HC reverses labour court judgement on compassionate employment

Bengaluru, Aug 12: The state high court, through an order passed on Thursday August 11, said that it would not be possible to direct the employer organizations to provide employment on compassionate grounds to the heirs of the deceased employees who die during the pendency of court cases after having been dismissed from service on charges of misconduct and dereliction of duty.

"Just because the charges levelled against the dismissed employee cannot be proved as the accused died during the hearing, a direction cannot be issued to the employers to provide employment to his legal heir," the high court said.

Revanappa. a conductor, had questioned the action of North East Karnatka Road Transport Corporation (NEKRTC) in dismissing him after finding that the charge of non-issuance of tickets to passengers after collecting money from them was proved, in the labour court. He however died when the case was being heard. Thereafter, the labour court ordered the corporation to provide employment to a close relative of the deceased on compassionate grounds.

NEKRTC appealed against this judgement in the high court, and the high court upheld the appeal.
