Bengaluru: HC refuses to exempt former Lokayukta from personal appearance

Bengaluru, Sep 22: The state high court (HC) clearly refused to issue interim stay against the summons served on former Lokayukta, Y Bhaskar Rao, for his personal appearance in a case of corruption filed against him. On Wednesday September 21, the single judge bench presided over by Justice Anand Byrareddy heard arguments for sometime before dismissing application moved by advocate for Bhaskar Rao to exempt him from personal appearance.

The court, during the hearing questioned as to where was Justice Rao hiding or disappeared. It wanted to know as to why he carried files if he was go to Hyderabad. It also sought to know the reason for writing a letter seeking to conduct investigation on complaint by Krishnamurthy by an external agency.

The court felt that Justice Rao was aware of the wrongdoings of his son. It observed that otherwise there was no need for him to decamp and sent leave application from elsewhere instead of attending office everyday and working from there.

"If your client has not done anything wrong, why is he afraid of appearing before the subordinate court? Let him boldly face the investigation. Even when allegations were levelled, he could have worked from office instead of taking long leave," the bench observed, addressing advocate for Justice Bhaskar Rao, senior advocate S M Chandrashekhar.
