Bengaluru: High Court orders reopening of St Paul the Hermit Church

Bengaluru, Sep 20: In a major setback to Archbishop of Bangalore Most Rev Dr Bernard Moras, the High Court of Karnataka has upheld the order of the Bengaluru City Civil Court for reopening the St Paul the Hermit Church at Nagenahalli in RT Nagar, which had been Canonically shut down following the erection of the statue of Fr Chowrappa Selvaraj alias Chasara in the church premises, and has ordered that the Church should be opened by September 26.

The High Court has also that the Archbishop should appoint a priest to the Church by September 29.

However, the only concession or rather consolation to the Bangalore Archdiocese and Archbishop Moras was the High Court’s direction that the bust of Fr Chasara erected in defiance of the Canonical Warning issued by the Archbishop was to cover it in a nicely looking wooden case.

It may be recalled that Fr Chasara was accused in the murder of the then Rector of St Peter’s Pontifical Seminary at Malleswaram on April 1, 2013, midnight of Easter, as per the additional charge-sheet filed before the Principal City and Sessions Court. Along with Fr Chasara, the additional charge-sheet had named six other persons including three priests – Frs I Anthappa, A Thomas and Anbu John, and three others Ms Rita Rini, Raphael Raj and Anthony Prasad.

However, the 61-year-old Fr Chasara died in March and his supporters of the pro-Kannada movement had erected his bust within a month of the death in violation of the Canonical warning and threat of closure of the Church. Fr I Anthappa had already been granted bail by the Principal City and Sessions Court due to his advanced age of 86.

Incidentally, High Court had granted bail to all the remaining persons among the seven accused. The High Court had quashed the quashed the additional charge-sheet against recently.

In the first charge-sheet filed in 2014, five persons were accused in the murder of the Rector and three persons, including two priests Fr William Patrick and Fr Elias Daniel, and a lay person Carmel Peter were arrested. Two other persons listed as accused in the murder of the Rector and identified simply as Swamy and Francis are absconding.

Fr William Patrick was granted bail by the Supreme Court on July 24. Subsequently, the two other arrested persons accused of murdering Fr K J Thomas were granted bail by the High Court.

    Mr.Robert, you are right.After all by your standards our beloved Pope and the laws enshrined by hierarchy{canon] no laws at all. Normally,busts are erected after sainthood is d. The halmark of christianity is forgiveness.And this man refuses to forgive the Archbishop,[whether he is right or wrong notwithstanding] even at his deathbed,wherein he has a plea,his death not to be blessed by the Archbishop...
    Archbishop direction was to remove the 'bust'which was defied and the 'sainthood' d by these locals....

    - Bishop Moras and many other Bishops like him have openly defied Canon law and Papal Authority by refusing to promulgate the Tridentine Latin Mass that must be said in perpetuity!

    What you want to encourage? Bishop Bernard should have also defied canonical orders and encouraged erection of busts of everyone's likes and choices?

    Mr.Robert,
    Entire world knows what late Fr.Chasara has done to a fellow priest.Now he is enjoying the reward in heaven for failing to live the great commandment "DO NOT MURDER".We are ashamed of such priest.Then why do we need to have his bust as a memory of his crime?What answer do we need to give to non-Christian brethren?

    your queries have been answered while answering Mr.Naveen's Comments. requested to go through...
    I think probably you might have not met Fr.Chasara personally when he was alive nor watched him closely, otherwise you wouldn't have termed him as murderer. It was a high level conspiracy to frame him & others.He was a man of self disciplined, preaching and practicing the teachings of Jesus Christ. He never encouraged violent agitations throughout his life.

    Good intelligent decision indeed. Problem was not with the Church, but with Fr. Charasa's burst erected defying canonical order. Respected, disciplined, Bishop Moras abides the canonical order.
    Hon. Court showed the way out.
    It becomes quite easy to handle law abiding citizens. It's civil society.

    High court should order the Bishop to remove the burst as it is against the Cannon Law under which Church is functioning. The bhakts can go to his tomb and kneel down but not inside the Church premises in front of bust covered with wooden casket. Need SC intervention.

    Courts should not interfere in religious beliefs...nor interfere in interstate water disputes...it's not Courts job to determine who is a Saint and who is not...Also its not Courts job if women should be allowed inside Shabarimalai temple or Haji Ali....

    Ofcourse it is not Courts' job to decide who is saint or not, it should be left to their respective religions....but in this case Court never said Fr.Chasara as a saint. It only upheld the fundamental rights of the citizens to offer prayers in Church which is granted in Constitution of India. It also noticed the wound caused to the Church and advised a remedial action. By all probability Archbishop was in the very helm of being apprehended to Civil Prison as a Judgement Debtor in City Civil & Sessions Court. Luckily through the efforts of his learned senior counsel, he was able to find a face saving solution to the problem through the timely intervention of Honorable High Court of Karnataka. I think the HC has taught a lesson to Archdiocese on how to handle the crisis and subsequently save the Church from being damaged.Personal disputes and vengeance should be kept below the interests of the devotees. Teachings of Jesus Christ needs to be followed not mere preaching.....

    Mr. Robert, Do you understand or know what is canon law? You are talking about fundamental rights of citizens, but a group of that very citizens have erected the bust of Fr. Chasara who is an accused in murdering a fellow priest. Today they erected his bust, tomorrow every XYZ bust/statue will be erected in church premises by their families/supporters. Fr. Chasara is the same person who played language politics & you want his statue/burst be erected inside church premises???

    Dear Mr.Naveen, you are refering Fr.Chasara as an accused in the murdering of a fellow priest based on the additional charge filed by police citing the penal codes of this land's law....remind you that not under any canon law. While accusing a person you are refering you take the shelter of constitutional laws and when it comes to HC verdict you are hiding behind canon law. To the latest happenings here in Bangalore, I would draw your kind attention to the Judgement & Order passed by Honorable High Court of Karnataka on 30/08/2016 of quashing the additional chargesheet filed by police in Rector Thomas murder case where Fr.Chasara and others names were involved. My reference to fundamental rights of Indian citizens was on the prayers offered in the Church not on errecting a statue in Church premises. And coming to the first question about Canon law, I am least bothered to know and undestand as I'm neither a priest nor a civilian of Vatican city country. All I know is I am a proud citizen of India and follower of Jesus Christ.....

    Dear Mr.Naveen, to the latest status of the additional chargesheet filed by police in Rector Thomas murder case involving the names of Fr.Chasara & others, the Honorable High Court of Karnataka has QUASHED in an Order dated 30/08/2016.
    You are pointing a person who was being made accused according to the laws of this land. There was not a single canon law involved. Then if you were to follow canon laws, he is a clean person...please avoid double standards to the same issue. And to the knowledge & understanding of Canon law by me, I am least bothered as I'm neither a priest nor a civilian of Vatican City country. I am the proud citizen of India following the religion of Christianity and Jesus Christ.
