I was Helpless in Protecting Honest Officer: Karnataka Lokayukta 

Bangalore, Jun 24 (IANS) : Karnataka Lokayukta (ombudsman) Santosh Hegde, who resigned in frustration Wednesday, expressed helplessness in protecting an honest officer from being suspended for exposing the disappearance of illegal iron ore seized by his team in March.

"A cabinet minister wanted an officer to be suspended for having exposed attempts to export illegal iron ore from Belekeri port that was seized by our team in a raid on March 20. When the officer sought my help, I could not do anything," an agitated Hegde told reporters after tendering his resignation to Governor H.R. Bhardwaj.

Singling out the mining lobby for indulging in illegal mining of iron ore in north Karnataka's Bellary district and the massive corruption behind such activities, an anguished Hegde said he could not continue to be a mute spectator when he was not able to protect an honest officer who was obeying his or his colleague’s orders.

"Is this the reward (for an honest officer)? My officers have suffered. I decided I should not continue if I cannot be their protector, especially when I know they are honest officers," asserted Hegde, a former Supreme Court judge and son of former Lok Sabha speaker K.S. Hegde.

Referring to the disappearance of five lakh tonnes of illegal iron ore valued at Rs.250 crore out of the 3.5 million tonnes seized in March, Hegde said the actual stock could have been five million tonnes.

"You can imagine what would have been the loss to the exchequer if the entire stock of 3.5 million or 5 million tonnes of iron ore had been exported or disappeared?

Assistant forest conservator Narendra Hittamalamakki, who was investigating the case, June 6 found five lakh tonnes from the confiscated stock missing from the Belekeri port where it was stored following a directive from a local court at nearby Ankola.

When port authorities learnt that the missing stock was illegally exported to China, the state mines and geology department ordered an inquiry.

The state forest department also filed a complaint in Ankola police station against 11 firms, which were under investigation for being involved in transporting illegal iron ore from Bellary mines.

As a quasi judicial anti-corruption investigation agency, the Lokayukta directed the deputy conservator of forests, Karwar, to register a case of theft and breach of trust against officials of the Belekeri port and customs authorities for allowing the seized material to be shipped without legal clearance.

The Karwar deputy conservator also complained to the chief vigilance commissioner against the customs officials for allowing the export of the seized iron ore from the stockyard.

In a related development, the Union Ministry of Mines directed the Indian Bureau of Mines to probe the disappearance of the seized iron ore, suspecting a nexus between the mining sharks and top state government officials.


A sense of defeat and despair

Bangalore, Jun 24 (DHNS): The Lokayukta has finally thrown up his hands in despair. In a typical response, when asked if he was giving up the fight against corruption, Santosh Hegde shot back saying that he had to be ''allowed to work'' to function effectively. 


That summed up the tone of his press conference later, where the Lokayukta expressed his unhappiness at the government blocking his efforts to book corrupt officials. Angry, emotional, resigned.. this was the Lokayukta who vowed to continue his fight against corruption on a different platform. But at no point did he indicate that he was likely to change his mind about his resignation, if some of his longstanding demands were met.

Expressing his incredulity at an instance where a suspended officer (caught on charges of corruption) was reinstated to the same post, the Lokayukta said senior officers had stated that they were revoking the suspension of the officer because the Lokayukta went to the press in an angry tone against the reinstatement. “Suspension cannot be revoked on the anger or compliments of the Lokayukta,” he said.

The Lokayukta made repeated references to feeling powerless and being unable to make any concrete moves towards curbing corruption. “I feel helpless and useless,” he declared.

The latest move of the government to suspend an officer in Karwar who had carried out his duties in accordance to the wishes of the Lokayukta was the last straw. The reference was to the DCF of Karwar, R Gokul, who along with Lokayukta had seized iron ore worth crores from Karwar and Belakeri ports. Though Santosh Hegde neither named the officer or the Minister who was trying to get him suspended on the flimsy charges of not having attended a meeting, the Minister in question is allegedly the Environment Minister Krishna Palemar.

Lokayuktaspeak

- Yes, I may be doing injustice to people. It may be the other way round. It may be justice for some others.

