Women activists detained while protesting against CJI

New Delhi, May 10 (IANS): A large number of women activists and lawyers were on Friday detained and taken to the Mandir Marg police station while they protested against the clean chit given to Supreme Court Chief Justice Ranjan Gogoi in a sexual harassment probe.

The protesters, who started their protest from Mandi House in the heart of the city, wanted to march to the Supreme Court.

A protester, Anjali Bhardwaj, said: "Police did not lets us march to Supreme Court against the supreme injustice in the case of sexual harassment against CJI. We condemn the hearing in which a CJI-led over bench made remarks against the woman complainant. Are judges above the law?"

A former Supreme Court employee has accused Justice Gogoi of sexually assaulting her. An in-hour court panel had cleared the CJI of the charges.

We do not know what are the true facts.

But certain things are not clear in this case.

When a female staffer raises a sexual harassment issue against CJI:

    1. Why a proper investigation is not made but instead a special privilege has been given to CJI?
    2. Why the complainant was not allowed to represent through a advocate?
    3. There were also complaints that harassment has been done to her family members because of this case. Why investigation was not done on these complaints?
    4. CJI being the supreme authority in judiciary, should have been an example for others. But he himself was part of the panel which constituted the enquiry committee which denied basic rights for the complainant to represent herself duly. Why this was done?

The needle of suspicion for this stage /event management could be the Rafale review and attempts to pressurise if not blacmail the CJI.

Then what is the problem in holding free, fair and transparent court proceedings. In any court is a trial held without the presence of a complaintant?. Then is not both plaintiff and defendant handed a copy each of the trial report? Then is the judgement / verdict passed by colluding between only the judiciary panel without the complaintant having to say anything on her defence????... This whole trial was eye wash, protectionism and favouritism for the accused guilty.

    Anyone can accuse anyone.

The same Supreme Court had reported earlier that 90% of gender-crime (with accusers almost always women) turn out to be false accusation.

So, women in India need to wake up. Accuse, but then do not give contradictory statements! Stick to the crime, if there was one.

The woman in this case did not even want to participate in the fact-finding exercise.

She possibly that the accusation will cause the downfall of the judge.

Whatever the feelings are, go the right way in protesting and do not attempt to gherrao the Supreme Court. By doing what you are doing you are showing disrespect to the entire institution and thereby the whole nation!
