Bangalore, Jan 21: Ending the uncertainty, Karnataka Governor H R Bhardwaj on Friday gave his sanction for prosecution of Chief Minister B S Yeddyurappa in the land scams and other charges of corruption.

The Governor announced his decision of according sanction to the two city-based lawyers Sriranjan Bhasha and K N Balraj on their petition to initiate prosecution of the chief minister hours after rejecting the decision of the state cabinet not to concede the demand.

Bhardwaj said the lawyers can initiate the prosecution in an appropriate court of law under various charges of grave allegations of corruption and criminal misconduct under Section 19(1) of the Prevention of Corruption Act, 1988 and Section 197 of the Criminal Procedure Code, 1973.

Meanwhile, Yeddyurappa, has in an official statement has termed the Governor’s decision to accord sanction for his prosecution ''even before any preliminary or giving any opportunity” on a complaint by private individuals as ''most unfortunate and highly politically motivated.”

The ruling BJP has retaliated at the Governor’s decision by giving a call for observing a state-wide bundh. Police have made elaborate security arrangements while many examinations scheduled to be held on Saturday have been postponed.


Schools and colleges in Bangalore will be closed on Saturday in view of the bundh. Many districts are also likely to follow suit in view of the spontaneous protests reported in Bangalore and other districts.

''This is nothing but broad day-light murder of democracy and justice,” the chief minister said accusing the Governor of misusing his office to carry out his political agenda.

 ''From the beginning he has been behaving in a biased manner as an agent of Congress and JD(S),” he said pointing out that ''what the Opposition parties could not achieve directly through the mandate of the people has been achieved through the office of the Governor and Raj Bhavan.”

''The Governor, being a constitutional head of the State, has acted in an arbitrary and partisan manner giving a go-by to the principles of natural justice,” Yeddyurappa said attacking the Governor for not seeking ''any opinion from the council of ministers or the government on the complaint petition.

''I leave it to the people to decide what is right and what is wrong. The people of Karnataka will see through the evil designs of those who are upset with the progress and development achieved by me in the last two and half years,” he said.

Asserting that there was no instance in judicial history or any arbitrary decision like this without recourse to an enquiry, the chief minister declared: ''I have full faith in the judicial system of this country and I will come out clean.”

It may recalled that the Governor had sent a strongly worded letter to the chief minister in response to the communication not to accord his consent for the petition by the two advocates for launching criminal prosecution against him, stated that the ''sum and substance of the cabinet decision is, it simply requires me to put a lit on the serious allegations of corruption against you.”

''The Governor is entitled to and required to take an independent decision on the basis of the material available and therefore the cabinet decision recommending to drop the consideration of the petitions is itself unwarranted,” Bhardwaj informed the chief minister ahead of taking the decision to accord the sanction.

Bhardwaj had, in his letter to Yeddyurappa, quoted a Supreme Court ruling and held that ''democracy would be at stake if sanction to prosecute higher functionaries is refused despite a prima-facie is clearly made out.”

''It would then lead to a situation where people in power may break the law with impunity, safe in the knowledge that they will not be prosecuted as the requiste sanction will not be granted,” the Governor had written to the Chief Minister. 

Yeddyurapa, on the other hand, had earlier in the day, demanded an apology from Bhardwaj for making his disparaging remarks on the cabinet resolution against granting sanction for prosecution as ''ulta chor kotwal ko dante” (the thief admonishing the law enforcer) and said it amounted to calling a duly-elected chief minister representing over 6 crore people as a ''thief” and it was an insult to the state and its people.

Though the opposition Congress and JD(S) can be expected to launch an agitation to demand the resignation of the Chief Minister following the Governor’s permission to launch criminal prosecution against him, the Yeddyurappa regime and the ruling BJP is planning to launch a counter agitation demanding the immediate recall of Bhardwaj. A delegation of all BJP MPs from the state and Central leaders are expected to meet President Pratibha Patil in Delhi on January 24 seeking the Governor’s recall.


Yeddy Attacks Governor for Not Giving Copy of Sanction Order

Within hours of the Karnataka Governor H R Bhardwaj according sanction for prosecuting the Chief Minister B S Yeddyurappa on alleged corruption charges and land scams, the latter has shot off an angry letter attacking Bhardwaj for not giving copy of the sanction order.

''After learning from media reports that you have accorded sanction for prosecuting me on the basis of petitions filed by two advocates, I had immediately deputed one of our senior officers from the CM’s
secretariat to Raj Bhavan to collect a copy of the said oder,” Yeddyurappa said in his letter to Governor.

But, the chief minister, lamented that the officers deputed from the Chief Minister’s office met both the Governor’s Principal Secretary and the Governor requesting a copy of the order. However, the request was denied by the Governor himself, Yeddyurappa said.

''It is very unfortunate that being a constitutional head of the state, a copy of the order was not handed over to me and the information of such order was divulged to the press,” Yeddyurappa said in his letter.

''In this connection, I would like to bring it to your notice that so far I have neither received a copy of the complaint nor an opportunity to explain my point of view,” the chief minister said adding: ''I hereby once again request you to provide the copy of the said sanction order immediately.”