- My decision is firm. I am not the one who will use resignation as a tool to blackmail the government.

- I feel helpless. Merely catching people won’t serve any purpose. Reinstating the same officials in the same position and in the same places even after the Chief Minister’s assurances of not doing so is a slap on the face of Lokayukta. How would a retired Supreme Court Judge feel about this?

- My father would always say, ‘If you are not wanted at any place, don’t stay there for a minute.’

- My resignation will not make any difference in my attitude of fighting corruption.

- If you want the Lokayukta institution to survive, appoint a Lokayukta and a Upa Lokayukta.

-  At present, the Lokayukta institution is not available for the poor.

-  If I can’t protect my honest officials, why should I be in power?. My helplessness in not helping honest officials poses physical and professional danger to them.

- The Government neglected, ignored and deliberately overruled the Lokayukta institution.

- I mentally suffered much during the last three months.

- Writing a letter seeking suspension of an honest official is a sin worse than being corrupt.

- Between 8000 to 9000 cases are awaiting action by Upa Lokayukta.

- Three defamation cases were registered against me. Two were dismissed. I will face the third one.



Reactions of prominent persons to resignation of Santosh Hegde


It is sad that Lokayukta Justice N Santosh Hegde has resigned. The government has taken action on his report on illegal mining and the Action Taken Report (ATR) has also been released. However, I am unaware of the illegal export of iron ore from Karwar port, as alleged by the Lokayukta. The chief minister and senior ministers in his cabinet will discuss the development on Thursday.

This is a black day in the history of the State. The Lokayukta is a man of  impeccable integrity and honesty.  When H D Kumaraswamy was the chief minister he tried to bring in an ordinance with regard to the same, which was not approved by the then governor.

Principal Conservator of Forests U V  Singh had also conducted a detail inquiry into illegal mining in the forest areas.  But the government did not act on these reports leading to his resignation.

    The citizens of India must think why Justice Hegde gave rsignation. I think surely for two reasons. One reason He might be bribed by Karnataka State governmnet [BJP Ministers] and second one he is frutrated and forced to resign by BJP government. As I know the first reason may not be true because he was really night mare for all stupid officers and to the BJP government body. So the BJP leaders planned together and delayed all JUstice Hegde's request and including CM forced him to resign by cheating him. We don't want one more group in Karnatka state like NAXALITES. Mr. C.M. please be HONEST and do the right job. Remember the death is there to all. You can not bribe GOD. Take care and ask Mr. Hegde to take back his resignation and let him do his good job.

    We used to laugh at Bihar and point our finger @ them when we used to talk about corruption but it is a fact that Karnataka must be the most corrupt of all the states in the country. our achievements are communal violance, corruption, half done roads ,pot hole filled high ways thick skinnd politicians looting the states resources ,politicians bringing laws to help the builders ,corrupt schools & colleges managed by politicians asking for donations ,corrupt government department where files dont move if not bribed,swindling of money received for development work..to name some of them..these are achivements and our elected representatives feel proud of it .Sadly One party is worse than the other in our state.I SALUTE MR.HEGDE FOR YOUR BRAVE EFFORTS TO ROOT OUT CORRUPTION.

    Mr.Hegde has cited three reasons for his resignation:Non-appointment of Upalokayukta, reinstatement of officers suspended to the same post, and a recent recommendation made to the Chief secretary by a Minister to suspend Deputy Conservator of Forests, Karwar who on the direction of the Lokayukta seized 8 lakh tonnes of iron ore illegally transported to belagairi port. The said iron ore was kept under court custody.Out of which 5 lakh tonnes of iron ore was illegally taken away by the mining mafia. Government did not move an inch to initiate action against port officials and 10 mining companies involved in it.

    Who was this Minister Mr.Hegde referred to.It was none other than a minister from our District Sri J.Krishna Palemar.

