Kalmadi Gets Bail After Nine Months in Jail


New Delhi, Jan 19 (IANS): Suresh Kalmadi, accused of corruption in the Commonwealth Games here, is set to walk out of prison after nine months as the Delhi High Court finally accepted his bail plea Thursday.

Justice Mukta Gupta allowed the bail application of Kalmadi and his aide V.K. Verma for a personal bond of Rs.5 lakhs with two sureties of the like amount subject to the satisfaction of trial court.

But while granting bail, the court told them not to leave India without judicial permission.

Kalmadi, former head of the Indian Olympic Association (IOA) who once boasted of bringing the Olympics too to India, is likely to be released at night, his aides said.

The court, taking note of the delay in trial, said there was no evidence that Kalmadi would threaten witnesses or interfere with evidence.

As witnesses had spoken without fear and there was no evidence that they had been intimidated, there was no likelihood of they being threatened.

"There is no allegation that (Kalmadi and Verma) are likely to flee from justice," said the judge.

Kalmadi was arrested April 25 last year for his alleged role in awarding a contract to set up the Timing-Scoring-Result system to Swiss Times Omega at a cost of Rs.141 crore, allegedly causing a loss of Rs.95 crore to the exchequer.

The Central Bureau of Investigation (CBI) opposed the bail plea.

The New Delhi Commonwealth Games, attended by 54 countries, was trailed by controversy, charges of financial mismanagement, bungled preparations, contractual fiasco and mudslinging between those at the helm.

Kalmadi's bail order evoked mixed responses.

While Congress leader Digvijay Singh said bail was the right of every accused, Balbir K. Punj of the Bharatiya Janata Party said the bail "does not declare Kalmadi innocent".

IOA vice-president Tarlochan Singh said it was up to Kalmadi to decide whether to return as the IOA chief.

The court observed that the chargesheet was filed on May 2011. Two supplementary chargesheet followed.

Kalmadi and Verma moved the court for bail after the Supreme Court observed in the 2G case that bail must be the rule and jail an exception.

The accused and two companies in the case were charged under the Indian Penal Code for cheating, criminal conspiracy and forgery, and booked under the Prevention of Corruption Act.

Seven other accused, including Kalmadi aides Lalit Bhanot and M. Jayachandran, are in Tihar Jail in what was seen as the biggest scandal in India's sports history .

    Chidambram will stand up and say he will help Kalmadi with 5G technology for OLYMPICS 2020..

    Yeddy or Raja or Kalmadi - they are not yet convicted. Keeping them in jail for months together based on mere allegation is wrong. Improve our judicial system to provide swift justice.
    By the way if Kalmadi opens his mouth more troubles are in store for Congress!

    All comments about this issue and arguments and counter arguments are very good, but as a individual how much efforts I put to enlighten my neighbour and a trump card with valid vote to explain that the politicians who are coming to our door step are going there to make money at our expense. Do we by any means as a Community thought the candidate each party has ed is good or a tainted man? No we have some political party in our mind and irrespective of his character we vote to that party and he is becoming billionair overnight and forget the poor voters where he came begging for votes.There is one saying in Kannada "Madiddunnu Maharaya"

    Going through the comments given by some of the readers, it seems that they know more than the High Court Judges. Taking names,blaming people who are not even remotedly connected with this scam does not look good. We call ourselves educated people. Just having knowledge doesnt mean that we are educated.Even in computers lot of knowledge saved.     It is said, Indian constituency is the best in the world and Indian Intelligence Bureau stands as third best in the world .This is the thing taught to us and we beleive this as a truth.

    We have seen people who were riding cycle before became politician and also seen same guy riding Mercedes Benz of his own in his term of 5 years. We know a ordinary clerk working for a Notary Public lawyer who became politician and then MP who owns property worth muli Billion now. This is the story of 95% of the politicians in India either in the parliament or Assembly.

    Did our intelligence department shown any interest of finding the source of income or wealth of these persons until they comes into limelight ? Is the law quite strong enough to punish these in quick time ? Is any able lawyers there in India who can upheld truth always ?

    It is very much disappointing when realizing the truth.

    One or other RAPING Bharath Matha, our motherland daily and we are sitting helplessly without doing anything.

    Causing Rs. 95 Crore to Public Exchequer is the major issue for our UPA led Central Government, where as Rs. 17,60,00,00,00,00,000/- means 176,00,000/- Crore of Loss to even not yet born next few generations are not a issue at all?
    For Rs. 95 Crore loss Kalmadi spent 9 months in Jail. So just imagine jail terms of 2G Scammer in total for all those involved.
    I think one day Subramaniam Swamy goes to jail for exposing 2G scam I believe!!!

    Indian law is meant to punish only the common man and the one who steals 500 Rs. and if he is caught by the public they might even kill him, our law is not applicable for those who steal our 500crore Rs. it provides VIP treatment to them in jail and one fine day they come out on bail, enjoy their life with high security and finally they are totally out of the case, we public read such news..abuse and keep quiet...now who is there to raise the voice against them?...me,,,you...or do we depend on Anna..? or do we just pass our comments on daijiworld and count how many agree and disagrees
