Historic Lokpal Bill passed in Lok Sabha, Anna breaks his fast

New Delhi, Dec 18 (Agencies): The historic Lokpal Bill today took a giant step towards enactment after a 40-year wait, with the Lok Sabha passing it a day after the anti-corruption measure sailed through the Rajya Sabha with the support of opposition parties.

At the village Ralegan Sidhi in Maharashtra, Gandhian activist Anna Hazare and his supporters cheered here as he broke his fast after two school children offered him coconut water. As soon as the news flashed on TV screens, there were screams of joy and merriment in the gathering and a frail Hazare gathered strength to stand up on the dias.

"Jai Hind, Vande Mataram, Bharat Mata ki Jai," he cheered on the microphone, acknowledging the greetings and happiness of the people gathered there. Many people broke into nationalist and devotional songs.

Hazare had launched the hunger strike vowing to continue it till the bill was passed during the current winter session of parliament and made a law.

The lower house had allocated four hours to debate the Bill, which proposes a national ombudsman to investigate wrongdoing in government, but wrapped it up in less than an hour and voted on it, amid slogan-shouting by Andhra Pradesh MPs opposed to the creation of Telangana.

Senior BJP leader Sushma Swaraj, the Leader of Opposition in the Lok Sabha, appeared to target the ruling Congress as she criticized attempts to take credit for pushing the Lokpal Bill.

"People are lining up to take credit, but there is an old man who keeps fasting for the bill and appeals to our collective conscience. And then the people of this country deserve credit," she said.

"It is our responsibility to complete our unfinished fight against corruption," said Congress leader Rahul Gandhi, whose party has credited him with leading the Lokpal push ahead of the national election due by May.

"The Lokpal Bill is part of the UPA's comprehensive anti-graft framework," Gandhi said, calling for an extension of the current session to pass six more Bills to check corruption.

The ruling Congress' extreme zeal to ensure that happens is being seen more as a result of the massive losses it suffered in assembly elections. In Delhi, which it had ruled for 15 years, the Congress was felled by Arvind Kejriwal's one-year-old Aam Aadmi Party, which made a stunning debut based on its promise to fight corruption.

The government's key ally Mulayam Singh Yadav and his Samajwadi Party staged a strategic walkout after slamming the Bill. The party was yesterday talked into backing down on its threat to block the Bill at any cost.

 

Salient features of Lokpal bill

Following are the salient features of the amended Lokpal bill passed by parliament:

1. Lokayuktas: The new bill mandates states to set up Lokayuktas within 365 days. States can determine the type.

Under the old bill, law was applicable to states only if they give consent. Under old bill, the central government had power to appoint state Lokayuktas; the new bill gives this power to the states.

2. Constitution of Lokpal: The Lokpal will consist of a chairperson and a maximum of eight members, of which 50 percent shall be judicial members. Fifty percent members of Lokpal shall be from among SCs, STs, OBCs, minorities and women.

In the old bill, the chairperson was to be the Chief Justice of India or a present or former judge of the Supreme Court or a non-judicial member with specified qualifications (chief justice or a judge of a high court).

3. Selection of Lokpal: The selection committee will have prime minister, Lok Sabha speaker, leader of the opposition in the Lok Sabha and the Chief Justice of India. A fifth member of the selection committee for selection of Lokpal under the category of "eminent jurist" may be nominated by the President on the basis of recommendation of the first four members of the selection committee.

Under the old bill, President could select the fifth person.

4. Religious bodies and trust: The new bill includes societies and trusts that collect public money, receive funding from foreign sources and have an income level above a certain threshold. It excludes bodies creating endowments for or performing religious or charitable functions.

The old bill expanded definition of public servant by bringing societies and trusts and organisations which receive foreign donations (over Rs.10 lakh a year) under Lokpal.

5. Prosecution: In the new bill, before taking a decision on filing a chargesheet in a case upon consideration of the investigation report, the Lokpal may authorise its own prosecution wing or the investigating agency concerned to initiate prosecution in special courts.

Under the old bill, such power was only with the prosecution wing of the Lokpal.

6. Central Bureau of Investigation (CBI): For independence of the CBI, in the new bill a directorate of prosecution will be formed. Appointment of the director of prosecution will be on the recommendation of the Central Vigilance Commissioner.

Transfer of officers of CBI investigating cases referred by Lokpal will be only with the approval of Lokpal who will also have superintendence over CBI in relation to Lokpal referred cases.

7. Hearing: The new bill says a government servant will get a hearing before a decision is taken by the Lokpal.

8. Prime minister: The prime minister will be under the purview of the Lokpal with subject matter exclusions and specific process for handling complaints against the prime minister.

9. Investigation: Inquiry has to be completed within 60 days and investigation to be completed within six months. Lokpal shall order an investigation only after hearing the public servant.

Inquiry against the prime minister has to be held in-camera and approved by two-thirds of the full bench of the Lokpal.

10. Penalty: False and frivolous complaints - imprisonment up to one year and a fine of up to Rs.1 lakh. Public servants - imprisonment up to seven years. Criminal misconduct and habitually abetting corruption - jail term up to 10 years.

    ADD in Penalty Clause: if MP/MLA/Public servant found guilty Govt/Lokpal should acquire his/her property from the time he came power till date inquiry his/her family income relatives/in-law/son/daughter etc belongs to him/her.....only imprisonment non use...USELESS.

    Inspite of making this Lokpal Bill very weak with several loop holes, still the Samajwadi Party of Mullayam Singh opposed it with tooth and nail, which proves that SP is openly in favour of Corruption as SP members are all steeped deep in corruption and they want to continue to be pathetically corrupt.