    On 21.06.2010 Palemar has writen a letter to the Chief Secretary to suspend the DCF stating that the said offcial had been absent from the meeting convened by the Minister of the 10 mining company.
    It is shame on Palemar to take such a action on an honest and intelligent officer and his sin of not attending the meeting was worse than being corrprut. It is well evident that Palemar spends most of his time in Mangalore looking after his Real Estate Business.He hardly attends his office in Vidhan Soudha, Bangalore. His office remain locked most the days in a year. He pressurises the Government officials in D.K.Dist to dance to his tunes. Those who oppose his unlawful orders are victimised either with a transfer or suspension.

    One cannot straighten a dog's tail. This is what has happened to India after 1950 when it became a Republic. From 1950 to 1973 the country was ruled only by congress party and under the rule of Nehru and Lal Bahadur Shastri we had a clean rule. Since the stepping Indira in Politics and then the follow of various political parties (99% family owned parties) came into existence with the only purpose to loot the country as much as possible. As a result the bureaucracy got a upper hand in supporting the politicians to be part of the loot and subsequently the lower cadre of govt employees. Corruption does not start from lower cadre people but it starts from top. If the top eats Rs. 100 let me eat 10 and what is wrong. Democracy is only at the time of election and once the election is over whichever party wins then starts the looting right from the treasury to the natural resouces. It looks like we the civilized people and for the common man the time has come to fight another freedom war and that is against our own democratically elected govt and the bureaucracts. It is time that people get out of their houses get on to the streets to take control of govt properties that are being looted by these leaders like it happens in Thailand and South Korea. The people of India are very emotional and do not believe in violence but in peace. IT is time that the present Governor calls for dismissal of this corrupt BJP Govt where the voters had faith after seeing 55 yrs of Cong.failure

I want to just recall the history...during Late Mr.Ramakrishna Hegde govt in 1980s I think...given full power to CBI in karnataka in the begining.. immediatly CBI put him in trouble on somebody's instruction... immediatly power had been withdrawn,it is the known fact,so it is the quastion of trust...Resignation is not the solution I believe...when he is unable to discharge his duties...let some able candidate come and do this job.Corruption is not restricted to karnataka alone,it is right from the begining of Indian democracy every where it is same or more.At the moment who is less corrupt ..it is importenet...so people decided Mr.Eddy and team is good,here the many people are commenting like heaven fallen down..people who have really voted...they are silent...No body can topple BJP govt in karnataka till Eddy has got MLAs mandate.It is Indian democracy and politics...100%satisfation is impossible.....

    This is not a blotch on current ruling party. Irrespective of the party, this happens in Indian political ruling. The elected reps have no regard to democracy, constitution and justice.     Some readers had commented couple of days ago that BJP is setting right what Congress had destroyed. Ofcourse, now it is clearly evident what BJP is setting right.     It is very shameful on the part of the BJP government to have made a just nd upright man of the stature of Mr. Justice Hegde to resign. I feel due to the rampant corruption in the BJP government nd their protection and sheilding of corrupt officials and re instating them even when they have been caught red handed by the Lok Ayukta is really a matter of great shame on the part of the politicians. No just nd upright person can tolerate such nonsense nd so that was why Mr. Justice Hegde has resigned. Shame on all you corrupt politicians. How can corruption be eradicated if the ruling politicians themselves r corrupt. No use having or making any number of Lok Ayuktas if corruption is not eradicated from the top itself.

    (...) Only possibility for the father of the family (State) CM is to balance both. Lokayukta did his job. Public came to know the corrupt faces. People once aware definitely will not deal with such people. Isn't that enough ? What best a CM should do is transferring them to other jobs, demotion and keep a further vigil on them etc. People should change CM and his govt if he is not doing that least. Giving Lokayukta a supreme power will mask out the presence of CM or Governor.
    We are all about spontaneous change. We expect reforms by fort-night. Is it possible to see that change at once as Beaurocracy and corruption which was rooted here from the British period ? Let Lokayukta do his job. Let him highlight corrupt people. Let people hinder bribing for their work. Let society go clean. Let us shine. We the people becoming corrupt. We the people blaming corruption and Finally WE catch hold of ONE among OURSELF and say "HE" is corrupt.

    Momentary anger and momentary view everybody's right. Know the facts and think before you ink (or type).

