M'lore: Clarence Pais for Legislation Favoring Non-agricultural Mulgeni Tenants

Mangalore, Sep 11: Veteran city lawyer Clarence Pais, has on Wednesday September 10, urged the state government is urged to enact legislation to confer absolute rights on 'mulgeni' tenants with respect to non-agricultural property held by them on lease. He cited his support for such tenants in Dakshina Kannada and Udupi districts, through a press release.

He suggested the enactment of suitable legislation to this effect by way of an ordinance or an act of the Legislature.  Absolute rights with respect to agricultural leases were conferred under the Karnataka land reforms act which has been upheld by the courts awith reference to the ninth schedule of the constitution. However, non-agricultural property and any tenancies relating to such property are not included in the ninth schedule of the constitution.

     Mr Pais kindly recollect the days when Agricultural lands were given to the tenents only on an 15 years time not to sell the land, but 90%of the tenents sold this land and became very rich by knocking of this land from the landlords for a song.

    Now you are suggesting this mulgani gymic I am sure that you dont possess any Mulhgani lands thats why you are suggesting this. Just for your info, Mulgani come under the transfer of property act which is an central act it has to be passed by the centre not you or your karnataka govt. Make sure if this happens that the landlords get compensitated properly atleast 50% of the selling prise.

    Now comming back to the Agri land where are the tenents tilling the lands now, they have all sold dont make it 15 yrs but for ever from generation to generation they should till the land not sell for big fortunes and roam in Skoda Cars Think Well Happy Reading want to have a Debate with me .

    Congratulations Mr. Pais. This will be your great service to humanity. People should expect district in charge minister's statement or veiw on this matter. He cannot hide or escape from his responsibility towards people who elected him.

    Minister Eshwarappa when visited Udupi promised to abolish the strange system of Mulagheni tennancy system which is not existing anywhere in India. Where is promise stands? Welfare society cannot live on empty promises, people want action and results. In 100 days of rule the present govt. gave only promises, no progress. This is a good issue, govt should act quickly and enjoy or boast its good work. It is nice to see a great lawyer with peoples interest in mind has taken up this issue. Mr. Pais go ahead, a large number of tenants are with you.

    This is a very important suggestion in the area of public interest. If government give absolute right to the tenants that is going to be a great service to the tenants who will never forget the govt. of this gift.
