Court questions demonetisation without ensuring bank account for all


Kolkata, Nov 19 (IANS): The Calcutta High Court on Thursday questioned the rationale behind the central government's initiative scrapping high value currency notes without ensuring every Indian had a bank account.

Hearing two Public Interest Litigations moved against demonetisation, Calcutta High Court's Chief Justice Girish Chandra Gupta also questioned the central government's frequently changing circulars regarding the withdrawal, deposit and exchange of money from banks and post offices post the demonetisation move.

"People who work on daily wages mostly earn an amount that is non-taxable. What is the necessity for them to have bank accounts," Gupta asked Additional Solicitor General Koushik Chanda.

"What steps are being taken to ensure the convenience of physically handicapped people who are queuing up to get money," he asked.

The High Court also criticised the central government's decision to bring down the upper limit of exchange of old notes from Rs 4,500 to Rs 2,000 saying the present amount is inadequate for the common people to meet their daily expense.

West Bengal Chief Minister Mamata Banerjee welcomed the high court's stand in the case.

"I am grateful. Honorable President of India, as also the judges have to act in favour of people in trouble," Banerjee said.

An advocate had filed the first PIL describing demonetisation as a harassment for the commoners. A group of disabled persons moved the second PIL seeking change in the rules for exchanging old Rs 500 and Rs 1,000 notes for benefit of the physically challenged.

    With all respect to the point of black money killing, the common middle Class salaried class are very much affected. At this point of decent lifestyle (for which all civiliszed people work hard) its impossible to lead life with 2000 Rs exchange per person. Government first should have made sure the list of black money generators, create enough resource to refil/replace the need and then announce the demonetisation. Now while 20-25% may be black money generators and the rest are all common people like salaried, small business, small scale industries, who have unskilled workforce, who are paid wages in cash.. What is their plight?? How can any intelligent person like Finance Minister caliber just think and decide only 2000 rs is enough for a person!!! What kind of India are we living in??

     First they wanted to control the Eating habits, then to control what to watch?? Then whom to worship and when?? and now Cash crunch>>> Is this called better days for the common man?? When there are only handful people who generate or create black money, why the rest need to be punished or taxed or penalised?? Let us do things in larger interest.. It should have been made Bank accounts available for every legal citizen. Here there are citizens, do not have a house or land but have ration card in their name and the property belongs to someone else.. what kind of justice are we talking about??..

    When Modi spoke, Indians hoped for relief for them, while the black money holders will be punished very harshly.

    Yet again, they realised it is another fake encounter. Modi is harsh and mean to common man and savior of black money hoarders.

    Today they are infront of every bank to save their own hard earned money and savings which is thousands or at the most in lakhs. While they see the Blackmoney guys spending 500cr for a single wedding.

    While the digital warriors of fekuland, are working overtime, to save their masters, their actually betraying their own motherland. Some maybe ignorently but some with full knowledge. This is unpardaonable.

    Feku warriors whose only objective to put feku ahead of India, must be defeated.

    I was also feeling and writing about the same, that Govt should have ensured accounts of every adult Indian before scrapping of 84% currency.

    The court can not play utive role in the administrative decisions.The biggest beneficiary in the demonetisation is our nation. Minor inconvenience caused to the small percentage of population is highly regrettable . The crooked politicians are trying to shield themselves using these sufferers to protect their black money.

    All the court should first try to clear the queues in terms of cases in their respective courts and they should allowed to speak on people standing in queue

    Are you dictating the courts also?? As per the constitution Bank Account is not mandatory for every citizens. But every individual has the right to save their hard earned money. Govt cannot disqualify it overnight. If govt want to do it, inform the people and ask them to open the account. Now there is no other way, govt have to roll back the decision. India runs on the constitution, not under Modi's dictatorship.

    We are not dictating to any courts, we are just telling that courts are useless... When they have so many cases pending what steps did they take to ensure case queue becomes shorter...

    Supreme court has also told that its a good move and no need to rollback..

    So now terrorists sympathizers are on the street to protest because its difficult to run their houses..

    If people supports this move they will vote for modi in 2019 if not some other party will come to power

    Common man, judiciary system taken for granted. Courts are accepting cases filed by those families who lost their family member standing in queue. This is not democracy, people are forced to obey stupid orders done without any preparation.

    Scourie BJP MP and Excel Minister in an interview said this demonetization is not against black money because 1% of population hold 50% wealth and black money and 9% of population hold 35% of wealth and black money and that is invested or transferred abroad. So 10% hold 85% of black money and there is no action on this cream sector.
    Only middle class, lower middle class, farmers, teachers, medium salary employees targeted.
    Farmers and professional standing in queue so the productivity will be hit badly, scarcity of food and resources drive prices rocket high

    I am glad that Court is questioning the demonetisation without ensuring every Indian had a bank account. Its important to ensure that citizens faith on the complete system is not lost. Its important that Government should ensure that people are educated about cashless economy before taking measures towards cashless economy.

    Demonetization done in a hurry to put commoners and poor in roads to starve and struggle. It does not make any much difference for black money people as they have enough to survive and such people know how to distribute the money among their people expecting the return in one way or the other in the long run. Only affected people is commoners and poor people. It is like buring the house to kill rats.
