Aadhar will be optional for availing various govt schemes: SC


New Delhi, Aug 11 (PTI): Aadhar card will be optional for availing various welfare schemes of the government, the Supreme Court today said and ordered that no personal information of the holders of such cards shall be shared by any authority.

A three-judge bench, which in the forenoon referred to a larger Constitution Bench a batch of petitions challenging the Aadhar scheme and the issue whether right to privacy is a fundamental right, recorded the statement of Attorney General Mukul Rohatgi that "no personal information of Aadhar card shall be shared by any authority".

The bench, headed by Justice J Chelameswar, which issued a slew of directions, said the Centre shall give wide publicity through electronic and print media that the card is not mandatory to avail the government schemes.

The bench, also comprising Justices S A Bobde and C Nagappan, said, "UIDAI/Aadhar will not be used for any other purposes except PDS, kerosene and LPG distribution system." However, the court made it clear that even for PDS, kerosene and LPG distribution system, the card will not be mandatory.

It directed that the information received by UIDAI shall not be used for any other purposes, except in criminal investigation with the permission of the court.

The court did not allow the interim plea of petitioners, challenging Aadhar scheme, that the ongoing enrolment process for the Aadhar card be stayed.

Earlier in the day, the apex court had referred to a Constitution Bench the batch of petitions challenging the Centre's Aadhar card scheme and decide whether right to privacy is a fundamental right.

Allowing the Centre's plea, the court framed various questions, including as to whether right to privacy is a fundamental right, to be decided by a Constitution Bench.

"If yes, then what would be contours of the right to privacy," the apex court said while referring the matter to Chief Justice H L Dattu for setting up the larger bench.

Attorney General Rohatgi, appearing for the Centre, had earlier said that the matter requires elaborate debate and an authoritative pronouncement is needed in view of the fact that there have been inconsistent decisions as to whether right to privacy is a fundamental right.

He had cited two judgments, pronounced by six and eight- judge benches, which had held that right to privacy is not a fundamental right.

Subsequently, smaller benches had held a contrary view and, hence this matter needed to be decided by a larger bench, he had said.

"Whether right to privacy is a fundamental right guaranteed under Part III of the Constitution of India, in the light of express ratio to the contrary by an eight-judge bench in M P Sharma case and also by a six-judge bench of this court in Kharak Singh's case" has to be decided, Rohtagi had said.

The Centre had sought transfer of the pleas against Aadhar to a larger bench, saying that a two-judge or a three- judge bench cannot decide it. Referring to pronouncements made in historic cases like A K Gopalan, Maneka Gandhi and bank nationalisation, the top law officer had said that inconsistencies with regard to interpretation of certain fundamental rights can only be "squared up" by a larger bench.

The Centre had opposed a plea seeking initiation of contempt proceedings against it, Reserve Bank of India (RBI) and others for allegedly insisting on Aadhar cards to grant benefits of various schemes to citizens, saying it was not mandatory.

In pursuance of earlier orders, the government has conveyed to the states and authorities concerned not to make Aadhar cards, issued by UIDAI, mandatory for availing various schemes, Additional Solicitor General Pinky Anand had told the court.

The bench was hearing a batch of pleas against decisions of some states to make Aadhar cards compulsory for a range of activities including salary, provident fund disbursal, marriage and property registration.

The government had also said that persons, having Aadhar cards, were being asked to provide it to authorities but this was optional.

Senior advocate Gopal Subramanium, appearing for Mathew Thomas, one of the PIL petitioners, had filed an application seeking initiation of contempt proceedings against the Centre and others, including RBI, and the Election Commission.

He had alleged that the government and others were in violation of earlier orders that had said that no person should be denied any benefit or suffer for not having Aadhar cards.

    Aadhar is the innovative and smart idea, which will be instrumental in taking the benefits to the poor and deprived. It is a UPA project, naturally BJP opposed it.

