Corporal Punishment Could Land Teachers in Jail for Three Years

New Delhi, Oct 28 (PTI):
Resorting to corporal punishment in class or forcing students to purchase books, uniforms and other stationery from a particular shop could land one up to three years in jail, according to a draft Bill on curbing unfair practices in schools.

The draft 'Prohibition Of Unfair Practices in Schools Bill', 2012 makes it clear that no school shall directly or indirectly demand or accept capitation fee or demand any donation for admission to any class.

The draft legislation, which would be presented before the Central Advisory Board of Education (CABE) meeting here on November 1, also prohibits schools from denying admission or expelling any student if he/she is reported to have any serious diseases such as HIV/AIDS.

Schools can neither indulge in any kind of corporal punishment or withhold students to appear in any examination for which they are eligible and desirous of appearing.
Besides schools cannot expel any student due to poor academic performance or detain them arbitrarily, the draft says.

The proposed legislation comes as complaints were mounting against the unfair practices of schools.

Though the draft Bill has remained silent on the quantum of monetary penalty to be imposed, it states that the imprisonment could extend to three years or fines or both.

It said school shall not charge any fee for information brochure, prospectus, admission form or an admission test and provide all such information on its website or notice board. Fee collection during mid-session has also come under the scanner.

The provisions of the draft Bill states that any capitation fee or donations collected in contravention of the provisions would be confiscated by an order of appropriate government 'state school education tribunal' or 'national school education tribunal' or a state or national body.

According to the draft Bill, no school shall insist for private coaching in the school or outside after the school hours. They also cannot insist for purchase of books, uniform or any other related materials from the school premises or a particular shop.

Schools would be penalised for providing false or misleading advertisement. The Bill also recommends admission to VI, IX and XI standards through tests.

    This is most suitable law and a mind opener for teachers. Teachers must remember that they too were student once. Child can always be councelled and corrected. 21st century does not tolerate child/student abuse worldwide. Already we come across number of cases on daily basis.In U.S.A. parents have no right to beat their children.

    Is there any one who can deal or control the School or Jr.College Fees taken at the time of admission, end of the first term, then the second term etc. Is there any control over the school-college prospectus information provided by the them is not the one at the time of collecting fees !!! Is there any provision or control over the detailed receipt to provide for the payment???? some of the school colleges are completing the first term (!) where not even taken 20 working days!!!

    @Dr S Kamath , Mumbai. Mild punishment like hitting palm with ruler , pat on the back , pinching the ear should not be treated as any offences . This differs from child abuse u r talking about. These punishment are necessary to invoke discipline and respect among cadres. Child abuse happens even at homes , and is very difficult to bring under gambit of law. @ prabhu mangalore , very rightly said brother . Domestic harrasement laws should be made gender neutral . Its not surprising supreme court termed it legal terrorism. A days back court discouraged to try in laws and parents filed in FIR. Yes , but husbands have not legal support if framed. In other words all r sitting ducks!. And this barbaric one sided sexist law is only in india.

    Nothing will change with laws alone unless our we change ourselves from unrighteousness, wickedness, selfishness, might is right, greedyness and abusives. We have sufficient laws to curb any misdeeds, lacking is implimenting and convicting needs to be focused.
    I do not think a teacher will beat the child in revenge. In the history of India may be some 50 cases can be counted and it is negligible. To curb this kind of laws will not benefit growing children's future.

Please go through the Child abuse and the research conducted on this topic .Several hundreds of research has been conducted on this Topic and the WHOLE WORLD HAS COME TO A CONCLUSION THAT BEATING CHILD WILL LEAD TO A BEATEN ,LOST CONFIDENCE ,FULL OF ANXIETY FUTURE CITIZEN .This fact has been proved beyond doubt and there were very negligible cases of false cases in Children .I myself was a Teacher . .I am writing this with conviction having visited many many of Schools in Mumbai and interacting with Children through one of the NGO .This is a very big problem .Regarding teachers if they teach well then neither Children nor Parents will Complain please note

    TO IMPLEMENT CHILD LAWS IN INDIA WILL TAKE SOME DECADES. LIKE..............

