If Cabinet says No, Governor Cannot Order CM’s Prosecution: Nariman

Bangalore, Jan 24: Governor H R Bhardwaj’s decision to accord sanction to the two city-based advocates of Justice Lawyers’ Forum to launch criminal proceedings against Chief Minister B S Yeddyurappa on the land scams and other alleged corruption charges against the specific advise of the Council of Ministers was improper, according to noted Constitutional expert Fali S Nariman.

''The Governor has no power to order prosecution of a Chief Minister if the Council of Ministers has advised him not to do so, he said pointing out that the Governor was a constitutional head and must act on the aid and advice of his Council of Ministers.

In a Constitution Bench decision of the Supreme Court in 2004, the court had unequivocally said that unless the Council of Ministers disabled or disentitled itself to take a decision about whether the Chief Minister should or should not be prosecuted, the Governor "may not have any role to play,” Nariman contended.

Even if the Governor invokes some residual power in himself, he must then offer to resign and the things will take care of themselves. The courts will then decide whether he has the power to order such a prosecution on his own.

''This is the only way in which Governors can keep out of politics,” he said pointing out that the Governor must leave the political parties to go to court for a direction that he is empowered to sanction prosecution of the Chief Minister even though he is a constitutional head and the Chief Minister and the Council of Ministers are responsible to the Legislative Assembly.

According to Nariman, the Chief Minister was responsible to the Legislative Assembly and it is for the Legislative Assembly to show a lack of confidence in him if it so chooses on the ground of his corrupt act.

Nariman said the petitions of the advocates seeking the Governor’s sanction for prosecuting the Chief Minister pertaining to the matter that was to be determined by Karnataka Lokayukta Justice Santosh Hegde and it does not appear that he has recommended to the Assembly that the Chief Minister should be prosecuted.

''If he (Justice Hegde) had done so, then technically speaking, as the appointing authority, he (Governor) could, perhaps, relying on the recommendation of the Lokayukta, have ordered the sanction to prosecute the Chief Minister,” Nariman said.

However, there may be some scope for the Governor on some notions of his own residual power to grant sanction. But in the absence of such a recommendation from the Lokayukta, it would be improper and not constitutional for the Governor to act on his own, Nariman said.

    C.M.(c = corrupt, m = man)Yeddy consulted Ram Jetmalani about his case n jetmalani advised him to resign n face the trial. But he ignored. Nariman forgot the fact that all cabinet ministers are corrupt and they are all involved in it. Brasta janara party.

    Hello who is this Nariman? Just forget the law and use human sense.whether he is poor or he is powerful law should be the same for everyone. Laws are made for our good. But our lawyers have got brains to interpret the law as per their thinking. Governor has not sacked Yeddi but given into the hands of law. I don't understand why this hue and cry.

    These people think with their brains(refer the sentence which is beneficial to them, never mention the sentence which goes against them). India will improve when these lawyers start thinking from their heart and stop searching the loopholes using their brains.That is why we have little faith in the judiciary which can be bought at a price. Without the media the condition would have been still worse.

    Yesterday @ Suvarna news an eminent lawyer of Karnataka, shown a sketch of the land denotified by Mr. Yeddy (on the basis of the same sketch the two lawyers filled the case against Yeddy). Yeddy denotified a small pieces land left over after denotification made by his predecessors and told that the major denotification was made by H.D. Kumaraswamy and previous Governors. For Yeddy there was no other option left except to denotify that small pieces land. The lawyer warned that if court accepts the case, then predecessors of Yeddy are in more trouble than Yeddy. I.e. Yeddy is more relaxed now and told will not file a case against Governor’s decision.

    Nariman is paid for every single sentence that he speak during this week.The Governor is not a lay man but a experienced supreme court Lawyer.The Governor has wisely noted that the sanction was given not to a government agencu such as CID or CBI but to two private lawyers and this not covered as per views spelled out by the lawyer Nariman.

    Constitutional exprt Fali S Nariman's opinion has exposed the real intention of the so called great Lawyer(lier) Guv Bharadwaj wherein he has opined that if the Council of Ministers says no, Guv can not go against their wish.Here Guv, the great Lawyer of the country has done blunder and will become a laughing stock for the people of Karnataka.Now the best thing is that the great Bharadwaj should pack of his luggage and book a flight ticket to Delhi at earliest possible time to further save his face and join Congress for active politics.That is the best option.Jai ho Yedyurappa..Jai ho BJP...Jai hi Karnataka...

    With all due respect to Mr Nariman, I presume that he has taken up a ive approach in this matter. The 2004 judgement of SC bench of 5 judges that included even Santhosh Hegde has made it clear that that the Guv can grant sanction to prosecute the CM, even overruling the state cabinet decision. The only exercise he has to do is to conduct a preliminary enquiry. In the present case, Guv has done so by summoning various files pertaining to the matter from the govt. Further Guv needs to heed the cabinet's decision only in the case of former CM or ministers. As I mentioned in one of my earlier comments, this is not the first case even. Channa Reddy did so in the case of Jayalalitha while Kidwai made Lalu to face music. The the 2004 Supreme Court constitutional bench judgment literally sealed the fate of corrupt CMs and ministers, as it ruled that the Guv can act in his discretion against the cabinet's advice in the matter of prosecution.

    While hearing the case, the bench significantly observed "We also presume that a cabinet will normally act in a legitimate manner, fairly, honestly and in accordance with the law. However, there have been several instances where they take bias and irrational decisions on certain issues. Therefore, the cabinet resolution should not be considered on such a sensitive issue." Guv has acted in accordance with the Law but the only problem is that our 'immoral CM (phrase taken from the litany of Gadkari) has long forgotten the meaning of Law