    Fist of all regarding A.S. Mathew's comment where he has mentioned"hurted" this word does not exist in the English language ,even if American use it secondly if the chief minister is a self respecting man ,he will resign and face the court, if he is innocent he will come back.
    Enough of politicians ripping off India. W e aren't foolish anymore, get the hell out of office and behave like a normal citizen, you aren't a king yeddy. The Governor is only doing his duty. The government is corrupt and has to go.

    • Indias loss in the 3G scam is approximately Rs 1.7 Reddys
    • Indian politicians have siphoned out Rajas of dollars of ill gotten public money and parked in Swiss Banks.

    The Governor has only three point agendas in mind:
    (a) Save Congress and JDS from the clutches of Justice Padmaraj who is investigating land D-notification since 1994.
    (b) Embarrass the central leadership of Congress playing constitutional cards, always with flows putting central leadership under catch 22 situations, and compelling them to interfere and take corrective measures. Agenda is simple, does not like the Governorship and wants to be a Minister at Central.
    (c) Humiliate BJP day and night, whichever forum or medium available the typical Congress mentality –“a political rival is your personal enemy”

    Again BJP use this episode again to their advantage & try to create sympathy wave in favor of Yeddy, stating that:
    (a) Central, Governor, Congress and JDS teamed up 4th time to overthrow Yeddi
    (b) They want to dislodge a democratically elected Govt. undemocratically with the help of Governor again and again
    (c) Governor has not given any opportunity to the cabinet or the CM to explain their point view and released the prosecution order directly to the media without giving copies to the parties involved.
    (d) Last 3 years ,since inception of BJP Govt in the State, the Congress and JDS not allowed the Govt. to function properly not a single day

The daylight murder of democracy was when Ramasene attacked churches and innocent people in Mangalore when you grabbed hectares of land when you tried to divide the people with your cheap communal talks when swamy nityananda ceased to be swami anymore when a poor man dies of hunger. You are looting the democracy as we speak your goons burnt the buses without even realising that it is their own tax that will compensate these losses. Do not provoke innocent public. Do your job properly and no one will have any reason to rob the democracy.

    You can see the BJP mindset in these demonstrations. BJP wants the stringent laws whenever corruption scams are unearthed in other parties but when it comes to them see the reaction.

    Mr. Yedyurappa and his thieves required to be punished for all their misdeeds. I heard the latest news which says that confisicated iron ore at Belekeri port was sent to china by MLA Anand Singh and the company belonging to Reddys. I will be happy when Reddys are behind bars and all the loot is recovered by them.

    Bhardwaj has proved time & again that his post is depndent only on congress & he is just helping the centre to dislodge the state government for declaring fresh elections,from day one of the current government congress was hell bent in trying to put down the government,as it is people are burdened of the corruption,looting,inflation in everything,now we have to spend another amount in crores for the reelection,which people must think!! These congress goondagiri has costed the nation many a crores by reelections through bringing down of the elected opponents.

    King or begger.. in democracy there is no disparity. Law and order should be same to both. If BSY is guilty, he should be punished. Chief Minister cannot swallow the money of public. He is elected by people and not inherited his post from his forefathers. Every paisa is our tax, which is gone to state revenure through our blood and sweat. It is accountable. Yeddy's, Reddy's and Cheddy's cannot loot that by threatening to give a call for state bundh. Two lathi's on legs make this nonsense people queit.     Yeddi is not BJP & BJP is not Yeddi.
    Unlike congress,
    where Sonia/Rahul Gandhi is congress and congress is Sonia/Rahul Gandhi.

    The people of Karnataka voted for BJP and not for Yeddi. The more the opposition uses the governor to oust Yeddi from the CM's position, the more stronger the BJP will return in the next elections.

    Instead of the oppostion playing all sorts of games to destabilise the governament, it would be better, if they would use their time and energy to work for the people of Karnataka and gain their confidence, so that,they will have better chances to win the next elections.

    Even if Yeddi is prosicuted and whatever the outcome may be, it will have hardly any negative impact on the BJP, as far as the next elections are concerned.

    Dear Honorable Governor, revive the case of the murder of Mr. Yeddyurapp's wife. Who murdered his own wife? The water tank was 7 feet height and water in the tank was 4 feet when she was traced dead in the tank. The wife of Mr. Yeddyurappa was 5 feet. Is it that she self committed suicide by jumping into the tank and forget to standup!!!!!!!!!!
    There will be a forced closure of Karnataka and this will not be a spontaneous bundh. Of-course may be in Mangalore some may willingly close and others will be forced to close. The District administrations must be care full in video taping for forced closures. The governor has excised his constitutional power to go ahead for prosecution. Probe will be done by the Judiciary. The anger of C.M. shows he will loose the power.

    One should ask who is acutually mudering Democracy. The Governor is excercising his duty granted within the constitution. If the CM is really innocent then there is nothing to worry about. But causing a state bundh and all other tamasha will cost the people crores of rupees. It is the PEOPLE who want to answers about the corruption. By acting childish like this the CM proves that there is some fire beneath the smoke. Letting corruption go scotfree is not part of any democracy.