    Today, BJP is arguing in favor of it, by itself implies BJP was ignorant again when it was opposing.

    When it comes to court verdict, yes, Aadhar can not be made mandatory, but alternative to dozens of other documents one has to submit to avail benefits. People will go for it by themselves, as 80 crore people of Indians already done.

    ..its a daylight scam..how can a Govt spend thousands crores of public money on a citizen ID card without parliament nod,which dont have any legal support!!..today SC says its not mandatory..After this verdict AADHAR not even important than a Ration card..Congress MP candidate NILEKANI paid by the Congress Govt in crores..BJP tried to convince SC to give legal backing..this U turn is to save 10 thousand crores of public money which Congress spent recklessly..

    First of all everyone should understand that SC decision is based on tbe fact that this Aadhar is a order by one of government ministries and till today there is no backing by law as its not approved or introduced in Parliament. This itself causes concern that the data collected is being used to do things which citizens are not aware of as all personal data is with the ministry!. More strange js tbe fact that the party that opposed tbis scheme and even said explicitly that it will be cancelled is today giving more importance to this scheme than the party which started this scheme!. Good that SC has given a slap on the face of tbe government.

    John..read first 4 lines of your own comments then you will realise why BJP opposed..secondly, why BJP now supports..within few month of Govt formation BJP was ready to scrap AADHAR but NANDAN NILEKANI met MODI & urged not to do so, it was widely reported..Later MODI also realised how Congress spent thousands of crores of public money on this card which dont have any backing of Law!!..if its scrapped crores of citizens tax money goes waste..thats why it requested SC to look into the matter & give legal backing..its Congress which started this scheme without proper planning, not the BJP..If proper investigation made it will be another scam of Congress..

    The supreme court is composed of very learned people.
    They are right. A modern human being's most precious possession is identity.
    The problem is that no clear method has been described that prevents the identity schemes from being misused by others.
    It is a fool who will freely let his most personal identity information in the hands of agencies who will be careless with it.
    Only when the safety of the information is guaranteed and proven will this be a useful exercise.

    ..GOD save INDIA..If SC decides or objects to this card, then why Govt didnt took its permission while introducing this card!!..thousands of rupees spent on this card..millions of manpower spent on this..AADHAR is not perfect,but can be improved gradually..If not mandaotory then who cares!!..till today we are not able to give our citizen a Identification card..every nation introduces this..in Gulf regions its very successfully implemented..even after 60 years still we are limping..we have road blocks in every corner in the forms of NGOs,Courts so on..Its pity that even if SC orders, still it goes for a review after 15 years!!

    U turn syndrome has spread to Bhakths as well. Before elections Aadhar was huge scam and once NDA come in it was supposed to become Niradhar. Joker Ananthu vowed to jail Nandan. Now how come suddenly Jumla leaders and their Bhkths reposing faith in Aadhar.

    Since Aadhar card carries lots of personal information it would be of great use and help for civil administration and crime investigation Agencies too. We in GCC countries have Civil ID which is a must for anything and everything as long as we are legal residents.
    I hope Indian government will succeed one day to introduce such ID card so that lots of infiltration and terrorist could be nabbed. A positive step ahead to check the criminals.

    ..If we go like this even after 50 years we cant issue ID..Programs are good but implementation very poor..UPA messed up initially, there was lot of confusion but later it took some pace..now SC put a break..if you make it mandatory then only it gets importance otherwise who need it..In Gulf we cant go out without ID card from SIM card to private Hospitals its must..we boast we are no.1 IT tech, but only selling outside not to use it ourselves..recently INFOSYS Narayana Murthy openly said, they are fed up with Govt projects..red tape every where, no enthusiasm, delay, price escalation so on..

    There is no document in India as foolproof as Aadhar card. In addition to the above, it is now being used for passport application, ration card and verification of income tax return. Since it is not mandatory and also since you have other documents with your photo, it is up to you whether to go through a rigmarole.
