Yeddyurappa Not to Seek Stay of Bhardwaj's Order

New Delhi/Bangalore, Jan 23 (IANS):
Chief Minister B.S.Yeddyurappa on Sunday said he will not move the high court seeking stay of Governor H. R Bhardwaj's order sanctioning his prosecution over corruption charges as he came to the national capital to discuss his future course of action with senior party leaders.

"No, not going to approach high court," he told reporters in New Delhi when asked whether he will petition the high court for stay of Bhardwaj's sanction order.

"Private complaint has been lodged (against him in a Bangalore court). Let us see what will happen," Yeddyurappa said after meeting party central leaders and consulting legal experts.

Bhardwaj granted sanction to two advocates late Friday to launch criminal proceedings against Yeddyurappa, brushing aside strong objection from the chief minister as well as his cabinet.

The advocates, Sirajin Basha and K.N. Balaraj, Saturday filed two complaints in a Bangalore court and plan to file more Monday.

Yeddyurappa said a delegation of BJP central and state leaders and MPs from Karnataka will meet President Pratibha Patil Monday to apprise her of Bhardwaj's conduct.

Yeddyurappa and BJP have accused Bhardwaj of working as "an agent of Congress and (Congress-led) United Progressive Alliance government." The delegation is expected to urge Patil to immediately remove Bhardwaj as Karnataka governor.

Yeddyurappa also said he planned to meet union Home Minister P.Chidambaram to brief him about Bhardwaj's conduct.

Yeddyurappa has accused Bhardwaj of not giving him an opportunity to present his case about the complaint by the two advocates.

He has also said Bhardwaj had first refused to give a copy of his sanction order and did so only when a group of ten ministers met him Saturday. 

During his meeting with party central leaders in New Delhi, Yeddyurappa sought their advice on his course of action to face the prosecution case filed by the two lawyers.
Soon after reaching Delhi, Yeddyruppa was closeted with senior party leaders to discuss the political and legal strategies to face Bhardwaj's action.

"I will strongly recommend to the party high command to seek the recall of the governor by the president for his attempt to destabilise a democratically elected government in the state," Yeddyurappa told reporters in Bangalore before leaving for New Delhi.

The chief minister, who declined to quit Saturday, asserted that he would fight till the end to prove that he did not commit any offence and complete his five-year term.

In Bangalore, a senior official said that the chief minister flew to Delhi to apprise the party leadership on the political developments in the state following the Bhardwaj's sanction for his prosecution and seek advice on the next course of action.

"The chief minister will decide in consultation with the party leadership whether to challenge the governor's prosecution order in the Karnataka High Court on Monday for staying the proceedings in the special Lokyayukta (Ombudsman) court where two criminal cases were filed on Saturday by the two advocates," the official from the chief minister's office, speaking on condition of anonymity, told IANS.

The twin cases - on the charges of land grabbing and de-notification (freeing from government control) by the chief minister - are slated to come up for hearing Monday on their admissibility in the special court of Judge C.B. Hipparagi.

Besides Yeddyurappa, his two sons-B.Y. Raghavendra, a Lok Sabha member from Shimoga in central Karnataka, and B.Y. Vijayendra, his son-in-law R.N. Sohan Kumar, former BJP minister S.N. Krishnaiah Setty and Davalagiri Property Developers Ltd, partly owned by his kin, have been named co-accused along with other close associates in the cases.

The cases were filed for offences allegedly committed by the chief minister and his kin under various sections of the Indian Penal Code (IPC) and the Prevention of Corruption Act.

The permission to launch criminal proceedings against Yeddyurappa was sought by the two advocates Dec 28 following revelations that Yeddyurappa had favoured his kin with prime land in and around Bangalore.

Former BJP president Venkaiah Naidu demanded the recall of the governor, saying Bhardwaj, by his action of sanctioning the prosecution of Yeddyurappa, has undermined democracy.

