Bengaluru: High court stays case against minister's son, Bose

Bengaluru, Aug 18: On Wednesday August 17, the high court granted interim stay against a case registered against Sunil Bose, son of PWD minister, Dr H C Mahadevappa. Bose is facing the charge of abetting accepting of bribe by an officer for granting permission to conduct illegal sand mining.

The single judge bench of the high court presided over by Justice Anand Byrareddy, which heard the petition filed by Sunil Bose, granted the stay on technical reasons,duly observing that the lower court had not strictly followed prescribed rules. Lokakyukta advocate strongly argued against staying the case, but the court said that temporary stay for non-adherence to rules is being granted, and that the Lokayukta is free to file application to lift the stay.

The court also ordered the advocate for the defendants in the case to file objections and posted the case for hearing to August 19. Advocate for the petitioner, C H Jadhav, pointed out that the third sessions court at Mysuru should have served notice first, followed with hearing of arguments and then fix charges. He argued that the court had violated rules by framing charges first before issuing show cause notice.

The case pertains to an officer, Alphonso, of mines and geology department, having caught redhanded by Lokayukta police on March 27, 2016