    CHILD IN A CLOSED CAR
    SMOKING WITH CHILD AROUND
    CHILD IN THE FRONT SEAT
    SEAT BELT/SEAT IN CAR FOR CHILD
    ETC ARE THE VARIOUS OTHER CHILD LAWS
    INDIA IS FAMOUS FOR ITS UNREASONABLE ,DRACONIAN LAWS WHICH HAS NO JUSTICE AND ARE MOSTLY ONE SIDED.
    IF THE DOMESTIC VIOLENCE ACT WAS IN FORCE BEFORE MY MARRIAGE I SWEAR I WOULD NOT HAVE GOT MARRIED AT ALL....
    I CAN'T EVEN CALL MY WIFE DARLING IN A LOUD VOICE...SHE CAN SUE ME EVEN AFTER 10 YEARS.SO MUCH FOR LAWS OR FANTACIES OF LAWMAKERS.

    We have come up in our carrier because some time we too got punishment because for one or other reasons.Present day children(mobile Zamana,) Mischief's student can not control in the class room.Because of this one or two students must be Given punishment.NO other way Actualy Teachers only know the difficulty in handling the class.Little Punishment must be given,Otherwise Teachers will be no ware.Punishment must be Lenient type.

    @ Dr s. Kamath , dear friend . I Know bill has been in the best interest of student. but what about framed or fake cases . This can spoil teachers life too , three years is too much. And also he/she has hungry mouths to feed at home . I believe there should be certain clauses in bill , punishing fake complaints , which can be tried under juvenile courts. This may stop framed cases. .....:......... Bill to prosecute parents ?!, i think it won't be practical or feasible in india , people will reject this ideology looking at rising juvenile crimes in west.

    Excellent Law .I appreciate this but this should be really implemented .One of the Most Important I repeat very very important Fallacy in laws of this kind is the Whistle blower ( Complainant )Child will be neglected by the Teacher .To Prevent this there should be a National level call centre tel no and one call should be enough and also the Officials those who visit Schools should first Caution ( no punishment )concerned teachers without naming which student has complained .Then only this law will be useful .If the teacher is a repeated offender then only punish Otherwise useless .Fearing neglect by the teachers no body will complain .So what is the solution ?
    1. All the parents should teach or put children to Tuition so that Teachers burden is lowered 2. In the PTA meetings raise this issue 3.Be very Friendly with the Children so that they will report to you in case of any such beating by the Teachers . Dear

    Does the new laws apply to the Indian schools in the Gulf...?? Will the Embassies of India in different countries will have the power to monitor their implementations.

    Also what about schools run by religious orders or Secular Parish Schools....Will they also come under the purview of the new laws...???

    We send our children to school to learn better education & discipline. Most of the time Teachers are better positioned than Parents to control our children when they do wrong. But applying so many corporal punishments on Teachers means I think we put too much pressure on modern Teachers!! I hope that Teaching profession too scared away by this law or our children got too much freedom to enjoy their students’ life rather than becoming good future citizen

    The draft is very lenient on students and parents/guardians. They can often misuse against teachers. Also what about meassurements to safeguard teachers welfare?!. One has to understand they get pressure from all sides..... Principal , Inspectors , Students , Parents / Guardians. So what next...... A bill to punish parents who beat children!?. Its a joke , where we heading? . At present most bills are misused by peaple and taken advantage. Eg: domestic violence and sec 491 A. The only best part about this bill .....it should stop schools from taking ransom fees and donations.

    Times have chganged. Earlier, authority was exercized by instilling fear in subordinates, whether it is servants, family members, pupils, etc. It is modern era and we have to move according to contemporarily relevant ideology and practices. Do not try to descipline students by beating daylight out of them. Win them with love, attention, setting example by own behaviour.