The BJP would raise the issue in the forthcoming budget session of parliament, Naidu told reporters in Andhra Pradesh's Vijayawada city, adding the continuation of Bhardwaj was detrimental to the relationship between the central government and the states.

    One thing amused me is that Yeddy and his son only went to Delhi that means most of his friends distancing him??Does it show Yeddy's downfall is certain?Yeddy, completely isolated under prevailing situation.Now those who are CHAIR LOVERS may be looking for others !In one ocassion I am wondering (DBC-ex cong)D.B.     For Yeddy all the roads lead to jail. He quits he lands in jail as he won't find a Godfather like Raja found in Karuna. He fails to get stay order from High Court then also he lands in jail as that proves him guilty then and there. But a person who is in dilema of whether to be in jail or at office continues to be Karnataka CM. What a shame!

    HC,certainly do not stall proceeding of the Sessions court due to the fact that all cases are prima facie established and it is too early to intervene in this subject to HC.To avoid emberrassment, battery of known Lawyers in Delhi advised him not to seek STAY @ this juncture.

    I DOUBT YEDDY IS CM OF KARNATAKA OR DELHI COZ MOST OF THE TIMES HE IS IN DELHI THAN IN BANGALORE.

    SINCE LAST THREE MONTHS HE HAS MADE 46 VISITS TO DELHI TO MEET HIS USELESS AKA'S(HC) AND ALL THAT AT PUBLIC MONEY.

    A caveat has been filed-& the chances of granting a stay on Governors order without hearing the caveat holders is nill. Even without a caveat the High Court never stays any polictical actions-refer what it did when 16 MLA's were disqualified, not even Supreme Court grants any stay so easily-to save his face from getting blackened further if Courts refuse to grant a stay he chose the right course in not asking for one. Legal opinion might have pursuaded him to take this step-otherwise the one who took all the Vama Margas to remain in power since the govt., was formed, he would have tried this as well. Just wait & watch-many more dramas will unfold in this never ending story.

    Now Yeddi is staying behind to go against Governor's order. Why he is not willing to put a stay? Let us see the real face of BJP.
    1. When BJP came to power they bribed many MLA's and brought to their party . Where was the moral what they are talking today. If a candidate was elected in any other party symbol then, it should be respected by all. Operation KAMALA is totally insulting the voters and murder of democracy.
    2. When Boopa the legislative president totally used his power as per BJP and RSS instruction to disqulify the elected MLA,s. Why BJP is not accepting their role to distroy the democracy and back stabing the people.
    3. When Governor is doing his job and asking the ruling party to work with in the frame of justice, law, with out partiality, and honest, this BJP and RSS never bothered to listen him and did all coruption, rapes, murders, and cheating in all the ways. This government is having AIDS and need serious attension. If not it will spread to every citizens and need these AIDS people to be kept in ISOLATION {Jail}.
    4. BJP is not having the right to say that every citizen is against the verdict of Governor and say it is bad to Karnataka. They can say it is bad for BJP and for their coruption. Finally we all must remember when BJP was in center they released very dangerous Terrorist and said nothing about it. Same way BJP released many people in Karnataka who are belong to RSS, Bgagrang, VHP, and Ramasena. This Bloody BJP is not having any moral to Rule.

    Yeddi should fight the legal battle to the end by letting the prosecution go ahead. What is the fear that he should seek Stay of Bhardwaj's Order if he is innocent? Even Nagesh Naik would agree that there is no need to seek a Stay Order because Sheeman Yeddi is not guilty. Stand up if you are really upright and don't seek to Stay Governor's Order, and prove that you are a honest gentleman, Mr. CM.

    Why comment on this "poor" CM, Shreemaan Yediyurappaji? He does not even have a set of proper suit to wear, and wears the same one every time he goes to Delhi. Please refer the article on 18th January, "Yeddyurappa Rushes to Delhi for Consulting BJP High Command". I pity this shameless guy without any mannerism. He looks like a fish out of pond. Pre-independence era there was sathyagraha against the foreign rule, but now its by the people against their own rule.
