Kuwait banned drug case - Richard's wife Justine arrested

Karkala, Sep 19: Together with the arrest of Richard Castelino in connection to the case of Melwin Fernandes who was apprehended in Kuwait for carrying banned drug last year, the police have also arrested Richard's wife Justine who had given the parcel containing the medicines to Melwin.

In early 2014, Justine, it is said, requested Melwin Fernanades, a neighbour, who was going back to Kuwait after visiting his hometown, to carry some medicines for her ailing husband working in Kuwait. Melwin had taken a parcel given by Justine to him in good faith, at Richard's behest, without realizing that contained a banned drug. On his arrival at the airport, Kuwait police had arrested Melwin for bringing banned substance into the country.

Melwin spent nearly nine months in Kuwait jail before being released following the untiring efforts of his wife Carol, with the help of high-ranking officials, government agencies, and the coastal community people living in Kuwait. In the meanwhile, Carol had filed complaint in the town station here, alleging that Richard holds two passports.

Carol also complained to the chief minister, minister U T Khader, former union minister Oscar Fernandes, Veerappa Moily, and D V Sadananda Gowda by meeting them personally, besides writing to the union external affairs minister. She also met western range inspector general of police, Amrit Paul, and explained the injustice her family had gone through. Under his guidance, a fresh case was registered in the court, and the case was given to deputy superintendent of of police, Dr H N Venkatesh Prasanna.

Prasanna, after taking over investigation, found out that a person named Roshan Crasta had transferred funds to the bank account of Justine in Canara Bank from Kuwait. The police wrote to Dollarco Money Exchange, Kuwait through the bank and sought identity proof of Roshan Crasta. Prasanna found that the photo of Roshan Crasta matched with that of Richard Castelino.

The police obtained passport details of Crasta through immigration. They thereafter found that Richard had two different passport in different names. The couple was arrested on the basis of this finding.

    In this case, it is the mistake of the carrier of the parcel also that he did not counter check it before accepting it! No authority will just leave you if you carry something illegal and then say I did not know about it! Similar convictions have taken place in the infamous Mumbai blast case where a lady was convicted for having accepted and kept in her house a cache of arms without knowing the contents!!

    Secondly, the wrong doer being a low profile worker in what way would he have helped this guy out of the situation! It is natural, but many may fume, that he went underground to save himself trouble! However much one may deny it is basic human nature that when the going is good, all is fine, but when some big trouble creeps in we either deny, ignore, or push the buck to save ourselves!!

    Thirdly having a duplicate passport has no connection with this incident whatsoever and it is his baby and he will face the consequences of that!

    Now that the wrong doing party has had the conviction to give in writing an affidavit about what they had done with the bill of purchase of medicine in the station itself shows that their intention was definitely to save the victim, just imagine if they had not done this, there would be no proof at all that they have given the medicines to them!!

    So, in context of all this, it appears to be a wrong doing with no wrong intention to the carrier gone foul and all were put to trouble!!

    It is better to amicably end this matter rather than flare it up as it will bring no peace either to the doer or the victim in my opinion!!

    The above is a very personal opinion seeing the wider picture and with a forgiving thought!! Jai Hind!!

    Mr. Rudolf why are you defending Castelino family? They were fully aware of these drugs and they tried to create trouble for Fernandes family. Castelino family deserves heavy punishment. They don't deserve mercy. They should not have done this to innocent family who had to be in Kuwait jail for such a long time without job and Melwyn Fernandes is still struggling to get a job. They lost their reputation in the society.

    If an Indian has one passport or ten passports, why should others worry about it? So long as the passports are used to seek employment and earn a decent living by honest work in the Gulf, is it not that the family will have a better life, why to block it just because one has more than one passport?We have poverty and unemployment here. Ask any Englishman, if he has only one passport? I know of a case where I sent the passport for renewal in Oman for renewal and the owner, an Englishman left the country, I alerted the boss, and he smiled!!This was in mid eighties.

    The parcel handed over by Richard's wife Justine to Melwin contained commercial quantity over-the-counter drugs. People around the world, especially in the alcohol-controlled Middle East, are known to consume these drugs as a form of substance abuse. Hence the GCC countries are firm on eradicating the menace.

    Based on earlier reports, the drugs were not bought in Mangaluru, but in Mumbai. It is a clear giveaway that Justine was fully aware what she was doing.

    But India may not have many laws to cover the sales/purchase of such drugs, even in commercial quantities. So Justine might escape punishment. However, let the law decide how she should be treated.

    She could still be punished for being an accessory to the fake passport (of Richard) case. She certainly knew that he was sending money to her in a fake name.

    People in possession of fake passports have received sentences of six months of rigorous imprisonment in Indian courts. Once the prison term is complete, Richard might want to go to Kuwait again.

    I request Melwin to write to the Consular, Passport & Visa Division, Ministry of External Affairs, Government of India, to block issuance of another passport to Richard.

    Those who say that Melwyn Fernandes should have forgiven are completely wrong.
    The case is not of Melwyn Fernandes is persued here, but that of Fraud.
    Having two passports with different names in India, is a crime in respect of Indian constitutional law.
    Two passports or more different is only held by fraudsters, terrorists and anti nationals. Same case as the traitors doing.
    Let Indian law take its course, according to penal law.

    Finally justice prevails. No lawyer should fight Castelino couple case. If they do, it will be injustice to the family of Melwyn who had to undergo so much of trauma all this time.