    1. Necessity of Lokpal (A watchdog for all including PM) & Lokayukta (A watchdog for all including CM) was mooted by Late Morarji Desai. My first salute to him. Congress(I) never spoke about implementing it as it was the idea of Morarji.
    2. It was instrumentalized in Karnataka by Late Ramakrishna Hegde. My next salute to him.
    Yes. Lokayukta is an independent body and did good jobs during the period of Justice Venkatachalaiah & Justice Santosh Hegde. In Karnataka it was Venkatachalaiah who showed people that there is a person to watch public servants of their work irregularities and corruption. It was also the demand of Venkatachalaiah for ultimate power to prosecute the crooks. Ironically when Venkatachalaiah drags the corrupt people to public court and made news in the same way as Hegde did now Hegde had some different opinions about Venkatachaliah. Strange right ?
    If Lokayukta has supreme power then we don't need Governor, CM & Legislative body. If government is not working then the people has the right to change. CM is like father of a family. When Lokayukta catch a corrupt official, that official or his relatives cry for pardoning with sometimes assuring that they will not do it in future. Now you imagine the situation of CM. He is now in between the corrupt person pleading for help and Lokayukta with prey & guns !!! (Contd....)

    Extremely serious issue, the Chief Minister Yediyurappa should resign immediately. When the Lokayuktha , who is in a grade of Chief Justice of Karnataka has made such serious allegations against Chief Minister and his government , has he any morality to continue in the office? If he doesn’t resign voluntarily, the Governor should report to the President of India about the failure of constitutional machinery in the state and recommend president’s rule. I call it a failure of constitutional machinery because the BJP government has made a mockery of Karnataka Lokayuktha Act , 1984 and hence done a serious contempt of court. The BJP government has done so many unlawful activities in the past but the allegation by Justice Hegde is an unpardonable crime and it is unacceptable in a democratic setup.
    Having said that, I don’t find the need for the resignation by Justice Hegde. If he was not in a position to function, he had enough remedies prescribed under the Act itself like the remedies under Section 12(5) and Section 17 (A). He had the power to report to the Governor even against the Chief Minister , then why he hasn’t gone for such remedies?
    By resigning, Justice Hegde has made easy the life of Yediyurappa and his colleagues. Now there is no one to stop or question these greedy people from looting Karnataka absolutely. A very sad day in the history of Karnataka indeed.

    It is very much evident from the appearence and talk of Honourable Justice Santhosh Hegde that the Karnataka Lokayuktha suffers from external political pressure to carry out his work. Whether it is present Govt. or past Govts. that have come and gone, the fact remains the same (As he himself said that all political parties are one and the same). One thing is very clear that the present Govt. must take serious decision to recall him to the post by giving him all necessary powers to help the people who face injustice in an honest manner and to eradicate the menace of corruption.
    The Govt. should understand that as long as his powers are not extended, it is in vain to appoint a person to that post. The Govt. and Politicians must also acknowledge that Lokayuktha is not an hand maid to protect the interests of corrupt officials and to dance according to the music of ministers. The leaders of various parties must stop unnecessary comments on the resignation of Mr. Justice and join hands with people of good willing to set right the mistake of Govt. in the interests of general public.
    I am sure the Govt. realises its mistake and takes firm steps to set right their blunder to protect their own faces from embarrasement.
    Let us hope for the better.

    iT IS UNFORTUNATE. Now it is the duty of the Public. All NGO of the state should join together and approach the CM and Governor of Karnataka to withdraw the resignation. Government must assure Lokayuktha that the required support will be given to him and immediatly act/pass the ordinence. At times I am also loosing the faith in the system... What to do...     It is injustice to the entire state. Politicians have become a curse on us. They work for themselves not for us. Least bothered about us. There is no need of a department like LOKAYUKTHA when the people rule the department is corrupt. What he said is correct, I heard even in mangalore city corporation (MCC) the officers who are suspended on corruption charges have been asked to join the office. I would not be surprised if some person, who is facing corruption charges become a new LOKAYUKTHA . . We have to do something . . otherwise we may hate to live here in future.
