Mangaluru: 2010 air crash - High court quashes private complaint

Mangaluru, Mar 12: The high court has quashed the private complaint filed against Air India, Aitports Authority of India and officials relating to the flight from Dubai which crashed when landing at the airport here in the year 2010.

A single judge bench of the high court presided over by Justice Ashok G Nijagannavar passed this order, dismissing the comlplaint filed against the Airports Authority of India and its oofficer, Peter Abraham, as well as Air India Ltd and its officer, Ansburt D'Souza.

The court nullified the second JMFC court's action in taking cognizance of the private complaint. The high court treated the action of the JMFC court as illegal as it had overlooked the fact that the lower court had closed the charge sheet filed based on the earlier complaint. It noted that the accused, pilot of the flight had died in the crash.

The Air India flight had crashed, killing 152 persons on board with six survivors. Mangaluru-based 812 Foundation had filed the said complaint on March 6, 2012, duly accusing the concerned of operating flights even though the airport was not fit for this operation, facilities whichi should have been provided at the airpot had not been provided, and argued that the negligence of Air India and the department of civil aviation had caused the flight to crash.