    Actual credit should go to crooked politicians who wanted to play safe. The moment Arvind announced his decision to contest 2014 election and all seats in Gujarat,

    Just read in the IAC website. One feature of the Bill states "50% of the members of the lokpal shall be from amongst SC/ST/OBC's and Minorites. Reservation here also.

    So we now know the credibility of this Dongi Congi's Jokepal. Khangress don't leave a chance to play votebank in any schemes. No prizes for guess whom the caged parrots will serve now favoring whos intrests.

    Let me put it emphatically. The Lokpal Bill which both Congress and the BJP together played games 2 years back and scuttled to pass it in Parliament, has now woken up in a hurry to pass a lesser version of the Bill so that AAP party may not use JAN LOKPAL in their election manifesto and also in their vigorous campaigns. Even though the Lokpal Bill is not strong enough to contain corruption and send the guilty behind bars,(Arvind Kejirival says that even even a mouse will not go to jail with this Bill) it is passed only to ward off AAP party from being the anti corruption crusader and taking the credit. The Indian AAM AADMI is smart enough to understand the gimmicks of the Congress and the BJP.

     Congress played behind the scene game by asking Anna to sit on fast having decided to table the Bill in this winter session so that they both Anna and Congress could take the credit. Clearly it shows how Anna played into the hands of the Congress. Earlier Swami Angivesh was found to be a Congress mole in the IAC movement. Now it appears the entire team accept those now in AAP Party were all Congress moles or agents. They finally played into the hands of the congress as it suited them. This is politics my friends.

    I am surprised by the comments below given by some of the readers. First, all were blasting because we don't have Lokpal. Then, we did but its wasn't Anna's Lokpal. Now we have one acknowledged and drafted by Anna Hazare, powerful politicians will get away. Anna himself has said that change cannot happen all of a sudden and the Bill can be amended later depending on the situations that arise and gradually we will have the strongest Lokpal. But no, some readers are still not satisfied. Well, if you all want immediate changes and end of corruption in a minute, I suggest play a video game based on politics for immediate results. Just agree, my fellow citizens and people of Indian Origin, that we are a lot of unsatisfied human beings who keep scrutinizing our country at every step.

    We compare sayin why cant India be like Dubai, or Muscat, or US, or London etc etc. People sit abroad and comment on corruption. But when we come to India, we are the first ones who initiate corruption by saying the following to your relative "Hey, can we pay money and get our work done faster because we have to visit our relatives and have no time to wait". You know why prices are high in Mangalore? We come from abroad and go to the market and to buy vegetables or meat and when the sellers recognize that you are an NRI, then will raise prices to 200% of the actual cost and we happily pay it thinking it shows our status to them. And this behavior gives the sellers to sell their goods at high prices. Have you every thought, what effect it would have on the locals? The sellers will quote the same prices and refuse any bargain thinking if no one buys, atleast one NRI will come and buy everything for the price we quote. So, these are the those minor things that we do, that have effect on others.

    The real estate prices in Mangalore is also artificially very high just because of NRI mentality you have mentioned. Every thing is more costly in Mangalore as compared to Bangalore just because of Mangalorean NRIs only.

    Worried ..with this bill no body will be going to give complaint against corruption because of the penalty clause. Penalty clause says if you give False and Frivolous complaints IMPRISSIONMENT up to ONE YEAR and a FINE upto Rs.1 LAKH. As all know bribe receiving or supply side are clever enough to destroy all evidences.So end of the day whistleblower will be in trouble. So he/she will not take risk of getting jailed or fined.

    Whatever gimmicks Sonia does to place rahul against Modi, its all in vain. people are not stupid.

    If there is a strong Lokpal bill/ lokayuktha, it would be the first family of congress to go behind bars first. That is the reason, Sonai has pushed this toothless bill.
    For all readers, a simple point in the bill is as below. read and judge.

    Anyone can file a complaint with Lokpal against any corrupt politicians or Govt. employees .
    if the compainant can not prove /provide enough evidences that the accused is corrupt, then he will be sentenced for 1 year imprisonment.

    Credit for this historic Lokpal Bill should not go to Congress, BPJ or any political party. They did nothing in the last 40 years.

    No party in India wanted this bill. Now because the election is approaching and also the threat from Anna and its subsequent result on the election performance, they have agreed.

    Nobody helped anybody in this passing of bill. For the political parties, it was just chosing between devil and the deep sea.

    Full credit goes to Anna and his supporters. Thank you Anna. Long live Anna.

    In the political circles, everyone is so busy taking credit of passing the lokpal but in my opinion, the credit goes to the poor show by the Congress in the 4 states, specially in Delhi and ofcourse to Anna Hazare who fasted so long for such law to come. Lets hope that if in future a requirement of super lok pal comes up as who can guarantee that this institution will not get infected with the corruption bug.

    Election result of Delhi pushed the congi government to pass the Lokpal Bill at the Lok Sabha. Credit should go to the people of Delhi who voted wisely and also to Aam Admi Party leader Mr. Arvind Kejriwal.
    Now Anna Hazare, Sonia, Rahul .... etc. are on the Q to get the credit. From today onwards Rahul in his election campaign only boast about passing Lokpal Bill by himself and his mother. Remember last time he was only talking about Food Bill and illness of his mother!!
    If every Indian follow the role model of Delhi people in the coming Lok Sabha Election, Indian citizens for the first time in history can feel what is Real Democracy, Independence. Kick out the corrupt politicians irrespective of any political parties and Save India's image in this world.
