash the Delhi-based FSSAI’s June 5 order asking the company to recall all nine variants of Maggi from the market since they were for human consumption.

On June 6, Maharashtra government passed an order to ban the product in the state.

Justifying its ban in an affidavit, the FSSAI said: "The present situation has arisen only because the company has failed to adhere to its own declared policy and principles.

The one rejected in India is exported. Now only other countries are rejecting Indian products. Now Its officially proved that Indians are ready to kill.

    Do people know that many tandoori and other masala powders that are made in India, are banned in Europe and USA? Shaan masala powder from pakistan is available in western countries, but indian masala powders are not! Only indian masala powders made in the USA, Canada or England are available in western countries....wonder why???? Because of the toxic colours and chemicals/preservatives, indian manufacturers put in their commercial edible products.

    This is happening for ages. Authorities are sleeping in India. Only they wok u now because Maggi didn't pay the maamuli. That also the UP officials came to know there is contamination in Maggi. So you can imagine why it happened

    I notice customers skipping not only Maggi but all products with Nestle title. Check with local shops. All for the fear of LEAD contamination.

    As such, I wonder which country offered to import Maggi !

    Why court is so blind. Why cant it direct to test all the products in India. Every product in India is contaminated. All the Masalas are missed with colors and some chemicals. But no court is bothered. It seems that Only Maggi is contaminated. Indian Maggi Joke. Paise pe sab kuch chalta hai. If you dont bribe properly you will be caught. Even though your product meets US standards it wont meet Indian standard if you dont pay under the table. Modi is asking for FDI.

    If you have little trust in Indian Constitution then please refer National Commission for Minorities Act, 1992. Six religious communities, viz Muslims, Christians, Sikhs, Buddhists, Zoroastrians (Parsis) and Jains have been notified as minority communities by the Union Government.

    But if you go and search in Nagpur HQ constituency then you will find only Beef,Love Jihad and Babri Majid act
